Section 12A
Prescribed activities to be approved
of Environment Protection Enactment 2002
(1)
No person shall carry out any prescribed activities unless the environmental impact assessment report or the proposal for mitigation measures thereof has been approved by the Director.
(2)
Any person who contravenes subsection (1), -
(a)
in relation to environmental impact assessment report, commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both; and

(b)
in relation to proposal for mitigation measures, commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years or to both.
