Licence to sell or store pesticides

(2)

Upon receipt of an application duly made under subsection (1)

and in accordance with the rules, the Pesticides Licensing Officer may, issue to the applicant a licence in the prescribed form subject to such conditions as the Pesticides Licensing Officer thinks fit to impose, if he is satisfied that—

(a)

the pesticide to which the application relates is for the time being registered under this Act; and

(b)

the applicant is aware of the toxicity of the pesticide and of the risks involved in the use and handling thereof.

(3)

A licence under this section—

(a)

shall not authorize the sale or storage for sale of a pesticide at more than one premises;

(b)

shall specify the premises at which the sale or storage for sale of the pesticide is authorized;

(c)

may authorize both the sale and storage for sale of one or more pesticides, that may be of the same class or different classes of pesticides, at the specified premises; and

(d)

shall be valid for three years from the date of its issue but may be renewed on payment of the prescribed application fee.
