Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 92I Kanun Tanah Negara [Akta 56/1965], Menteri, dengan kelulusan Majlis Tanah Negara, membuat peraturan-peraturan yang berikut: Nama
Seksyen 2
Kedalaman minimum
Kedalaman minimum berkenaan dengan tanah bawah tanah yang dinyatakan di bawah seksyen 92B adalah sebagaimana yang diperihalkan dalam Jadual.
Ketidakpakaian
Seksyen 3
Kedalaman minimum yang dinyatakan dalam Jadual tidak terpakai—
(i)
untuk serah balik di bawah seksyen 197 dan beri milik di bawah seksyen 76 yang dibuat serentak; atau
(b)
berdasarkan penggunaan tanah bawah tanah itu, atau kehendak bagi pembangunan tanah bawah tanah itu atau perkara lain yang menyentuh tanah bawah tanah itu berhubung dengan penggunaan atau kehendak bagi pembangunan tanah bawah tanah itu.

NATIONAL LAND CODE
NATIONAL LAND CODE (UNDERGROUND LAND) (MINIMUM DEPTH) REGULATIONS 2017
IN exercise of the powers conferred by section 92I of the National Land Code [Act 56/1965], the Minister, with the approval of the National Land Council, makes the following regulations:
Citation 1.
These regulations may be cited as the National Land Code (Underground Land)
(Minimum Depth) Regulations 2017.
Minimum depth 2.
The minimum depth in respect of underground lands specified in sections 92B shall be as described in the Schedule.
Non-application 3.
The minimum depth specified in the Schedule shall not apply—
(a)
to an application by the proprietor—
(i)
to surrender under section 197 and for alienation under section 76 to be made concurrently; or
(ii)
to surrender and for re-alienation under section 204D; or
(b)
based on the usage of the underground land or the requirement for the development of the underground land or other matters affecting the underground land relating to the usage or requirement for development of the underground land.

Revocation 4.
The National Land Code (Underground Land) (Minimum Depth) Regulations 2006
[P.U. (A) 414/2006] published on 4 December 2006 are revoked.
