Joinder of parties
(a)
separate actions were brought by or against each of them, as the case may be, and some common question of law or fact would arise in all the actions; and
(b)
all rights to relief claimed in the action, whether they are joint, several or in the alternative, are in respect of or arise out of the same transaction or series of transactions.
(2)
Notwithstanding subsection (1), if it appears to the Court that any joinder may embarrass any defendant or delay the trial or be otherwise inconvenient, the Court may, of its own motion or on the application of the defendant, order separate trials or make such other orders as it thinks fit.
(3)
Judgment may be given without any amendment to any plaintiff for the relief to which he is entitled, or against such one or more of the defendants as may be found liable according to their respective liabilities.
