Disposal of works of visual arts from the Gallery

Section 31
(1)
Subject to subsection (2), where the Board is satisfied that a work of visual arts in the national collection—
(a)
is unfit for the national collection; or
(b)
is not required as part of the national collection, the Board may, with the approval of the Minister, dispose of such work by sale, gift or destruction.
(2)
A work of visual arts shall not be disposed of by way of destruction unless the Board is satisfied that the work has no saleable value.
(3)
The disposal of any work of visual arts under this section shall be carried out by the Gallery.
