Upon receipt of the notification of the dispute referred to in section 83, the Commission shall, as soon as practicable, convene to decide the dispute.
The Commission shall be bound under subsection (1) to convene to decide a dispute if it is satisfied that—
an agreement will not be reached, or will not be reached within a reasonable time;
the notification of the dispute is not trivial, frivolous or vexatious; and
the resolution of the dispute would promote the objects of this Act.
Subject to the objects of this Act and any guidelines issued by the Commission under this Chapter, the Commission may resolve the dispute upon such terms and conditions as it may deem fit.

“agreement” means an agreement, whether formal or informal, oral or written, express or implied;
