(2)
Where a person appearing before the Registrar in a preliminary procedure or applying for registration of trademark or any procedure relating to a registered trademark, does not reside or carry on business principally in Malaysia, he shall appoint and authorize a registered trademark agent to act for him.
(3)
Upon being appointed and authorized by the person to act for him under subsection (2), the registered trademark agent shall—
(a)
continue to be the agent of the person; and
(b)
be answerable for all acts, matters and things that are required to be done by the person under this Act, unless he is terminated by the person or ceases to act for him in accordance with the prescribed manner.
(4)
Where a registered trademark agent acting for a person intends to cease to act on behalf of the said person—
(a)
the registered trademark agent shall file the notice of the intention to cease to act on the said person’s behalf with the Registrar in the manner as determined by the
Registrar;
(b)
the registered trademark agent shall notify the person;
and
(c)
upon complying with subparagraphs (a) and (b), the agent shall cease to be the agent for the said person.
