Pihak berkuasa tatatertib boleh, selepas mempertimbangkan laporan yang dibuat di bawah subperaturan (2), memulakan tindakan tatatertib terhadap pegawai itu.

Kehilangan gaji dan emolumen disebabkan oleh ketidakhadiran tanpa cuti, tanpa terlebih dahulu mendapat kebenaran, dsb.

Jika seseorang pegawai tidak hadir bertugas tanpa cuti, tanpa terlebih dahulu mendapat kebenaran atau tanpa sebab yang munasabah pada pandangan Ketua Jabatan, pegawai itu tidak berhak kepada apa-apa gaji atau emolumen bagi tempoh ketidakhadirannya untuk bertugas.

Bagi maksud subperaturan (1), perakuan oleh

Ketua Jabatan mengenai tempoh yang pegawai itu tidak berhak kepada gaji dan emolumen di bawah subperaturan (1) kepada pihak berkuasa tatatertib yang bertanggungjawab bagi pembayaran gaji dan emolumen lain pegawai itu merupakan kuasa yang mencukupi untuk memotong gaji dan emolumen bagi tempoh ketidakhadiran pegawai itu untuk bertugas.

Jika seseorang pegawai tidak hadir bertugas tanpa cuti, tanpa terlebih dahulu mendapat kebenaran atau tanpa sebab yang munasabah pada pandangan Ketua Jabatan, bagi tujuh hari berturut-turut dan tidak dapat dikesan, Ketua Jabatan hendaklah menyebabkan suatu surat diserahkan kepada pegawai itu sendiri atau dihantar melalui pos berdaftar

Akuan Terima kepada pegawai itu di alamat terakhirnya yang diketahui, mengarahkan pegawai itu supaya segera melaporkan diri untuk bertugas.

(b)

pegawai itu tidak melaporkan diri untuk bertugas atau dia masih tidak dapat dikesan,

Ketua Jabatan hendaklah mengemukakan suatu laporan kepada pihak berkuasa tatatertib dan pihak berkuasa tatatertib hendaklah memulakan tindakan tatatertib terhadap pegawai itu.

Jika surat yang disebut dalam subperaturan (1)

tidak dapat diserahkan kepada pegawai itu sendiri disebabkan oleh pegawai itu tidak lagi tinggal di alamat terakhirnya yang diketahui atau jika surat pos berdaftar Akuan Terima telah dikembalikan tidak terserah,

Jabatan hendaklah melaporkan perkara itu kepada pihak berkuasa tatatertib.

Pihak berkuasa tatatertib hendaklah, apabila menerima laporan yang disebut dalam subperaturan (3),

mengambil langkah untuk menyiarkan suatu notis—

(a)

mengenai hakikat bahawa pegawai itu telah tidak hadir bertugas dan tidak dapat dikesan; dan

menghendaki pegawai itu melaporkan diri untuk bertugas dalam masa tujuh hari dari tarikh penyiaran notis itu.

Jika pegawai itu melaporkan diri untuk bertugas dalam masa tujuh hari dari tarikh penyiaran notis yang disebut dalam subperaturan (4), Ketua Jabatan hendaklah melaporkan perkara itu kepada pihak berkuasa tatatertib dan pihak berkuasa tatatertib hendaklah memulakan tindakan tatatertib terhadap pegawai itu.

Jika pegawai itu tidak melaporkan diri untuk bertugas dalam masa tujuh hari dari tarikh penyiaran notis yang disebut dalam subperaturan (4), Ketua Jabatan hendaklah melaporkan perkara itu kepada pihak berkuasa tatatertib dan

pegawai itu hendaklah disifatkan telah dibuang kerja daripada perkhidmatan berkuat kuasa mulai tarikh dia tidak hadir bertugas.

Pembuangan kerja seseorang pegawai menurut subperaturan (7) hendaklah disiarkan dalam Warta.

Pelucuthakan emolumen disebabkan oleh ketidakhadiran tanpa cuti, tanpa terlebih dahulu mendapat kebenaran, dsb., bagi tujuh hari berturut-turut dan tidak dapat dikesan 29D. (1)

Jika seseorang pegawai telah didapati bersalah kerana tidak hadir untuk bertugas tanpa cuti, tanpa terlebih dahulu mendapat kebenaran atau tanpa sebab yang munasabah pada pandangan Ketua Jabatan bagi tujuh hari berturut-turut dan tidak dapat dikesan, pegawai itu tidak berhak kepada apa-apa emolumen bagi tempoh ketidakhadirannya dan segala emolumen sedemikian hendaklah disifatkan telah terlucut hak walaupun pihak berkuasa tatatertib yang berkenaan tidak mengarahkan pelucuthakan itu.

  1. IN exercise of the powers conferred by section 22A of the Tabung Angkatan Tentera Act 1973 [Act 101], the Lembaga, with the approval of the Minister, makes the following regulations: Citation 1. These regulations may be cited as the Lembaga Tabung Angkatan Tentera Officers (Conduct and Discipline) (Amendment) Regulations 2017. Amendment of regulation 3 2. The Lembaga Tabung Angkatan Tentera Officers (Conduct and Discipline) Regulations 1996 [P.U. (A) 352/1996], which are referred to as “the principal Regulations” in these Regulations, is amended in regulation 3—

(a)

by substituting for the definition of “Head of Division” the following definition:

‘ “Head of Department” means an officer charged with the responsibility for a Department;’;

An officer who is absent from duty without leave, without prior permission or without reasonable cause in the view of the Head of Department shall be liable to a disciplinary action.

Head of Department, the Head of Department shall, as soon as reasonably practicable, report the absence to the disciplinary authority.

The report on the absence referred to in subregulation (2) shall include the dates and circumstances of the absence and any other information in respect of such absence.

The disciplinary authority shall, upon receipt of the report on the absence made by the Head of Department under subregulation (2), consider the report.

The disciplinary authority may, after considering the report made under subregulation (2), institute disciplinary action against the officer.

For the purpose of this Part, "absent", in relation to an officer, includes a failure to be present for any length of time at a time and place where the officer is required to be present for the performance of his duties.

For the purpose of subregulation (1), a certification by the Head of Department certifying the period of which that officer is not entitled to salaries or emoluments under subregulation (1) to the disciplinary authority responsible for the payment of salaries and other emoluments of the officer is a sufficient authority to deduct the salaries or emoluments for a period of his absence from his duty.

If an officer is absent from duty without leave, without prior permission or without reasonable cause in the view of the Head of Department, for seven consecutive days and cannot be traced, the Head of Department shall cause a letter to be delivered personally or sent by A.R. registered post to the officer at his last known address, directing the officer to immediately report for duty.

If after the letter referred to in subregulation (1) is delivered—

the officer fails to report for duty or he still cannot be traced, the Head of Department shall submit a report to the disciplinary authority and the disciplinary authority shall institute disciplinary action against the officer.

(3)

If the letter referred to in subregulation (1) cannot be delivered personally to the officer by reason of the fact that the officer is no longer residing at his last known address or if the A.R registered letter is returned undelivered, the Head of Department shall report the matter to the disciplinary authority.

The disciplinary authority shall, upon receiving the report referred to in subregulation (3), take steps to publish a notice—

(a)

of the fact that the officer has been absent from duty and cannot be traced; and

requiring the officer to report for duty within seven days from the date of the publication of the notice.

(5)

The notice referred to in subregulation (4) shall be published in at least one daily newspaper—

(a)

having its publication in the national language; and

as determined by the disciplinary authority.

(6)

If the officer reports for duty within seven days from the date of the publication of the notice referred to in subregulation (4), the Head of Department shall report the matter to the disciplinary authority and the disciplinary authority shall institute disciplinary action against the officer.

If the officer fails to report for duty within seven days from the date of the publication of the notice referred to in subregulation (4), the Head of Department shall report the matter to the disciplinary authority and the officer shall be deemed to have been dismissed from the service with effect from the date the officer was absent from duty.

The dismissal of an officer pursuant to subregulation (7)

shall be published in the Gazette.

Forfeiture of emoluments due to absent without leave, without prior permission, etc., for seven consecutive days and cannot be traced 29D.

If an officer has been found guilty for being absent without leave, without prior permission or without reasonable cause in the view of the Head of Department for seven consecutive days and cannot be traced, he shall not be entitled to any emolument for the period of his absence and all such emoluments shall be deemed to have been forfeited notwithstanding that the disciplinary authority may not have ordered such forfeiture.

An officer whose emoluments have been forfeited under subregulation (1) shall be notified in writing of the forfeiture.

The forfeiture of emoluments pursuant to subregulation (1) is not a disciplinary punishment.”.

where there has been made against the officer any order of detention, supervision or deportation, or where there has been imposed on such officer any form of restriction or supervision by
