Property found on fugitive criminal

Section 45
(1)
Everything found in the possession of a fugitive criminal at the time of his arrest which may be material as evidence in proving the extradition offence may be delivered up with the fugitive criminal on his return, subject to—
(a)
a deferment of its delivery if it is needed as evidence in
Malaysia;
(b)
an undertaking for its return to Malaysia upon request;
(c)
the rights, if any, of third parties with respect thereto.
(2)
Everything mentioned in subsection (1) may be delivered even when the extradition of the fugitive criminal cannot be effected due to his death, disappearance or escape subject to the conditions mentioned in that subsection.
