(2)
An agreement may be made under subsection (1)—
(a)
before a claim is lodged under section 16L; or
(b)
where a claim has been lodged under section 16L, at any time before the Tribunal has recorded an agreed settlement in respect of the claim under subsection 16T(3) or has determined the claim under section 16Y, as the case may be.
