(2)
Where a part of a claim has been abandoned under subsection (1), the Tribunal’s record of an agreed settlement under subsection 16T(3) or the Tribunal’s award under section 16Y, as the case may be, in relation to the claim shall operate to discharge the person—
(a)
who is a party to that agreed settlement; or
(b)
against whom the claim is brought and the subsequent award is made, from liability in respect of the amount so abandoned.
