Section 39

(1)
No compensation shall be payable in respect of any fish infected with fish disease and destroyed pursuant to section 38.
(2)
Notwithstanding subsection (1), there shall be payable as compensation to the owner, importer or exporter of any fish reasonably believed to be infected with fish disease which has been destroyed pursuant to section 38 but found to be not so infected, such sum as may be approved in writing by the Minister.
