(2)
The developer shall perform its duties and exercise its powers as provided in the First Schedule.
(3)
During the developer’s management period—
(a)
the developer shall ensure that a separate and distinct area is set aside out of the common property of the development for the sole purpose of an administration office for the carrying out of duties of the developer under this
Ordinance;
(b)
the developer shall not be entitled to be paid any remuneration for carrying out the management and maintenance of a building or land intended to be subdivided into parcels and the common property in the development; and
(c)
the developer shall be allowed to enter into any contract for the purposes of management and maintenance of

a building or land intended to be subdivided into parcels and the common property in the development provided that such contract shall not extend beyond the developer’s management period.
(4)
Any developer who fails to comply with the provisions with this section shall be guilty of an offence and shall, upon conviction, be punished with a fine not exceeding two hundred and fifty thousand ringgit or imprisonment for a term not exceeding three years or to both.
