(2)

Whenever an accident that occasions loss of human life or personal injury is suffered by an employee as a result of the handling, use, or presence of or contact with or exposure to a pesticide in the course of his employment, his employer shall forthwith send or cause to be sent to the Minister notice of the accident and of the loss of human life or personal injury.

(3)

Whenever a registered medical practitioner finds or has reason to believe that a person has died or suffered personal injury as a result of the handling, use, or presence of or contact with or exposure to a pesticide, the registered medical practitioner shall forthwith send or cause to be sent to the Minister notice of the death or personal injury.

(4)

This section shall not apply to accidents occasioning loss of human life or personal injury of which notice is required by the

Hydrogen Cyanide (Fumigation) Act 1953 [Act 260] to be given to the proper Minister thereunder.

(5)

A person who fails to comply with any of the provisions of this section commits an offence and is liable to a fine of one thousand ringgit.
