Section 37

(1)

Subject to subsection (2), a water distribution licensee shall, on application in writing by the owner or occupier of any premises, supply water to the premises.

(2)

No water distribution licensee shall be required to supply water to any premises if—

(a)

any building on the premises has been erected in contravention of any written law or is in a ruinous or dangerous condition;

(b)

the supply of water is already given to the premises by another water distribution licensee;

(c)

the water distribution licensee is prevented from doing so by circumstances beyond the water distribution licensee’s control;

(d)

the supplying of the water will cause the water distribution licensee to be in breach of this Act or its subsidiary legislation;

(e)

the supply of water had been previously disconnected as a result of a breach of this Act or its subsidiary legislation and the breach has not been remedied;

(f)

the previous supply of water has been disconnected in accordance with this Act or its subsidiary legislation;

or

(g)

the refusal to supply water is approved by the Commission.
