Section 12E
(1)
The Director shall, before the commencement of any prescribed activities in respect of which an environmental impact assessment report or proposal for mitigation measures has been submitted and approved, require the person to undertake in writing to comply with any terms and conditions as may be prescribed by the Director by signing an agreement of environmental conditions or a mitigation declaration, as the case may be.
(2)
The Director may add to, vary or revoke the terms and conditions of the agreement or the declaration.
(3)
Any person who fails to comply with the terms and conditions of –

(a)
the agreement of the environmental conditions, commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both; and
(b)
the mitigation declaration, commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years or to both.
