  1. PADA menjalankan kuasa yang diberikan oleh seksyen 65 Akta Persaingan 2010 [Akta 712], Menteri membuat peraturan-peraturan yang berikut:

Tiap-tiap notis rayuan yang difailkan dengan Tribunal di bawah seksyen 51 Akta hendaklah dalam lapan salinan dan—

(i)

nama perayu, dan wakilnya jika ada;

(iii)

alamat penyampaian bagi apa-apa notis atau dokumen kepada perayu atau wakilnya;

Jika notis rayuan yang difailkan tidak mematuhi peraturan 3, Tribunal boleh mengarahkan perayu untuk mengambil apa-apa langkah sebagaimana yang perlu untuk memastikan bahawa kehendak di bawah peraturan 3 dipatuhi.

Notis rayuan hendaklah dimeterai, dsb., dan dicatatkan dalam Daftar

Apabila notis rayuan diterima, Setiausaha hendaklah menyebabkan salinan notis rayuan yang difailkan—

Setiausaha hendaklah menyebabkan tiap-tiap notis rayuan yang difailkan dicatatkan dalam Daftar.

Selepas notis rayuan yang difailkan dicatatkan dalam Daftar, Setiausaha hendaklah menyebabkan dua salinan notis rayuan itu dikembalikan kepada perayu.

Penyampaian notis rayuan

Perayu hendaklah menyampaikan sesalinan notis rayuan yang ditandatangani dan dimeterai kepada Pengerusi Suruhanjaya dalam masa empat belas hari dari tarikh notis rayuan itu dikembalikan kepada perayu.

Pernyataan jawapan

Tertakluk kepada subseksyen (5), Suruhanjaya yang telah disampaikan dengan sesalinan notis rayuan di bawah peraturan 6 hendaklah, dalam masa tiga puluh hari dari tarikh penyampaian itu, memfailkan pernyataan jawapan dalam enam salinan dengan Tribunal.

(i)

nama Suruhanjaya, dan wakilnya jika ada;

(ii)

alamat penyampaian bagi apa-apa notis atau dokumen kepada

Pindaan notis rayuan

Perayu boleh, pada mana-mana peringkat prosiding, meminda notis rayuan yang difailkan di bawah peraturan 3 dengan kebenaran Tribunal dan tertakluk kepada apa-apa terma, dan apa-apa arahan berbangkit, sebagaimana yang difikirkan perlu oleh

Tribunal.

Walau apa pun subperaturan (1), Tribunal tidak boleh memberikan kebenaran untuk meminda notis rayuan yang difailkan di bawah peraturan 3 bagi maksud memasukkan alasan rayuan yang baharu melainkan jika Tribunal berpuas hati bahawa—

(a)

alasan rayuan yang baharu itu berasaskan apa-apa perkara fakta atau undang-undang yang diketahui oleh perayu hanya selepas notis rayuan itu difailkan;

alasan rayuan yang baharu itu tidak praktik untuk dimasukkan dalam notis rayuan itu apabila ia difailkan; atau

Jika kebenaran diberikan di bawah subperaturan (1), perayu hendaklah memfailkan notis rayuan terpinda itu dalam lapan salinan dengan Tribunal.

Setiausaha hendaklah menyebabkan notis rayuan terpinda itu ditandatangani dan dimeterai, dan dikembalikan kepada perayu.

Jika notis rayuan dipinda di bawah subperaturan (1) selepas notis rayuan itu disampaikan kepada Suruhanjaya di bawah peraturan 6, notis rayuan terpinda yang ditandatangani dan dimeterai itu hendaklah disampaikan kepada Suruhanjaya dalam masa empat belas hari dari tarikh notis rayuan terpinda itu dikembalikan kepada perayu di bawah subperaturan (4).

Jika notis rayuan terpinda itu disampaikan kepada Suruhanjaya selepas pernyataan jawapan disampaikan kepada perayu di bawah peraturan 8, Suruhanjaya boleh meminda pernyataan jawapannya dan menyampaikan pernyataan jawapan terpinda itu kepada perayu dalam masa empat belas hari dari tarikh notis rayuan terpinda itu disampaikan kepada Suruhanjaya.

melainkan jika Tribunal berpuas hati bahawa—

pindaan itu berasaskan apa-apa perkara fakta atau undang-undang yang diketahui oleh Suruhanjaya hanya selepas pernyataan jawapan itu difailkan;

Seksyen 11

Mana-mana pihak boleh, pada mana-mana peringkat prosiding, hadir sendiri atau melalui seseorang wakil.

Seksyen 12

Pengurusan kes

Jika Tribunal mendapati bahawa suatu pengurusan kes boleh memudahkan mana-mana prosiding, Tribunal boleh, atas usulnya sendiri atau atas permintaan mana-mana pihak, mengarahkan pihak-pihak untuk menghadiri suatu pengurusan kes yang berhubungan dengan perkara yang berbangkit dalam prosiding itu.

Tujuan pengurusan kes itu hendaklah termasuk yang berikut:

(a)

untuk memastikan penjalanan prosiding yang berkesan;

untuk menentukan isu dalam prosiding itu yang baginya pihak-pihak dikehendaki untuk mengemukakan hujah atau keterangan lanjutan;

Tribunal boleh memberikan arahan di bawah perenggan 57(1)(g) Akta pada bila-bila masa, sama ada semasa pengurusan kes atau selainnya, atas usulnya sendiri atau atas permintaan mana-mana pihak, sebagaimana yang perlu atau suai manfaat bagi mempercepat keputusan rayuan, yang termasuklah arahan yang berhubungan dengan—

(a)

cara bagaimana prosiding itu akan dijalankan, termasuk apa-apa had masa yang hendaklah dipatuhi dalam penjalanan pendengaran itu;

pemfailan apa-apa pliding tambahan selepas pernyataan jawapan atau butir-butir tambahan oleh pihak-pihak;

Mana-mana pihak atau orang yang memfailkan dengan, atau mengemukakan kepada, Tribunal apa-apa dokumen boleh membuat permintaan kepada Tribunal bagi layanan kerahsiaan dokumen itu, secara keseluruhan atau sebahagiannya.

Permintaan di bawah subperaturan (1) hendaklah dibuat secara bertulis dalam masa empat belas hari dari tarikh pemfailan atau pengemukaan dokumen itu.

Jika permintaan di bawah subperaturan (1) berhubung dengan—

(a)

keseluruhan dokumen, pihak atau orang yang membuat permintaan di bawah subperaturan (1) hendaklah menyatakan sebab bagi permintaan itu; atau

Tribunal boleh membenarkan permintaan di bawah subperaturan (1)

tertakluk kepada apa-apa terma sebagaimana yang difikirkan sesuai oleh Tribunal.

Pihak atau orang yang membuat permintaan di bawah subperaturan (1)

hendaklah memberikan dokumen itu dalam bentuk bukan rahsia kepada Tribunal sebagaimana yang diarahkan oleh Setiausaha.

Tribunal tidak boleh menimbangkan apa-apa permintaan di bawah subperaturan (1) yang tidak mematuhi peraturan ini melainkan jika Tribunal mendapati bahawa ketidakpatuhan itu disebabkan oleh hal keadaan yang luar biasa.

Jika mana-mana pihak atau orang mempertikaikan layanan kerahsiaan yang dibenarkan di bawah subperaturan (4), Tribunal hendaklah memutuskan pertikaian itu selepas mendengar pihak atau orang yang mempertikaikan layanan kerahsiaan itu dan pihak atau orang yang telah memfailkan atau mengemukakan dokumen yang berhubungan dengan pertikaian itu.

Mana-mana pihak boleh, tidak lebih daripada empat belas hari sebelum tarikh pendengaran rayuan itu, meminta Setiausaha mengeluarkan saman untuk hadir kepada mana-mana orang dan permintaan itu hendaklah menyatakan—

(a)

nama dan alamat orang yang hendak dipanggil itu;

fakta yang mengenainya orang itu akan diperiksa dan sebab bagi pemeriksaan itu; dan

Jika rayuan itu ditetapkan untuk pendengaran, Setiausaha hendaklah mengeluarkan notis pendengaran kepada pihak-pihak yang menyatakan tarikh, tempat dan masa pendengaran.

Pendengaran itu hendaklah dimulakan sebagaimana yang diarahkan oleh anggota Tribunal yang mempengerusikan yang hendaklah bertanggungjawab ke atas penjalanan yang sepatutnya bagi pendengaran apa-apa rayuan.

Tribunal boleh, jika boleh dilaksanakan, mengelakkan formaliti dalam prosiding itu dan menjalankan pendengaran itu mengikut apa-apa cara yang difikirkannya paling sesuai bagi penyelesaian prosiding yang adil, cepat dan berhemat.

Melainkan jika diarahkan selainnya oleh Tribunal, seorang saksi boleh didengar jika—

(a)

berkenaan dengan saksi pakar, pernyataan bertulis saksi itu, dan laporan pakar jika ada; dan

Walau apa pun subperaturan (1), mana-mana bahagian pendengaran boleh diadakan secara tertutup jika Tribunal berpuas hati bahawa semasa pendengaran itu

Tribunal akan mempertimbangkan—

(a)

apa-apa maklumat yang penzahirannya mungkin bertentangan dengan kepentingan awam;

apa-apa maklumat sulit yang penzahirannya boleh dengan nyata sekali memudaratkan kepentingan perniagaan yang sah bagi apa-apa pengusahaan yang baginya maklumat itu berkaitan; atau

apa-apa maklumat yang berhubungan dengan hal ehwal persendirian bagi seseorang individu yang penzahirannya boleh dengan nyata sekali memudaratkan kepentingan individu itu.

Tertakluk kepada subperaturan (2), Tribunal boleh, atas usulnya sendiri atau atas permohonan mana-mana pihak kepada suatu rayuan, memerintahkan mana-mana rayuan yang lain untuk didengar bersama dengan rayuan yang mula-mula disebut itu jika

Tribunal mendapati bahawa—

(a)

hal perkara bagi rayuan-rayuan itu timbul daripada keputusan

Suruhanjaya yang sama; atau

Suggest a correction

(b)

hal perkara bagi rayuan-rayuan itu melibatkan isu yang serupa.

Perintah di bawah subperaturan (1) hanya boleh dibuat selepas pihak-pihak kepada rayuan-rayuan yang berkenaan itu telah diberi peluang untuk didengar.

Jika perayu tidak hadir pada tarikh dan masa dan di tempat yang ditetapkan untuk pendengaran tetapi Suruhanjaya hadir, Tribunal boleh, setelah berpuas hati bahawa notis pendengaran telah disampaikan dengan sewajarnya, menolak rayuan itu.

Jika Suruhanjaya tidak hadir pada tarikh dan masa dan di tempat yang ditetapkan untuk pendengaran tetapi perayu hadir, Tribunal boleh, setelah berpuas hati bahawa notis pendengaran telah disampaikan dengan sewajarnya—

(a)

meneruskan pendengaran itu tanpa kehadiran Suruhanjaya; atau

Suggest a correction

(b)

menangguhkan pendengaran itu ke suatu tarikh lain.

Jika mana-mana pendengaran diteruskan tanpa kehadiran Suruhanjaya di bawah perenggan (2)(a), Tribunal hendaklah, sebelum menyelesaikan rayuan itu, menimbangkan apa-apa representasi yang dikemukakan oleh perayu.

Jika kedua-dua pihak tidak hadir pada tarikh dan masa dan di tempat yang ditetapkan untuk pendengaran, rayuan itu hendaklah ditolak.

Walau apa pun subperaturan (1) dan (4), tiada rayuan boleh ditolak jika alasan yang munasabah diberikan—

(a)

berkenaan dengan penolakan di bawah subperaturan (1), oleh perayu;

Tribunal boleh, atas permohonan pihak yang terkilan, mengetepikan apa-apa keputusan yang dibuat di bawah subperaturan 19(1) dan (2).

Pihak yang terkilan itu boleh memfailkan suatu permohonan untuk mengetepikan keputusan itu dalam enam salinan dengan Tribunal dalam masa tiga puluh hari dari tarikh keputusan itu diterima dan hendaklah menyampaikan sesalinan permohonan itu kepada pihak yang satu lagi.

Apa-apa permintaan untuk suatu perintah persetujuan hendaklah dibuat dengan menghantar serah kepada Setiausaha suatu draf perintah persetujuan yang ditandatangani oleh semua pihak atau wakil mereka yang menyatakan terma yang dipersetujui antara pihak-pihak.

Perayu boleh, dengan kebenaran Tribunal, menarik balik rayuan pada bila-bila masa sebelum Tribunal membuat apa-apa keputusan mengenai rayuan itu dengan memfailkan suatu notis penarikan balik dengan Tribunal.

Perayu hendaklah menyampaikan sesalinan notis penarikan balik itu kepada

Penarikan balik di bawah subperaturan (1) itu tidak akan menjejaskan kuasa

  1. IN exercise of the powers conferred by section 65 of the Competition Act 2010 [Act 712], the Minister makes the following regulations:

(1)

These regulations may be cited as the Competition (Appeal Tribunal)

These Regulations come into operation on 2 May 2017.

Interpretation 2.

In these Regulations, unless the context otherwise requires—

“presiding Tribunal member” means the President or the member of the Tribunal who presides over any proceedings in respect of an appeal before the Tribunal;

“Register” means the Register of the Competition Appeal Tribunal;

“advocate” means—

(a)

an advocate and solicitor within the meaning of the

Legal Profession Act 1976 [Act 166];

Sabah [Sabah Cap. 2]; or

(c)

an advocate within the meaning of the Advocates Ordinance of Sarawak

[Sarawak Cap. 110];

“appellant” means a person who is aggrieved or whose interest is affected by a decision of the Commission under section 35, 39 or 40 of the Act;

“President” means the President of the Competition Appeal Tribunal appointed under subsection 45(2) of the Act;

“appeal” means an appeal made to the Tribunal under section 51 of the Act;

“Secretary” means the Secretary to the Competition Appeal Tribunal appointed under subsection 50(1) of the Act;

“Tribunal” means the Competition Appeal Tribunal established under section 44 of the Act;

“representative” means—

in relation to an appellant, an advocate, or any other person authorized in writing by the appellant and allowed by the Tribunal to appear on behalf of the appellant; and

in relation to the Commission, an advocate, or any officer of the

Commission authorized in writing by the Commission to appear on its behalf.

COMMENCEMENT OF APPEAL PROCEEDINGS

Notice of appeal 3.

(1)

Every notice of appeal filed with the Tribunal under section 51 of the Act shall be in eight copies and—

(i)

the name of the appellant, and his representative if any;

(ii)

the name of the Commission, and its representative if any;

the address for service of any notice or document to the appellant or his representative;

the address for service of any notice or document to the

Commission or its representative;

(v)

the date of the decision appealed against and the substance of the decision in summary;

(vii)

the grounds of appeal together with the particulars of fact or law which the Commission is alleged to have erred;

a succint argument of fact or law supporting each ground of appeal;

(ix)

the relief, or the direction if any, sought by the appellant; and

(b)

shall list all supporting documents attached to the notice of appeal, if any.

(2)

The notice of appeal shall be signed and dated by the appellant or his representative.

The notice of appeal shall be accompanied by a copy of the decision appealed against.

Non-compliance of requirements relating to notice of appeal 4.

Where a notice of appeal filed does not comply with regulation 3, the Tribunal may direct the appellant to take such steps as may be necessary to ensure that the requirements under regulation 3 are complied with.

Notice of appeal to be sealed, etc., and entered in the Register 5.

Upon receipt of the notice of appeal, the Secretary shall cause the copies of the notice of appeal the filed—

(b)

to be sealed with the seal of the Tribunal; and

(2)

The Secretary shall cause every notice of appeal filed to be entered in the

Register.

After the notice of appeal filed has been entered in the Register, the Secretary shall cause two copies of the notice of appeal to be returned to the appellant.

Service of notice of appeal 6.

The appellant shall serve a copy of the signed and sealed notice of appeal to the

Chairman of the Commission within fourteen days from the date the notice of appeal is returned to the appellant.

Statement in reply 7.

(1)

Subject to subsection (5), the Commission which has been served with a copy of the notice of appeal under regulation 6 shall, within thirty days from the date of service, file a statement in reply in six copies with the Tribunal.

The statement in reply—

(i)

the name of the Commission, and its representative if any;

(ii)

the address for service of any notice or document to the

Commission or its representative;

a succint argument of fact or law supporting the decision appealed against; and

the relief or direction sought by the Commission, if any; and

(b)

shall list all supporting documents attached to the statement in reply, if any.

(3)

The statement in reply shall be signed and dated by the Commission or its representative.

The statement in reply shall be confined to the matters raised in the notice of appeal.

(5)

The Tribunal may, on the application of the Commission, extend the time for the filing of the statement in reply under subregulation (1).

Service of statement in reply 8.

The Commission shall serve a copy of the signed statement in reply to the appellant within fourteen days from the date the statement in reply is filed with the Tribunal.

Amendment of notice of appeal 9.

(1)

The appellant may, at any stage of the proceedings, amend the notice of appeal filed under regulation 3 with the leave of the Tribunal and subject to such terms, and any consequential direction, as the Tribunal thinks necessary.

(2)

Notwithstanding subregulation (1), the Tribunal shall not grant leave to amend the notice of appeal filed under regulation 3 for the purpose of inserting a new ground of appeal unless the Tribunal is satisfied that—

(a)

the new ground of appeal is based on any matter of fact or law which is known to the appellant only after the notice of appeal is filed;

the new ground of appeal was not practicable to be inserted in the notice of appeal when it was filed; or

(c)

the new ground of appeal is inserted due to exceptional circumstances.

(3)

Where a leave is granted under subregulation (1), the appellant shall file the amended notice of appeal in eight copies with the Tribunal.

The Secretary shall cause the amended notice of appeal to be signed and sealed, and to be returned to the appellant.

Where a notice of appeal is amended under subregulation (1) after the notice of appeal has been served on the Commission under regulation 6, the signed and sealed amended notice of appeal shall be served on the Commission within fourteen days from the date the amended notice of appeal is returned to the appellant under subregulation (4).

Where the amended notice of appeal is served on the Commission after the statement in reply has been served on the appellant under regulation 8, the Commission may amend its statement in reply and serve the amended statement in reply on the

appellant within fourteen days from the date the amended notice of appeal is served on the Commission.

(1)

The Commission may, at any stage of the proceedings, amend the statement in reply filed under regulation 7 with the leave of the Tribunal and subject to such terms, and any consequential direction, as the Tribunal thinks necessary.

Notwithstanding subregulation (1), the Tribunal shall not grant leave to amend the statement in reply filed under regulation 7 unless the Tribunal is satisfied that—

(a)

the amendment is based on any matter of fact or law which is known to the Commission only after the statement in reply is filed;

the amendment was not practicable to be inserted in or omitted from the statement in reply when it was filed; or

(c)

the amendment is inserted or omitted due to exceptional circumstances.

(3)

APPEAL PROCEEDINGS

Representation in proceedings 11.

A party may, at any stage of the proceedings, appear personally or by a representative.

Case management 12.

(1)

Where it appears to the Tribunal that a case management would facilitate any proceedings, the Tribunal may, on its own motion or on the request of any party, direct the parties to attend a case management relating to the matters arising in the proceedings.

The purposes of the case management shall include the following:

(a)

to ensure the efficient conduct of the proceedings;

to determine the issues in the proceedings of which the parties are required to submit further arguments or evidence;

to clarify the issues in the proceedings, the arguments of fact or law, and the terms of the order, relief or direction sought by the parties;

to consider the possibility of settlement of all or any of the issues in the proceedings and to ensure that any agreement between the parties is recorded; and

to ensure that the conduct of the proceedings is recorded.

Unless the Tribunal otherwise directs, a case management shall be held in a closed session.

Directions 13.

(1)

The Tribunal may give direction under paragraph 57(1)(g) of the Act at any time, whether at a case management or otherwise, on its own motion or on the request of any party, as may be necessary or expedient for the expeditious decision of the appeal, which includes directions relating to—

(a)

the manner in which the proceedings are to be conducted, including any time limit to be complied with in the conduct of a hearing;

the filing of any additional pleadings subsequent to a statement in reply or additional particulars by the parties;

the filing of any bundle of pleadings, written statement of witness and expert report, if any;

The hearing shall commence as directed by the presiding Tribunal member who shall be responsible for the proper conduct of the hearing of any appeal.

The Tribunal may, if practicable, avoid formality in the proceedings and conduct the hearing in such manner as it considers most appropriate for the just, expeditious and economical disposal of the proceedings.

Unless the Tribunal otherwise directs, a witness may be heard if—

(a)

in respect of an expert witness, a written statement of the witness, and expert report if any; and

in respect of any other witness, a written statement of the witness,

has been submitted to the Tribunal before the hearing and any other direction of the

Tribunal under regulation 13 has been complied with.

(2)

Notwithstanding subregulation (1), any part of the hearing may be held in a closed session if the Tribunal is satisfied that at the hearing it will consider—

(a)

any information the disclosure of which may be contrary to public interest;

any confidential information the disclosure of which may significantly harm the legitimate business interests of any undertaking to which the information relates; or

(c)

any information relating to the private affairs of an individual the disclosure of which may significantly harm the interests of the individual.

(1)

Subject to subregulation (2), the Tribunal may, on its own motion or on the application of any party to an appeal, order any other appeal to be heard together with the first-mentioned appeal if it appears to the Tribunal that—

(a)

the subject matter of the appeals arises from the same decision of the

Commission; or

(b)

the subject matter of the appeals involves similar issues.

The order under subregulation (1) may only be made after the parties to the respective appeals have been given an opportunity to be heard.

Where the appellant does not appear on the date and at the time and place fixed for the hearing but the Commission appears, the Tribunal may, upon being satisfied that the notice of hearing has been duly served, dismiss the appeal.

(a)

proceed with the hearing in the absence of the Commission; or

Where any hearing proceeds in the absence of the Commission under paragraph (2)(a), the Tribunal shall, before disposing of the appeal, consider any representation submitted by the appellant.

Nothwithstanding subregulations (1) and (4), no appeal may be dismissed if a reasonable excuse is given—

(a)

in respect of a dismissal under subregulation (1), by the appellant; or

(1)

The Tribunal may, on the application of the aggrieved party, set aside any decision made under subregulations 19(1) and (2).

The aggrieved party may file an application to set aside the decision in six copies with the Tribunal within thirty days from the date of the receipt of the decision and shall serve a copy of the application to the other party.

Upon receipt of the application under subregulation (2), the Secretary shall fix the date, time and place of the hearing of the application and shall issue a notice of hearing of the application to all parties.

(2)

Any request for a consent order shall be made by delivering to the Secretary a draft consent order signed by all parties or their representatives stating the agreed terms between the parties.

The Tribunal may, as it thinks fit and after hearing the parties—

(a)

make the consent order as requested under subregulation (1);

subject to the agreement of the parties, vary the terms of the consent order and make the consent order in accordance with the terms varied;

refuse to make the consent order.

(1)

An appellant may, with the leave of the Tribunal, withdraw an appeal at any time before the Tribunal makes any decision on the appeal by filing a notice of withdrawal with the Tribunal.

The appellant shall serve a copy of the notice of withdrawal on the

Commission.

The withdrawal under subregulation (1) shall not affect the power of the

Tribunal to make an order in relation to the payment of costs incurred until the time of filing of the notice of withdrawal.

Where an appeal is withdrawn, no fresh appeal may be brought by the appellant in relation to the decision which was the subject of the appeal so withdrawn.

The Tribunal may adjourn a hearing or proceedings subject to such conditions as the Tribunal thinks just.

the disclosure or production of any document by the parties.

Where any party fails to comply with any direction given under subregulation (1), the Tribunal, on its own motion or on the request of any party, may make the following decisions:

The Tribunal may, on the application of any party, set aside the decision made under subregulation (2) on such terms, if any, as the Tribunal thinks just.

The Tribunal may, in giving directions under subregulation (1)—

(a)

put questions to the parties and the witnesses;

direct the parties to make a written or oral submission on certain issues in the proceedings;

direct any other person to produce any relevant document.

(5)

A request for any direction under subregulation (1) may be made at any stage of the proceedings and shall be—

served on any person whom the Secretary determines, after taking into account the submissions of the parties, to be affected by such directions.

(1)

Any party or person who files with, or produce to, the Tribunal any document may make a request to the Tribunal for confidential treatment of the document, in whole or in part.

The request under subregulation (1) shall be made in writing within fourteen days from the date of the filing or production of such document.

Where the request under subregulation (1) relates to—

(a)

the whole document, the party or person making the request under subregulation (1) shall state the reason for the request; or

(b)

any part of a document, the party or person making the request under subregulation (1) shall state the words, figures or passages intended to be treated as confidential and the reason for the request for each part of the document intended to be treated as confidential.

(4)

The Tribunal may allow the request under subregulation (1) subject to such terms as the Tribunal thinks fit.

The party or person making the request under subregulation (1) shall provide the document in a non-confidential form to the Tribunal as the Secretary may direct.

(6)

The Tribunal shall not consider any request under subregulation (1) which does not comply with this regulation unless it appears to the Tribunal that the non-compliance is due to exceptional circumstances.

(7)

If any party or person disputes the confidential treatment allowed under subregulation (4), the Tribunal shall decide on the dispute after hearing the party or person who is disputing such confidential treatment and the party or person who had filed or produced the document relating to the dispute.

Any party may, not more than fourteen days before the date of the hearing of the appeal, request the Secretary to issue summons to appear to any person and the request shall state—

the name and address of the person to be summoned;

If the person who is summoned under subregulation (2) fails to comply with the summons, the Tribunal may exercise it powers with regard to the punishment for contempt under subsection 57(2) of the Act.
