PERINTAH ORDINAN TAHAN HARTA (PELUASAN) 1980

Perintah ini bolehlah dinamakan Perintah Ordinan Tahanharta (Perluasan) 1980, dan hendaklah mula berkuatkuasa pada tarikh yang ditetapkan oleh Yang di-Pertuan Agong melalui pemberitahu dalam Warta.

Ordinan Tahan-harta 1951, adalah diubahsuai seperti dalam Jadual dan sebagaimana diubahsuai sedemikian itu adalah diperluaskan ke Sabah dan Sarawak.

Tiada apa-apa jua dalam Perintah ini boleh menyentuh sahnya langkah pembicaraan yang dibawa sebelum mula berkuatkuasa Perintah ini dan langkah pembicaraan itu hendaklah dijalankan dan diteruskan hingga selesai seolah-olah Perintah ini telah tidak dibuat dan tatacara yang dipakai bagi langkah pembicaraan itu sebelum sahaja mula berkuatkuasanya Perintah ini hendaklah terus dipakai baginya.

DISTRESS ORDINANCE (EXTENSION) ORDER 1980

This Order may be cited as the Distress Ordinance (Extension) Order 1980, and shall come into force on such date as the Yang di-Pertuan Agong may, by notification in the Gazette, appoint.

The Distress Ordinance 1951, is modified as in the Schedule and as so modified is extended to Sabah and Sarawak.

Nothing in this Order shall affect the validity of distress proceedings instituted before the commencement of this Order and the same shall be carried on and continued to final conclusion as if this Order had not been made, and the procedure applicable to such proceedings immediately before the commencement of this Order shall continue to apply thereto.

Section Modification

1 ... ... ... Omit ", and shall come into force on such date as the High Commissioner may, by notification in the Gazette, appoint".

2 ... ... In the definition of "bailiff" omit all the words after "High Court".

8 (g) ... 1. For "Municipal Commissioners for municipal purposes" substitute "local authority for local authority purposes".

2. Omit "charged with responsibility for the administration of justice".

For "sections 72 and 93 (1) (c) of the Courts Ordinance, 1948" substitute "section 72 and proviso (b) to section 93 (1) of the Subordinate Courts Act, 1948".

26 (1) ... For "Ordinance and Enactment" substitute "written laws".

26 (3) ... For "rules made under the Rule Committee Ordinance, 1948, or other written law" substitute "rules of court".

Schedule ... 1. For "Ordinance and Enactment" substitute "Written law".
