Section 52

In all legal proceedings relating to a registered trademark—

of Trademarks Act 2019

Section 52

(a)

the Register shall be prima facie evidence of anything contained in the Register;

(b)

the registration of the prescribed particulars of any registrable transaction under section 65 shall be prima facie evidence of the transaction; and

(c)

the registration of a person as the registered proprietor of the trademark shall be prima facie evidence of—

(i)

the validity of the original registration of trademark;

and

(ii)

any subsequent assignments and transmissions.
