Section 95
(1)
The plaintiff may, with leave of the Court, at any time before judgment withdraw any proceedings wholly or in part by giving notice in Form MS 19 to the Court and serving a copy of the notice to the defendant.
(2)
Where the plaintiff withdraws any proceedings under subsection (1), the defendant shall be entitled to the costs of the proceedings.
