Section 162
Qualifications of conservator
of Malaysia Deposit Insurance Corporation Act 2011
No person shall be appointed as a conservator unless—
(a)
the person is a natural person; and
(b)
he has consented in writing to his appointment and has not withdrawn his consent as at the date of his appointment.
(2)
The following persons shall be qualified to be appointed as a conservator:
(a)
an approved company auditor under the Companies
Act 2016;
(b)
a person who has, in the opinion of the Corporation, the requisite experience; or
(c)
a person who is, in the opinion of the Corporation, capable of performing the duties of a conservator.
(3)
The following persons shall not be qualified to be appointed as a conservator:
(a)
a corporation;
(b)
an undischarged bankrupt;
(c)
a mortgagee of any asset of the affected person;
(d)
an auditor of the affected person; or
(e)
an officer of the affected person.
