IN exercise of the powers conferred by subsection 49(2)(i)
of the
Malaysian Quarantine and Inspection Services Act 2011 [Act 728], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Malaysian Quarantine and Inspection
Services (Compounding of Offences) Regulations 2019.
(2)
These Regulations come into operation on 1 May 2019.
Compoundable offences 2.
(1)
The offences specified in the First Schedule are prescribed to be compoundable offences.
(2)
The offences referred to in subregulation (1) may be compounded with the consent in writting of the Public Prosecutor in Form 1 of the Second Schedule.
Offer and acceptance of compound 3.
(1)
An offer to compound an offence referred to in subregulation 2(1) shall be made in Form 2 of the Second Schedule.
(2)
A person who accepts an offer to compound an offence referred to in subregulation 2(1) shall accept the offer in Form 3 of the Second Schedule.

Method of compounding 4.
(1)
After an investigation has been conducted and it is found that a compoundable offence has been committed as referred to in subregulation 2(1), the Director General or enforcement officer authorized in writting by the Director General, may issue an offer to compound the offence in Form 2 of the Second Schedule to the person who has committed the offence.
(2)
An offer to compound an offence under subregulation (1) shall be valid for a period of fourteen days or within such extended period as the Director General or enforcement officer may grant, and if full payment of the sum offered is made within the stated period, no further proceedings shall be taken against the person referred to in subregulation (1).
(3)
If no payment of the compound offered is made within the stated period in subregulation (2), prosecution may be instituted against the person referred to in subregulation (1) without further notice.
Payment of compound 5.
(1)
If an offer to compound an offence under subregulation 4(1) is accepted by the person to whom the offer is made, he may pay the compound—
(a)
by cash and delivered personally to the Department of Malaysian
Quarantine and Inspection Services or any branch as determined by the
Director General; or
(b)
by money order, postal order, banker’s order or bank draft payable to the
Director General of Department of Malaysia Quarantine and Inspection
Services and crossed with the words “Account Payee Only”.
(2)
If payment is made in accordance with paragraph (1)(b), the money order, postal order, banker’s order or bank draft shall be delivered personally to the Director General or sent by registered post to the address specified in Form 2 of the Second Schedule.

(3)
Upon receipt of the payment made in accordance with subregulation (1), the Director General shall issue an official receipt for such payment to the person to whom the offer to compound an offence is made.

COMPOUNDABLE OFFENCES
The following offences are prescribed to be offences which may be compounded:
(a)
The offences committed under provision of the Malaysian Quarantine and
Inspection Services Act 2011 as follows:

(iv)
subsection 15(1);
(b)
The offences committed under provision of the Malaysian Quarantine and
