Seksyen 2

Dalam Peraturan-Peraturan ini, melainkan jika konteksnya menghendaki makna yang lain—

“anggota” ertinya seseorang yang menjadi ahli berdaftar kepada suatu badan sukan termasuk ahli sukan;

“jawatankuasa” ertinya jawatankuasa pertikaian dalaman yang ditubuhkan di bawah peraturan 4;

“pemohon” ertinya anggota badan sukan atau jawatankuasa badan sukan atau badan pengelola badan sukan yang membuat aduan pertikaian di bawah

Peraturan-Peraturan ini;

“responden” ertinya anggota badan sukan atau jawatankuasa badan sukan atau badan pengelola badan sukan yang dinamakan dalam aduan pertikaian;

“setiausaha badan sukan” ertinya mana-mana orang yang memegang jawatan sebagai setiausaha bagi jawatankuasa induk badan sukan atau dalam keadaan jawatankuasa induk badan sukan itu tiada jawatan setiausaha, mana-mana orang yang memegang apa-apa jawatan setara yang melaksanakan fungsi yang sama seperti setiausaha bagi jawatankuasa induk badan sukan itu;

“setiausaha badan pengelola badan sukan” ertinya mana-mana orang yang memegang jawatan sebagai setiausaha bagi badan pengelola badan sukan atau dalam keadaan badan pengelola badan sukan itu tiada jawatan setiausaha, mana-mana orang yang memegang apa-apa jawatan setara yang menjalankan fungsi yang sama seperti setiausaha bagi badan pengelola badan sukan itu.

Aduan pertikaian

Mana-mana pemohon hendaklah membuat aduan pertikaian secara bertulis dan mengemukakan aduan pertikaian itu kepada setiausaha badan sukan atau setiausaha badan pengelola badan sukan, mana-mana yang berkenaan, mengikut bentuk dan cara yang ditentukan oleh Pesuruhjaya.

Aduan pertikaian yang dibuat di bawah subperaturan (1) hendaklah dikemukakan bersama dokumen sokongan bagi menyokong aduan pertikaian itu.

Suatu jawatankuasa hendaklah ditubuhkan dalam tempoh dua puluh satu hari dari tarikh aduan pertikaian diterima di bawah subperaturan 3(1) seperti yang berikut:

(a)

bagi aduan pertikaian antara anggota dengan anggota lain dalam badan sukan yang sama, jawatankuasa itu hendaklah ditubuhkan oleh badan sukan itu;

bagi aduan pertikaian antara anggota dengan jawatankuasa badan sukan yang sama, jawatankuasa itu hendaklah ditubuhkan oleh badan pengelola badan sukan itu; atau 5

(c)

bagi aduan pertikaian antara anggota dengan badan pengelola badan sukan yang sama, jawatankuasa itu hendaklah ditubuhkan oleh suatu badan pengelola badan sukan itu yang satu tahap lebih tinggi daripada badan pengelola badan sukan yang terlibat dalam aduan pertikaian itu.

Jawatankuasa yang ditubuhkan di bawah peraturan 4 hendaklah terdiri daripada seorang pengerusi dan apa-apa bilangan anggota yang ditentukan dan dilantik oleh badan sukan atau badan pengelola badan sukan mengikut penubuhan jawatankuasa di bawah perenggan 4(a), (b) atau (c), mengikut mana-mana yang berkenaan.

Semasa apa-apa tempoh kekosongan jawatan anggota jawatankuasa, badan sukan atau badan pengelola badan sukan yang menubuhkan jawatankuasa di bawah perenggan 4(a), (b) atau (c) boleh melantik mana-mana anggota badan sukan untuk melaksanakan fungsi jawatankuasa.

Pengerusi jawatankuasa hendaklah, dalam tempoh enam puluh hari dari tarikh jawatankuasa ditubuhkan, menetapkan suatu tarikh, masa dan tempat pendengaran aduan pertikaian.

Setiausaha jawatankuasa hendaklah mengeluarkan suatu notis pendengaran aduan pertikaian itu kepada pemohon dan responden, atau saksi yang dinamakan oleh pemohon dan responden, dan menyampaikan notis itu mengikut cara yang ditentukan oleh setiausaha jawatankuasa.

Bagi maksud pendengaran aduan pertikaian itu, setiausaha jawatankuasa hendaklah mengemukakan semua dokumen yang diterima di bawah peraturan 3 kepada pengerusi jawatankuasa.

Semasa pendengaran aduan pertikaian, pemohon atau responden boleh mengemukakan apa-apa dokumen tambahan kepada jawatankuasa dan pihak yang satu lagi.

Setiausaha jawatankuasa hendaklah merekodkan minit pendengaran aduan pertikaian dan hendaklah menyimpan rekod semua pendengaran aduan pertikaian itu.

(1)

Jika pemohon, responden atau saksi yang dinamakan oleh pemohon dan responden tidak dapat hadir pada tarikh pendengaran aduan pertikaian kecuali dalam hal kecemasan, pemohon, responden atau saksi itu, hendaklah memberikan notis bertulis berkenaan ketidakhadirannya sekurang-kurangnya tujuh hari sebelum tarikh pendengaran aduan pertikaian kepada setiausaha jawatankuasa dan jawatankuasa boleh meneruskan atau menangguhkan pendengaran aduan pertikaian itu.

Jika tiada notis bertulis di bawah subperaturan (1) diberikan dan—

(a)

pemohon tidak hadir dan responden hadir pada pendengaran aduan pertikaian, jawatankuasa boleh, jika berpuas hati bahawa notis di bawah subperaturan 7(2) telah disampaikan—

menangguhkan pendengaran aduan pertikaian itu ke suatu tarikh lain yang akan ditentukan oleh jawatankuasa; atau

(ii)

tidak meneruskan pendengaran dan menolak aduan pertikaian itu;

(b)

responden tidak hadir dan pemohon hadir pada pendengaran aduan pertikaian, jawatankuasa boleh, jika berpuas hati bahawa notis di bawah subperaturan 7(2) telah disampaikan—

menangguhkan pendengaran aduan pertikaian itu ke suatu tarikh lain yang akan ditentukan oleh jawatankuasa; atau

(ii)

meneruskan pendengaran aduan pertikaian itu dan membuat keputusan; dan

pemohon dan responden tidak hadir pada tarikh pendengaran aduan pertikaian, jawatankuasa boleh, jika berpuas hati bahawa notis di bawah subperaturan 7(2) telah disampaikan, tidak meneruskan pendengaran dan menolak aduan pertikaian itu.

Seksyen 10

Pendengaran aduan pertikaian oleh jawatankuasa boleh, jika perlu, ditangguhkan dari semasa ke semasa atas apa-apa sebab yang munasabah, termasuklah bagi meneliti apa-apa keterangan, maklumat, rekod, atau dokumen tambahan yang dikemukakan di bawah subperaturan 8(1).

Tempoh penyelesaian pertikaian

(1)

Apa-apa aduan pertikaian di bawah Peraturan-Peraturan ini hendaklah diselesaikan dalam tempoh tiga tahun dari tarikh aduan pertikaian itu diterima di bawah subperaturan 3(1).

Dalam sesuatu hal apabila aduan pertikaian tidak dapat diselesaikan dalam tempoh yang disebutkan dalam subperaturan (1), aduan pertikaian itu hendaklah dianggap sebagai tidak selesai dan bolehlah dirujuk kepada Jawatankuasa Pertikaian

Sukan oleh mana-mana anggota badan sukan.

Keputusan

Seksyen 12

(1)

Setelah pendengaran aduan pertikaian selesai, jawatankuasa boleh membuat keputusan pada hari yang sama dan hendaklah menyampaikan keputusan secara bertulis kepada pemohon dan responden dalam tempoh tujuh hari dari tarikh keputusan dibuat.

Sekiranya keputusan tidak dibuat pada hari yang sama, keputusan hendaklah dibuat secara bertulis dan disampaikan kepada pemohon dan responden dalam tempoh dua puluh satu hari dari tarikh pendengaran aduan pertikaian itu selesai didengar oleh jawatankuasa.

Apa-apa keputusan aduan pertikaian yang dibuat oleh jawatankuasa hendaklah dikemukakan kepada Pesuruhjaya dalam tempoh tiga puluh hari selepas keputusan itu dibuat.

Pertikaian yang tidak dapat diselesaikan

Mana-mana aduan pertikaian yang tidak dapat diselesaikan setelah keputusan dibuat di bawah peraturan 12, aduan pertikaian itu bolehlah dirujuk kepada

Jawatankuasa Pertikaian Sukan oleh mana-mana anggota sesuatu badan sukan atau badan sukan itu.

Mana-mana tindakan penyelesaian pertikaian yang telah dimulakan mengikut tatacara dalaman mana-mana badan sukan itu sebelum tarikh permulaan kuat kuasa

Peraturan-Peraturan ini hendaklah, selepas permulaan kuat kuasa

Peraturan-Peraturan ini, diteruskan di bawah tatacara dalaman badan sukan itu seolah-olah Peraturan-Peraturan ini tidak dibuat.

Apa-apa pertikaian yang timbul dan masih belum dimulakan mengikut tatacara dalaman badan sukan itu sebelum tarikh permulaan kuat kuasa

SPORTS DEVELOPMENT (INTERNAL PROCEDURES FOR RESOLVING DISPUTES

WITHIN SPORTS BODY) REGULATIONS 2022

  1. IN exercise of the powers conferred by paragraph 38(2)(d) of the Sports Development Act 1997 [Act 576], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Sports Development

(Internal Procedures for Resolving Disputes within Sports Body) Regulations 2022.

These Regulations come into operation on 15 March 2022.

Interpretation 2.

In these Regulations, unless the context otherwise requires—

“member” means a person who is a registered member of a sports body including a sportsperson;

“committee” means an internal dispute committee established under regulation 4;

“applicant” means a member of a sports body or a committee of a sports body or the governing body of a sports body who makes a dispute complaint under these Regulations;

“respondent” means a member of a sports body or a committee of a sports body or the governing body of a sports body named in the dispute complaint;

“secretary of the sports body” means any person who holds office as a secretary for a main committee of a sports body or in the event that the main committee of the

sports body does not have a post for a secretary, any person holding an equivalent post who performs the same function as the secretary for a main committee of the sports body;

“secretary of the governing body of the sports body” means any person who holds an office of a secretary for the governing body of a sports body or in the event that the governing body of the sports body does not have the post for a secretary, any person holding an equivalent post who performs the same function as the secretary of the governing body of the sports body.

Dispute complaint 3.

(1)

Any applicant shall make a dispute complaint in writing and submit the dispute complaint to the secretary of the sports body or the secretary of the governing body of the sports body, as the case may be, in the form and manner determined by the

Commissioner.

(2)

The dispute complaint made under subregulation (1) shall be submitted with a supporting document in support of the dispute complaint.

Establishment of committee 4.

A committee shall be established within twenty-one days from the date of the dispute complaint received under subregulation 3(1) as follows:

(a)

for a dispute complaint between members and other members of the same sports body, the committee shall be established by the sports body;

for a dispute complaint between members and a committee of the same sports body, the committee shall be established by a governing body of the sports body; or

(c)

for a dispute complaint between members and the governing body of the same sports body, the committee shall be established by a governing body

of the sports body which is one level higher than the governing body of the sports body involved in the dispute complaint.

(1)

The committee established under regulation 4 shall consist of a chairman and any number of members as may be determined and appointed by the sports body or the governing body of the sports body in accordance with the establishment of the committee under paragraphs 4(a), (b) or (c), as the case may be.

(2)

During any period when the office of the committee member is vacant, the sports body or the governing body of the sports body who established the committee under paragraphs 4(a), (b) or (c) may appoint any member of the sports body to perform the functions of the committee.

Secretary of committee 6.

A secretary of the sports body or a secretary of the governing body of the sports body, as the case may be, shall be a secretary of the committee.

Notice of hearing 7.

(1)

A chairman of the committee shall, within sixty days from the date of the committee being established, fix a date, time and place of hearing of a dispute complaint.

(2)

A secretary of the committee shall issue a notice of the hearing of a dispute complaint to the applicant and respondent, or witness named by the applicant and respondent, and serve the notice in the manner as may be determined by the secretary of the committee.

(3)

For the purposes of the hearing of a dispute complaint, the secretary of the committee shall submit all documents received under regulation 3 to the chairman of the committee.

Hearing 8.

(1)

During hearing of a dispute complaint, the applicant or respondent may submit any additional document to the committee and the other party.

(2)

The secretary of the committee shall record the minutes of the hearing of a dispute complaint and shall keep a record of all hearings of the dispute complaint.

Absence of parties 9.

(1)

If an applicant, respondent or witness named by the applicant and respondent is unable to attend on the date of the hearing of the dispute complaint except in case of an emergency, the applicant, respondent or witness, shall give written notice regarding his absence at least seven days before the date of hearing of the dispute complaint to the secretary of the committee and the committee may proceed or postpone the hearing of the dispute complaint.

If no written notice under subregulation (1) is given and—

(a)

the applicant is absent and the respondent is present at the hearing of the dispute complaint, the committee may, if satisfied that the notice under subregulation 7(2) has been served—

(i)

adjourn the hearing of the dispute complaint to another date to be determined by the committee; or

(ii)

discontinue the hearing and dismiss the dispute complaint;

(b)

the respondent is absent and the applicant is present on the hearing of the dispute complaint, the committee may, if satisfied that the notice under subregulation 7(2) has been served—

(i)

adjourn the hearing of the dispute complaint to another date to be determined by the committee; or

(ii)

continue with the hearing of the dispute complaint and make a decision; and

(c)

the applicant and the respondent are not present on the date of the hearing of the dispute complaint, the committee may, if satisfied that the notice under subregulation 7(2) has been served, discontinue the hearing and dismiss the dispute complaint.

Adjournment of hearing 10.

The hearing of a dispute complaint by the committee may, if necessary, be adjourned from time to time for any reasonable reason, including for examination of any evidence, information, records or additional documents submitted under subregulation 8(1).

(1)

Any dispute complaint under these Regulations shall be resolved within three years from the date the dispute complaint is received under subregulation 3(1).

(2)

In case where the dispute complaint cannot be resolved within the period referred to in subregulation (1), the dispute complaint shall be considered as unresolved and may be referred to Sports Dispute Committee by any member of the sports body.

Decision 12.

(1)

Once the hearing of the dispute complaint is concluded, the committee may make a decision on the same day and shall deliver the decision in writing to the applicant and respondent within seven days from the date the decision is made.

If the decision is not made on the same day, the decision shall be made in writing and delivered to the applicant and respondent within twenty-one days from the date the hearing of the dispute complaint is concluded by the committee.

(3)

Any decision of the dispute complaint made by the committee shall be submitted to the Commissioner within thirty days after the decision is made.

Unresolved dispute complaint 13.

Any dispute complaint that cannot be resolved after a decision has been made under regulation 12, the dispute complaint may be referred to the Sports Dispute

Committee by any member of the sports body or the sports body.

Saving 14.

(1)

Any act of dispute settlement which has been instituted in accordance with the internal procedures of any sports body before the date of commencement of these

Regulations shall, after the commencement of these Regulations, be continued under the internal procedures of the sports body as if these Regulations are not made.

Any dispute arising and has yet to be commenced in accordance with the internal procedures of the sports body prior to the date of commencement of these

Regulations, shall be resolved by the sports body in accordance with these Regulations.
