Preamble

  1. PADA menjalankan kuasa-kuasa yang diberi oleh seksyen 7 Akta (Peruntukan-Peruntukan Khas) Saman dan Waran 1971, Menteri membuat Perintah berikut: if. 1.11.1984 - See Pu(B)438184 Diperbuat 18hb Julai 1984. (PU $ ^{2} $ ) 416.] Bagi pihak dan atas nama Menteri Luar Negeri, ABDUL KADIR BIN HAJI SHEIKH FADZIR, Timbalan Menteri Luar Negeri (Akan dibentangkan di dalam Dewan Rakyat dan Dewan Negara menurut subseksyen (3) seksyen 7 Akta (Peruntukan-Peruntukan Khas) Saman dan Waran 1971.) Opening note

Preamble

  1. In exercise of the powers conferred by section 7 of the Summonses and Warrants (Special Provisions) Act 1971, the Minister makes the following Order:

This Order may be cited as the Summonses and Warrants (Special Provisions) (Extension to Brunei Darussalam) Order 1984 and shall come into force on such date as the Minister may, by notification in the Gazette, appoint. eif 1.11.1984 - See PUC5)436/84

Subject to subparagraph (2) and to the qualification contained in paragraph 3, sections 3, 4, 5, 6 and 8 of the Summonses and Warrants (Special Provisions) Act 1971, which in this Order is referred to as "the Act", are extended to apply to Brunei Darussalam and references in the said sections to Singapore shall be construed as references to Brunei Darussalam.

(2)

In construing the sections specified in subparagraph (1), unless the context otherwise requires—

(a)

"Court" and "summons" have the same meaning assigned to them in section 2 of the Act save that the reference to "appropriate Criminal Procedure Code" is a reference to the Criminal Procedure Code of either Malaysia or Brunei Darussalam, as the case may be; and

(b)

"Magistrate" in relation to Malaysia includes a President of a Sessions Court.

In relation to the provisions of the Act as extended to Brunei Darussalam:

(a)

if at any time the Attorney-General is of the opinion that a summons under section 3 or 4 or a warrant under section 5, if served or executed, as the case may be, within Malaysia, would result in the person against whom the summons or warrant was issued, being compelled to appear in Brunei Darussalam to be tried or punished for an offence of a political character, the Attorney-General may, by order in writing, signify to the Magistrate not to endorse the said summons or warrant and the Magistrate shall accordingly not endorse such summons or warrant, as the case may be;

(b)

if the Magistrate had already endorsed the summons or warrant before the order by the Attorney-General had been signified to him, on his being signified of such order, the Magistrate shall recall the summons or warrant, whether or not the summons or warrant has been served or executed, as the case may be, and cancel the endorsement made thereon and where any person had been arrested and is in custody the Magistrate shall order his release forthwith.

This Order shall apply to summonses and warrants under sections 3, 4, 5, 6 and 8 of the Act as specified in subparagraph (1) of paragraph 2—

(1)

received in Malaysia from Brunei Darussalam after the date this Order comes into force notwithstanding that they were issued before the date this Order comes into force or relate to offences committed before the date this Order comes into force; and

(2)

received in Malaysia from Brunei Darussalam before the date this Order comes into force but which have not yet been served or executed.
