Section 10B
Limitation on rights given by registered certification marks
A registered proprietor of certification mark consisting of geographical indication does not have the right⸺
(a)
to prevent any use in the course of trade any individual component contained in the certification mark consisting of geographical indication where the individual component is identical to a term customary in the common language as the common name of any goods or services in Malaysia; or
(b)
to institute any proceedings for infringement against the lawful use of a registered geographical indication registered under the Geographical
Indications Act 2022 or any previous written law relating to geographical indications.
