(a)
the application has not been opposed and the period for opposition has expired; or
(b)
the application has been opposed and the opposition has been decided in favour of the applicant, the Registrar shall, unless the application has been accepted in error, register the trademark in the Register in the name of the proprietor, and the trademark so registered shall be registered as at the date of filing of application for registration and that date shall be deemed to be the date of registration.
(2)
On the registration of trademark, the Registrar shall issue to the proprietor a notification of the registration of trademark with the seal of the Registrar.
(3)
If the registered proprietor intends to obtain a certificate of

registration, the Registrar shall issue the certificate of registration which shall be equivalent to the notification of registration issued under subsection (2).
(4)
An application for a certificate of registration under subsection
(3)
shall be made by the registered proprietor in the form as determined by the Registrar together with the payment of the prescribed fee.
