Section 59

falsely pretends to be suffering from sickness or disability;

injures himself with intent thereby to render himself unfit for service or causes himself to be injured by any person with that intent;

injures any person subject to service law under this Act, at the instance of that other person, with intent thereby to render that other person unfit for service; or

with intent to render himself or keep himself unfit for service, does or fails to do anything (whether at the time of the act or omission he is in hospital or not) whereby he produces, or prolongs or aggravates, any sickness or disability, shall be guilty of malingering and shall, on conviction by court-martial, be liable to imprisonment for a term not exceeding two years or any less punishment provided by this Act.
