PERATURAN-PERATURAN TABUNG HAJI (DEPOSIT DAN PENGELUARAN) (PINDAAN) 2017

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Tabung Haji (Deposit dan Pengeluaran) (Pindaan) 2017.

Peraturan-Peraturan ini mula berkuat kuasa pada 1 April 2017.

Pindaan Bahagian IV

dalam perenggan (4)(c), dengan memotong perkataan “atau” dihujung perenggan itu;

dalam perenggan (4)(d), dengan menggantikan noktah dengan perkataan

“; atau”; dan

dengan memasukkan selepas perenggan (4)(d) perenggan yang berikut:

“(e)

dengan pembuatan suatu hibah amanah oleh pendeposit di bawah peraturan 7A.” .

Peraturan baharu 7A dan 7B

Seseorang pendeposit yang berumur lapan belas tahun atau lebih boleh membuat hibah amanah bagi amaun atau apa-apa bahagian amaun yang ada pada kredit pendeposit untuk diberikan kepada mana-mana orang sebagai penerima hibah amanah itu.

Tiap-tiap hibah amanah sedemikian hendaklah dibuat dalam borang yang ditentukan oleh Lembaga dan tidak mempunyai apa-apa kuat kuasa melainkan jika dibuat semasa hayat pendeposit itu.

Amaun atau sebahagian amaun yang ada pada kredit pendeposit yang diberikan kepada penerima hibah amanah di bawah subperaturan (1)

hendaklah dibayar mengikut peraturan 8.

Tertakluk kepada subperaturan (5) dan terma dan syarat sebagaimana yang ditentukan oleh Lembaga, penerima hibah amanah hendaklah memberikan kuasa kepada pendeposit—

Pendeposit hendaklah pada setiap masa semasa hayatnya mengekalkan deposit minimum sebagaimana yang ditentukan oleh Lembaga melainkan jika hibah amanah itu dibatalkan di bawah peraturan 7B.

Pendeposit hendaklah memberitahu Lembaga tentang apa-apa penambahan penerima hibah amanah atau apa-apa perubahan amaun yang ada pada kredit pendeposit yang diberikan bagi hibah amanah, atau tentang kematian penerima hibah amanah itu.

Jika hibah amanah dibuat bagi sebahagian amaun yang ada pada kredit pendeposit, pendeposit boleh menamakan mana-mana orang mengikut peraturan 7 yang kepadanya baki amaun yang ada pada kredit pendeposit boleh dibayar selepas kematian pendeposit mengikut peraturan 8.

Pembatalan hibah amanah 7B.

Sesuatu hibah amanah yang dibuat di bawah peraturan 7A terbatal dalam keadaan-keadaan yang berikut:

dalam subperaturan (1)—

dalam perenggan (a), dengan memotong perkataan “atau”

dihujung perenggan itu;

dengan memasukkan selepas subperaturan (1) subperaturan yang berikut:

“(1A) Apabila seseorang penerima hibah amanah meninggal dunia, amaun atau sebahagian amaun yang ada pada kredit pendeposit itu yang diberikan kepada penerima hibah amanah itu hendaklah dibayar kepada mana-mana orang yang berhak mewarisi amaun atau sebahagian amaun itu bawah Hukum Syarak bilamana suatu tuntutan dibuat kepada Lembaga oleh orang itu mengikut cara yang ditentukan oleh Lembaga.”;

dalam subperaturan

, dengan menggantikan perkataan

“subperaturan (1)” dengan perkataan “subperaturan (1) dan (1A)”;

in paragraph (4)(c), by deleting the word “or” at the end of the paragraph;

in paragraph (4)(d), by substituting for the full stop the words “; or”; and

by inserting after paragraph (4)(d) the following paragraph:

“(e)

by the making of a hibah amanah by the depositor under regulation 7A.” .

New regulations 7A and 7B

A depositor who is of eighteen years of age or above may make a hibah amanah for the amount or any part of the amount standing to the depositor’s credit to be given to any person as the recipient of the hibah amanah.

Every such hibah amanah shall be made in the form as determined by the Lembaga and shall have no effect unless made during the lifetime of the depositor.

The amount or part of the amount standing to the depositor’s credit given to the recipient of the hibah amanah under subregulation (1) shall be paid in accordance with regulation 8.

Subject to subregulation (5) and the terms and conditions as may be determined by the Lembaga, the recipient of the hibah amanah shall authorize the depositor—

The depositor shall at all times during his lifetime maintain a minimum deposit as determined by the Lembaga unless the hibah amanah is revoked under regulation 7B.

The depositor shall notify the Lembaga of any addition of the recipient of the hibah amanah or of any variation of the amount standing to the depositor’s credit given for the hibah amanah or of the death of the recipient of the hibah amanah.

Where the hibah amanah is made for a part of the amount standing to the depositor’s credit, the depositor may nominate any person in accordance with regulation 7 to whom the balance amount standing to the depositor’s credit may be paid upon the depositor’s death in accordance with regulation 8.

Revocation of hibah amanah

in the case of a hibah amanah made by a depositor who is a parent or grandparent to be given to his biological child or his biological grandchild as the recipient of hibah amanah, as the case may be, by written notice as determined by the Lembaga given by the depositor and received by the Lembaga during the lifetime of the depositor and the recipient of the hibah amanah; or

in any other cases, by mutual consent of the depositor and the recipient of the hibah amanah in a manner determined by the Lembaga.”.

Amendment of regulation 8 5.

Regulation 8 of the principal Regulations is amended in —

in subregulation (1)—

in paragraph (a), by deleting the word “or” at the end of the paragraph;

by inserting after subregulation (1) the following subregulation:

“ (1A) On the death of a recipient of a hibah amanah, the amount or part of the amount standing to the depositor’s credit given to the recipient of the hibah amanah shall be payable to any person who is entitled to inherit the amount or part of the amount under Hukum Syarak whenever a claim is made to the Lembaga by that person in a manner determined by the Lembaga.”;

in subregulation (2), by substituting for the words “subregulation (1)”

the words “subregulations (1) and (1A)”;

in subregulation (3), by inserting after the word “nominee” the words

“and in the case of hibah amanah, by the recipient of hibah amanah”;

by inserting after subregulation (3) the following subregulation:

“(3A) Before making any payment under subregulation (1A), the

Lembaga may, for the purpose of satisfying the Lembaga that the recipient of the hibah amanah is dead, require that the death certificate or a certified true copy or extract of the death certificate of the recipient of the hibah amanah or any other documents specified by the Lembaga be produced to the Lembaga by the person making the claim.”; and

in subregulation (4), by inserting after the word “depositor” wherever appearing the words “or the recipient of a hibah amanah”.
