(2)
Subsection (1) shall not apply to—
(a)
building operations or works of engineering construction the carrying out of which does not involve the use of machinery and which the person undertaking them has grounds for believing will be completed in a period of less than six weeks;
and
(b)
a person undertaking any operations in a place in which building operations or works of engineering construction are being carried out in respect of which notice has been given under subsection (1).
