Proceedings before the Tribunal
(2)
No member of the Tribunal shall take part in any proceedings before the Tribunal if he has a pecuniary interest in any matter which is to be determined by the Tribunal.
(3)
Where the
Chairman has been disqualified under subsection (2), the Minister shall appoint a Deputy Chairman to act as chairman for the purposes of that proceedings.
(4)
A person is deemed to have a pecuniary interest if he, his partner, employer or any member of his family or if a body whether statutory or not of which he is a member has a pecuniary interest in any matter which is to be determined by the Tribunal.
(5)
If, on any matter to be determined by the Tribunal there is an equality of votes, the chairman of the proceedings shall have a casting vote in addition to his deliberative vote.
(6)
If, in the course of any proceedings, any member of the
Tribunal is unable through illness or any other cause to continue, the proceedings shall continue before the remaining members of the
Tribunal, not being less than two, and the Tribunal shall, for the purposes of the proceedings, be deemed to be duly constituted.
(7)
In any such case as is mentioned in subsection (6) where the member who is unable to continue is the chairman of the proceedings, then the Minister shall—
(a)
appoint from amongst the remaining members a new chairman for the purpose of the continued proceedings; and
(b)
where appropriate, appoint a Deputy Chairman to attend the proceedings to advise the members of the proceedings on any issue that may arise during the proceedings.
