Peraturan-Peraturan ini, dipinda dengan menggantikan peraturan 26A dengan peraturan yang berikut:

“Kultur probiotik 26A.

(1)

Bagi maksud peraturan ini, “kultur probiotik”

ertinya mikroorganisma hidup yang apabila digunakan dalam jumlah yang mencukupi memberi manfaat kesihatan kepada hosnya.

Kultur yang dinyatakan dalam Jadual Kedua Belas A atau dengan kelulusan bertulis terdahulu daripada Pengarah hendaklah menjadi kultur probiotik mengikut pengertian dan bagi maksud Peraturan-Peraturan ini.

Kecuali sebagaimana yang diperuntukkan selainnya dalam Peraturan-Peraturan ini, kultur probiotik yang dibenarkan

Kultur probiotik yang ditambah hendaklah kekal hidup dan bilangan probiotik hidup tidak boleh kurang daripada 106 cfu/ml atau cfu/g semasa hayat simpanan makanan itu.

Maka hendaklah ditulis pada label atas suatu bungkusan bagi makanan yang kepadanya kultur probiotik ditambah, butiran yang berikut:

Bagi maksud subperaturan (6), jika media yang digunakan bagi pembiakan dan penyelenggaraan kultur probiotik berasal daripada binatang, nama biasa binatang itu hendaklah dinyatakan pada label makanan dengan menggunakan perkataan

DIGUNAKAN

BAGI

PEMBIAKAN

KULTUR

PROBIOTIK BERASAL DARIPADA (nama biasa binatang itu)”.

Maka bolehlah ditulis pada label atas suatu bungkusan bagi makanan yang kepadanya kultur probiotik ditambah, perkataan “Kultur probiotik membantu meningkatkan fungsi usus atau salur makanan” atau apa-apa perkataan lain yang mempunyai makna yang sama.”.

FOOD ACT 1983

FOOD (AMENDMENT) (NO. 2) REGULATIONS 2017

IN exercise of the powers conferred by section 34 of the Food Act 1983 [Act 281], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Food (Amendment) (No. 2)

Regulations 2017.

(2)

These Regulations come into operation on 15 April 2017 except regulations 2 and 5.

(3)

Regulations 2 and 5 come into operation on 15 July 2017.

Substitution of regulation 26A

2.

The Food Regulations 1985 [P.U. (A) 437/1985], which are referred to as the

“principal Regulations” in these Regulations, are amended by substituting for regulation 26A the following regulation:

“Probiotic culture 26A.

(1)

For the purposes of this regulation, “probiotic culture” means live microorganisms which when administered in adequate numbers confer health benefits on the host.

(2)

The cultures specified in the Twelfth A Schedule or with prior written approval of the Director shall be probiotic cultures within the meaning and for the purposes of these

Regulations.

(3)

Except as otherwise provided in these Regulations, permitted probiotic cultures may be added to food.

(4)

The probiotic cultures added shall remain viable and the viable probiotic count shall not be less than 106 cfu/ml or cfu/g during the shelf life of such food.

(5)

The probiotic cultures shall not contain transmissible antibiotic-resistant genes.

(6)

There shall be written in the label on a package of food to which probiotic cultures have been added, the following item:

(a)

the words “CONTAINS (state quantity) OF

PROBIOTIC CULTURES”;

(b)

the specification of genus, species and strain of the probiotic cultures; and

(c)

the direction for storage before and after package is opened.

(7)

For the purposes of subregulation (6), where the media used for propagation and maintenance of the probiotic cultures are derived from animal, the common name of such animal shall be stated on the label of that food by using the words “MEDIA

USED FOR PROPAGATION OF PROBIOTIC CULTURES DERIVED

FROM (the common name of such animal)”.

There may be written in the label on a package of food to which probiotic cultures have been added, the words

“Probiotic cultures help in improving intestinal or gut function” or any other words of similar meaning.”.

Amendment of regulation 37 3.

Regulation 37 of the principal Regulations is amended—

(a)

in subregulation (1)—

(i)

by substituting for the words “and pesticide residue” the words “, pesticide residue and other contaminant”; and

(ii)

by substituting for the words “preservative, colouring substance, flavouring substance, flavour enhancer, antioxidant, food conditioner, non-nutritive sweetening substance” the words

“food additive”; and

(b)

by substituting for subregulation (3) the following subregulation:

“(3) Except for pesticide residue, no person shall import, prepare or advertise for sale or sell any food containing any incidental constituent, except as otherwise specified in these Regulations or in the

Codex Alimentarius.”.

Amendment of regulation 113 4.

Subregulation 113(3) of the principal Regulations is amended in the national language text by substituting for the words “bahan pengawet” the words “bahan perisa”.

Substitution of Twelfth A Schedule 5.

The principal Regulations is amended by substituting for Twelfth A Schedule the following schedule:

Amendment of Thirteenth Schedule 6.

The Thirteenth Schedule to the principal Regulations is amended—

(a)

in TABLE I—

(i)

in item “Small hollow-ware”, in column “Cadmium”, by substituting for the words “0.20 mg/l” the words “0.5 mg/l”; and

(ii)

in item “Large hollow-ware”, in column “Cadmium”, by substituting for the words “0.20 mg/l” the words “0.25 mg/l”; and

(b)

in TABLE II, by substituting for the words “MS ISO 6486-1” wherever appearing the words “MS 1817-1”.

Amendment of Fourteenth Schedule 7.

The Fourteenth Schedule to the principal Regulations is amended in TABLE I, in item “Soft drink: (ii) For direct consumption”, in column (4), by substituting for the word “0.5” the word “0.05”.
