Power of Council to delegate
of Sabah Biodiversity Enactment 2000
The Council may, in writing, delegate any of its functions or powers subject to such conditions, limitations or restriction as it thinks fit, to the Chairman of the Council, Director or any committee, and such person or committee to whom the functions or powers is delegated shall perform the functions or powers in the same manner and with the same effect as if the functions or powers had been conferred on him under this Enactment.
(2)
A person purporting to act pursuant to a delegation made under this section shall, in the absence of proof to the contrary, be presumed to be acting in accordance with the terms of the delegation.
(3)
A delegation made under this section may at any time be revoked by the Council.
(4)
A delegation made under this section shall not preclude the Council itself from carrying out at any time the delegated functions or powers.
