Failure to employ Authority pilot or licensed pilot under certain circumstances
of Bintulu Port Authority Act 1981
(1)
The master, owner or agent of a vessel navigating in circumstances in which the vessel is required by the Authority under section 54 to be under pilotage who does not employ an Authority pilot or a person licensed under subsection 55A(1) for such purpose shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding five thousand ringgit.
(2)
Upon being found guilty of any offence under subsection (1), the court before which the master, owner or agent of the vessel is found guilty shall order such master, owner or agent to pay to the
Authority the amount certified by the accountant of the Authority to be the amount of dues and rates which would have been payable to the Authority if the vessel had been under pilotage as required by this
Act and such amount shall be recoverable in the same manner as a fine.
