Section 69
The principal Act is amended by inserting after section 69
the following sections:
“Notice for disclosure of information 69a. (1) The appropriate authority may serve a notice to any person whom the appropriate authority believes on reasonable grounds has information or documents relevant to the enforcement of this Act relating to radioactive material, nuclear material, nuclear related item or radiation generator, requesting the person to provide the information or documents to the appropriate authority.
(2)
A person who receives a notice referred to in subsection (1)
shall provide the requested information or documents to the appropriate authority in writing within the time specified in the notice.
(3)
Any person who contravenes subsection (2) commits an offence and shall, on conviction, be liable to a fine not exceeding one million ringgit or to imprisonment for a term not exceeding two years or to both.
Protection against suit and legal proceedings 69b. No action, suit, prosecution or other proceedings shall be brought, instituted or maintained in any court against the Minister, appropriate authority or authorized officer on account of or in respect of any act, neglect or default done or omitted by him in the course of carrying out his duties under this Act unless it can be proven that the act, neglect or default was done or omitted in bad faith and without reasonable cause.”.
