  1. PADA menjalankan kuasa yang diberikan oleh subseksyen 61A(3) Akta Pentadbiran Undang-Undang Islam (Wilayah-Wilayah Persekutuan) 1993 [Akta 505], Majlis, dengan kelulusan Yang di-Pertuan Agong, membuat kaedah-kaedah yang berikut:

Seksyen 2

Dalam Kaedah-Kaedah ini, melainkan jika konteksnya menghendaki makna yang lain—

“Daftar Wakaf” ertinya suatu daftar yang disimpan dan disenggara di bawah kaedah 11;

“kumpulan wang wakaf” ertinya kumpulan wang wakaf yang terdiri daripada semua wang dan harta yang diwakafkan atau apa-apa hasil yang diperoleh daripada mawquf atau melalui istibdal sama ada diakaunkan dalam akaun wakaf ‘am atau akaun wakaf khas yang menjadi sebahagian daripada Baitulmal;

“marad-al-maut” ertinya suatu penyakit yang boleh membawa maut yang memenuhi syarat yang berikut:

(a)

penyakit itu pada lazimnya berakhir dengan kematian;

penyakit itu menyebabkan takut akan kematian dalam minda pesakit sehingga menjejaskan kewarasan akal fikiran;

(c)

penyakit itu mempunyai beberapa tanda luaran yang menunjukkan bahawa penyakit itu merupakan suatu penyakit yang serius; dan

(d)

penyakit itu dideritai secara berterusan dalam tempoh tidak lebih daripada satu tahun;

“waqif” ertinya mana-mana orang yang memberikan dan menyerahkan hartanya sebagai suatu wakaf;

“waris” ertinya orang yang berhak mewarisi sesuatu harta pusaka menurut

Hukum Syarak.

BAHAGIAN II

Seksyen 3

Jawatankuasa Wakaf yang ditubuhkan di bawah subseksyen 61A(1) Akta hendaklah terdiri daripada—

(a)

seorang Pengerusi yang dilantik oleh Majlis dalam kalangan anggota Majlis;

Ketua Pengarah Jabatan Wakaf, Zakat dan Haji atau wakilnya;

Suggest a correction

(e)

Pengarah Jabatan Agama Islam Wilayah Persekutuan;

(f)

Pengarah Tanah dan Galian Wilayah Persekutuan atau wakilnya;

dan

Suggest a correction

(g)

sekurang-kurangnya tiga orang dan tidak lebih daripada lima orang anggota lain yang hendaklah dilantik oleh Majlis dalam kalangan orang Islam yang mempunyai pengalaman, pengetahuan dan kepakaran dalam perkara yang berhubungan dengan wakaf atau apa-apa bidang lain yang boleh menyumbang kepada pembangunan wakaf.

Anggota yang dilantik di bawah perenggan (1)(a) dan (g) hendaklah memegang jawatan selama tempoh tidak melebihi tiga tahun dan layak untuk dilantik semula.

Jika pada bila-bila masa orang yang memegang jawatan yang disebut di bawah perenggan (1)(f) bukan orang Islam, Majlis hendaklah melantik seorang pegawai lain yang beragama Islam dan yang kanan selepasnya dari Pejabat Pengarah

Tanah dan Galian Wilayah Persekutuan untuk menjadi anggota Jawatankuasa Wakaf bagi menggantikan orang itu.

Pegawai Majlis yang dipertanggungkan dengan tanggungjawab bagi hal ehwal wakaf hendaklah menjadi Setiausaha Jawatankuasa Wakaf.

Setiausaha Jawatankuasa Wakaf hendaklah bertanggungjawab bagi menjalankan dasar, arahan dan keputusan Jawatankuasa Wakaf.

Setiausaha Jawatankuasa Wakaf hendaklah menghadiri semua mesyuarat

Jawatankuasa Wakaf dan boleh mengambil bahagian dalam pertimbangtelitiannya, tetapi tidak berhak untuk mengundi.

Pembatalan, peletakan jawatan dan pengosongan jawatan

Majlis boleh, pada bila-bila masa, membatalkan pelantikan mana-mana anggota Jawatankuasa Wakaf yang dilantik di bawah perenggan 3(1)(a) dan (g).

Jawatankuasa

Wakaf yang dilantik di bawah perenggan 3(1)(a) dan (g) boleh, pada bila-bila masa, meletakkan jawatan dengan memberikan suatu notis bertulis kepada Setiausaha Majlis.

Seseorang anggota Jawatankuasa Wakaf yang dilantik di bawah perenggan 3(1)(a) dan (g) hendaklah disifatkan telah mengosongkan jawatannya jika—

(b)

telah dibuktikan terhadapnya, atau dia telah disabitkan atas, suatu pertuduhan berkenaan dengan suatu kesalahan jenayah;

(c)

dia dihukum sebagai bankrap yang belum dilepaskan; atau

Suggest a correction

(d)

dia menjadi tidak sempurna akal atau selainnya tidak berupaya untuk menunaikan kewajipannya.

Seseorang anggota yang dilantik di bawah perenggan 3(1)(a) dan (g) hendaklah terhenti menjadi seorang anggota Jawatankuasa Wakaf jika pelantikannya dibatalkan, anggota itu meletakkan jawatannya atau disifatkan telah mengosongkan jawatannya, dan Majlis boleh melantik seorang yang lain untuk mengisi kekosongan itu bagi tempoh berbaki anggota yang mengosongkan jawatan itu.

Seksyen 7

Mesyuarat Jawatankuasa Wakaf

Semua mesyuarat

Jawatankuasa

Wakaf hendaklah dipanggil oleh Setiausaha Jawatankuasa Wakaf atas arahan Pengerusi dengan menyampaikan suatu notis bertulis kepada anggota Jawatankuasa Wakaf sekurang-kurangnya lima hari bekerja sebelum mesyuarat.

Walau apa pun subkaedah (1), Pengerusi boleh, jika dia berpandangan bahawa terdapat keperluan mendesak, memanggil mesyuarat dengan notis yang lebih singkat.

Jika

Pengerusi tidak hadir dalam mana-mana mesyuarat, anggota yang hadir hendaklah memilih salah seorang daripada mereka untuk mempengerusikan mesyuarat itu dan anggota itu boleh menjalankan segala kuasa

Jawatankuasa Wakaf hendaklah bermesyuarat sekurang-kurangnya empat kali setahun.

Enam orang anggota Jawatankuasa Wakaf yang hadir hendaklah membentuk kuorum dalam mana-mana mesyuarat Jawatankuasa Wakaf.

Semua keputusan mesyuarat Jawatankuasa Wakaf hendaklah dibuat secara persetujuan atau melalui ketetapan majoriti anggota yang hadir dan berhak untuk mengundi, dan jika terdapat persamaan undi, pengerusi mesyuarat hendaklah mempunyai undi pemutus.

Pengerusi boleh mengundang mana-mana orang yang bukan anggota

Jawatankuasa Wakaf untuk hadir dalam mana-mana mesyuarat atau pertimbangtelitian

Jawatankuasa Wakaf bagi maksud menasihati Jawatankuasa Wakaf mengenai apa-apa perkara yang sedang dibincangkan tetapi orang itu tidak berhak mengundi dalam mesyuarat atau pertimbangtelitian itu.

Semua keputusan yang dibuat oleh mesyuarat Jawatankuasa Wakaf hendaklah dilaporkan kepada Majlis.

Semua minit mesyuarat Jawatankuasa Wakaf hendaklah disenggara dan disimpan oleh Setiausaha Jawatankuasa Wakaf.

Apa-apa minit mesyuarat Jawatankuasa Wakaf yang telah ditandatangani dengan sewajarnya oleh Pengerusi dan Setiausaha Jawatankuasa Wakaf hendaklah diterima dalam apa-apa prosiding sebagai keterangan prima facie mengenai fakta yang dinyatakan dalam minit itu tanpa bukti selanjutnya.

BAHAGIAN III

KETUA PENDAFTAR WAKAF DAN PENDAFTAR WAKAF

Seksyen 9

Setiausaha Majlis hendaklah menjadi Ketua Pendaftar Wakaf.

Majlis boleh melantik apa-apa bilangan Pendaftar Wakaf sebagaimana yang Majlis fikirkan perlu untuk membantu Ketua Pendaftar Wakaf dalam melaksanakan fungsi dan menjalankan kuasa Majlis di bawah Kaedah-Kaedah ini.

Tertakluk kepada arahan dan kawalan Ketua Pendaftar Wakaf, seseorang Pendaftar Wakaf boleh menjalankan apa-apa kuasa Ketua Pendaftar Wakaf di bawah Kaedah-Kaedah ini.

Ketua Pendaftar Wakaf hendaklah bertanggungjawab untuk—

mendaftarkan semua mawquf yang diwujudkan di bawah

menyimpan dan menyenggara suatu daftar bagi semua mawquf dalam apa-apa bentuk atau mengikut apa-apa cara yang ditentukan oleh Majlis;

menyimpan dan memegang semua surat cara, dokumen hakmilik atau dokumen lain yang berhubungan dengan mana-mana mawquf;

(d)

menyenggara data dan maklumat berkaitan dengan mawquf, mutawalli dan qayyim; dan

(e)

melaksanakan apa-apa kewajipan yang diarahkan oleh

Jawatankuasa Wakaf.

Daftar Wakaf

Ketua Pendaftar Wakaf hendaklah menyimpan dan menyenggarakan suatu Daftar Wakaf.

Bagi maksud subkaedah (1), Daftar Wakaf hendaklah mengandungi maklumat yang berikut:

(a)

butir-butir mawquf yang Majlis sebagai pemegang amanah tunggal atau mawquf ‘alaih;

butir-butir lain yang berhubungan dengan wakaf yang difikirkan perlu atau suai manfaat oleh Ketua Pendaftar Wakaf.

Seseorang yang ingin menyerahkan hartanya sebagai suatu wakaf boleh memohon bagi pendaftaran wakaf itu kepada Jawatankuasa Wakaf mengikut cara sebagaimana yang ditentukan oleh Jawatankuasa Wakaf.

Jawatankuasa Wakaf boleh menentukan jenis harta yang tidak perlu didaftarkan sebagai suatu wakaf.

Jika Jawatankuasa Wakaf berpuas hati bahawa permohonan di bawah subkaedah (1) telah mematuhi rukun dan syarat wakaf di bawah Kaedah-Kaedah ini,

Wakaf boleh meluluskan permohonan itu dan mengarahkan

Ketua Pendaftar Wakaf untuk mendaftarkan wakaf itu dalam Daftar Wakaf.

BAHAGIAN IV

PELANTIKAN MUTAWALLI, QAYYIM DAN PENTADBIR

Mutawalli dan qayyim

Seksyen 13

Tiada seorang pun boleh memungut, menerima, mengurus, mentadbir atau membangunkan mawquf, atau mengagihkan manfaat mawquf, bagi pihak Majlis di Wilayah-Wilayah Persekutuan melainkan jika dia telah dilantik sebagai mutawalli atau qayyim, mengikut mana-mana yang berkenaan, oleh Jawatankuasa Wakaf.

Mana-mana mutawalli atau qayyim yang hendak mengagihkan mana-mana mawquf di luar Wilayah-Wilayah Persekutuan hendaklah mendapatkan kebenaran bertulis terlebih dahulu daripada Jawatankuasa Wakaf.

Mana-mana syarikat, firma, pertubuhan, persatuan atau kumpulan orang yang lain layak memohon untuk dilantik sebagai mutawalli atau qayyim jika mana-mana syarikat, firma, pertubuhan, persatuan atau kumpulan orang yang lain itu berdaftar di Malaysia dan menjalankan aktiviti atau perniagaan yang tidak bertentangan dengan

Hukum Syarak dan permohonan hendaklah dibuat kepada Jawatankuasa Wakaf mengikut cara sebagaimana yang ditentukan oleh Jawatankuasa Wakaf.

Jawatankuasa Wakaf boleh, pada bila-bila masa, membatalkan pelantikan mutawalli atau qayyim.

Tanggungjawab mutawalli dan qayyim

Mutawalli hendaklah bertanggungjawab untuk melaksanakan semua fungsi yang berikut:

mengurus, mentadbir dan membangunkan apa-apa mawquf; dan

Mutawalli boleh mewujudkan apa-apa produk wakaf dengan kelulusan

mengurus, mentadbir dan membangunkan apa-apa mawquf; atau

Mutawalli dan qayyim hendaklah melaporkan semua aktiviti yang dilaksanakan kepada Jawatankuasa Wakaf.

Wakaf, melantik mana-mana orang sebagai pentadbir untuk menguruskan mawqufnya.

dalam hal suatu syarikat, firma, pertubuhan, persatuan atau kumpulan orang yang lain, ia berdaftar di Malaysia dan menjalankan aktiviti atau perniagaan yang tidak bertentangan dengan Hukum Syarak.

Seksyen 17

Seseorang waqif hendaklah memenuhi syarat yang berikut:

dalam hal suatu syarikat, firma, pertubuhan, persatuan atau kumpulan orang yang lain—

ia diperbadankan, ditubuhkan atau didaftarkan di Malaysia atau di luar Malaysia;

(ii)

ia tidak digulungkan atau pendaftarannya tidak dibatalkan atau ditarik balik, mengikut mana-mana yang berkenaan; dan

(iii)

ia tidak menjalankan aktiviti atau perniagaan yang bertentangan dengan Hukum Syarak.

Sesuatu mawquf hendaklah suatu harta yang—

(a)

dimiliki secara sempurna oleh waqif;

boleh dipindah milik atau diserah hak tanpa apa-apa sekatan; dan

(c)

boleh memberikan apa-apa manfaat, keuntungan atau kepentingan kepada mawquf ‘alaih pada masa wakaf itu diwujudkan atau masa akan datang.

Bagi maksud perenggan (1)(a), harta itu hendaklah disifatkan telah dimiliki sepenuhnya oleh waqif, jika waqif dibenarkan secara sah untuk membuat apa-apa transaksi atau urus niaga berkenaan dengan harta itu.

Dalam hal suatu wakaf ‘am, mana-mana orang layak menjadi mawquf ‘alaih bagi sesuatu mawquf.

Dalam hal suatu wakaf khas, seorang mawquf ‘alaih hendaklah memenuhi syarat khusus yang dinyatakan oleh waqif.

Dalam hal suatu wakaf khas—

(a)

yang mempunyai lebih daripada seorang mawquf ‘alaih dan waqif tidak menentukan bahagian mereka masing-masing terhadap manfaat, keuntungan atau kepentingan mawquf itu, manfaat, keuntungan atau kepentingan itu hendaklah dibahagikan oleh Majlis kepada mawquf ‘alaih; atau

jika mawquf ‘alaih ialah asnaf yang layak menerima zakat, manfaat, keuntungan atau kepentingan mawquf itu hendaklah dibahagikan oleh Majlis mengikut hasrat waqif.

Sighah wakaf boleh dibuat sama ada secara lisan, bertulis atau isyarat di hadapan dua orang saksi mengikut Hukum Syarak.

Permulaan kuat kuasa wakaf

Tertakluk kepada subkaedah 26(1), sesuatu wakaf hendaklah mula berkuat kuasa apabila semua rukun dan syarat wakaf telah dipenuhi.

Jika sesuatu wakaf telah mula berkuat kuasa, mawquf tidak boleh dijual, digadai, dipindah milik atau diberikan sebagai hibah, dibatalkan oleh waqif atau diwarisi sebagai harta pusaka.

Bagi suatu wakaf muaqqat, larangan di bawah subkaedah (2) adalah terpakai semasa tempoh wakaf yang ditetapkan oleh waqif.

BAHAGIAN VI

Seksyen 24

Wakaf muaqqat

Seseorang waqif boleh mewujudkan suatu wakaf muaqqat bagi hartanya secara sementara mengikut Hukum Syarak.

Seksyen 25

Wakaf secara ta’liq

Seseorang waqif boleh mewujudkan suatu wakaf secara ta’liq yang hendaklah mula berkuat kuasa apabila berlakunya syarat yang dinyatakan oleh waqif itu semasa hayatnya dengan syarat bahawa syarat itu tidak bertentangan dengan

Hukum Syarak.

Suatu wakaf secara ta’liq adalah tidak sah jika waqif itu meninggal dunia sebelum syarat yang dinyatakan dalam ta’liq itu dipenuhi.

Jika seseorang waqif mewujudkan suatu wakaf secara ta’liq kepada warisnya untuk disempurnakan selepas kematiannya, wakaf itu hendaklah tertakluk kepada persetujuan semua waris selepas kematian waqif.

Sekiranya seseorang waqif mewujudkan suatu wakaf secara ta’liq kepada bukan waris supaya disempurnakan selepas kematiannya, wakaf itu tidak boleh melebihi satu pertiga daripada harta waqif setelah ditolak hutang dan apa-apa tanggungan mengikut Hukum Syarak melainkan dengan persetujuan semua waris.

Seseorang waqif boleh mewujudkan suatu wakaf secara wasiat dan melantik wasi untuk melaksanakan atau menyempurnakan wakaf secara wasiat itu selepas kematiannya.

Wasi hendaklah dilantik oleh waqif dalam kalangan orang Islam, badan atau syarikat yang diharuskan oleh Hukum Syarak dan wasi itu hendaklah menyempurnakan wakaf itu selepas kematian waqif.

Jika tiada wasi dilantik oleh waqif, mana-mana orang yang berkepentingan boleh memohon kepada Mahkamah bagi pelantikan wasi.

Wakaf secara wasiat kepada waris hendaklah tertakluk kepada persetujuan semua waris.

Wakaf secara wasiat kepada bukan waris hendaklah tidak melebihi satu pertiga daripada harta waqif setelah ditolak hutang dan apa-apa tanggungan mengikut Hukum Syarak melainkan dengan persetujuan semua waris.

Jika seseorang waqif menyerahkan hartanya sebagai suatu wakaf kepada warisnya di bawah subkaedah (4) atau kepada bukan warisnya melebihi satu pertiga daripada hartanya di bawah subkaedah (5), wasi hendaklah, selepas kematian waqif, mendapatkan persetujuan semua waris bagi maksud melaksanakan wakaf secara wasiat itu.

Jika wasi tidak melaksanakan wakaf secara wasiat itu selepas kematian waqif, mana-mana orang yang berkepentingan boleh memohon suatu perintah

Mahkamah terhadap wasi bagi melaksanakan wakaf secara wasiat itu.

Apabila perintah pelaksanaan yang disebut dalam subkaedah (7) itu diterima, wasi hendaklah melaksanakan wakaf mengikut wasiat itu.

Bagi maksud kaedah ini—

(a)

“orang yang berkepentingan” ertinya mana-mana orang yang mempunyai kepentingan terhadap suatu mawquf secara wasiat;

(b)

“wasi” ertinya seseorang pelaksana wakaf secara wasiat yang dilantik melalui wasiat atau dilantik oleh Mahkamah.

jika mana-mana syarat wakaf tidak selaras dengan mana-mana undang-undang bertulis;

Nilai mawquf yang diperoleh melalui istibdal hendaklah tidak kurang daripada nilai semasa mawquf asal.

Majlis hendaklah melaksanakan istibdal apa-apa mawquf sama ada keseluruhan atau sebahagiannya dalam tempoh yang munasabah dengan sewajarnya.

Jika melibatkan harta tak alih yang dibuktikan melalui dokumen hakmilik yang dikeluarkan di bawah Kanun Tanah Negara [Akta 828] atau undang-undang lain yang sedang berkuat kuasa, Pendaftar, selepas menerima permohonan secara bertulis daripada Majlis tentang pewujudan wakaf secara istibdal hendaklah, melaksanakan peletakhakan atau pindah milik harta tak alih itu ke atas Majlis sebagai pemegang amanah tunggal, dan jika berkaitan, perkataan “wakaf” hendaklah diendors dalam dokumen hakmilik itu.

Mana-mana orang yang memungut, menguruskan atau mengagihkan wakaf ‘am atau wakaf khas tanpa kebenaran bertulis daripada Jawatankuasa Wakaf melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya, dan Mahkamah hendaklah memerintahkan supaya pungutan itu dirampas dan dibayar ke dalam kumpulan wang wakaf.

  1. IN exercise of the powers conferred by subsection 61A(3) of the Administration of Islamic Law (Federal Territories) Act 1993 [Act 505], the Majlis, with the approval of the Yang di-Pertuan Agong, makes the following rules:

PART I

(1)

These rules may be cited as the Administration of Islamic Law

(Federal Territories) (Wakaf) Rules 2025.

These Rules come into operation on 1 January 2026.

Interpretation 2.

In these Rules, unless the context otherwise requires—

“Register of Wakaf” means a register kept and maintained under rule 11;

“wakaf fund” means the wakaf fund that consist of all monies and properties of wakaf or any proceed obtained from a mawquf or by istibdal whether accounted in account of wakaf ‘am or account of wakaf khas that forms part of the Baitulmal;

“death-bed

(marad-al-maut)”

means a fatal disease that fulfils the following conditions:

the disease causes a fear of death in the patient’s mind to the extent of affecting the soundness of mind;

the disease is accompanied by several external signs showing that the disease is a serious disease; and

the disease is suffered continuously for a period of not more than one year;

“waqif” means any person who gives and surrenders his property as a wakaf;

“heir” means a person who is entitled to inherit an estate in accordance with the Islamic Law.

Bahagian II

PART II

(1)

A Wakaf Committee established under subsection 61A(1) of the Act shall consist of—

(a)

a Chairman appointed by the Majlis from amongst Majlis’s members;

the Director General of Department of Waqf, Zakat and Hajj or his representative;

Suggest a correction

(e)

the Director of the Federal Territory Islamic Religious Department;

Suggest a correction

(f)

the Federal Territories Director of Lands and Mines or his representative; and

(g)

at least three and not more than five other members who shall be appointed by the Majlis from among Muslims who have experience, knowledge and expertise in matters relating to wakaf or any other field that can contribute to the development of wakaf.

(2)

Members appointed under paragraphs (1)(a) and (g) shall hold office for a term of not exceeding three years and eligible to be reappointed.

(3)

If at any time the person holding the appointment mentioned in paragraph (1)(f) is not a Muslim, the Majlis shall appoint another officer who is a Muslim and next in seniority from the Federal Territories Director of Lands and Mines

Office to be a member of Wakaf Committee in place of that person.

Secretary 4.

(1)

The officer of the Majlis charged with the responsibility for wakaf affairs shall be the Secretary of the Wakaf Committee.

The Secretary of the Wakaf Committe shall be responsible for carrying out of the policies, directions and decisions of the Wakaf Committee.

(3)

The Secretary of the Wakaf Committe shall attend all meetings of the Wakaf Committee and may participate in its deliberations, but is not entitled to vote.

Revocation, resignation and vacation of office 5.

(1)

The Majlis may, at any time, revoke the appointment of any member of the Wakaf Committee appointed under paragraphs 3(1)(a) and (g).

(2)

The member of the Wakaf Committee appointed under paragraphs 3(1)(a)

and (g) may, at any time, tender his resignation by giving a written notice to the Secretary of the Majlis.

A member of the Wakaf Committee appointed under paragraphs 3(1)(a)

and (g) shall be deemed to have vacated his office if—

(b)

there has been proved against him, or he has been convicted on, a charge in respect of a criminal offence;

he is of unsound mind or is otherwise incapable of discharging his duties.

Effect of revocation, resignation and vacation of office 6.

A member appointed under paragraphs 3(1)(a) and (g) shall cease to be a member of the Wakaf Committee if his appointment is revoked, the member has tender his resignation or is deemed to have vacated his office, and the Majlis may appoint another person to fill the vacancy for the remaining term of the member who has vacated the office.

Meetings of Wakaf Committee 7.

(1)

All meetings of the Wakaf Committee shall be summoned by the Secretary of the Wakaf Committee on the direction of the Chairman by serving a written notice to the members of the Wakaf Committee at least five working days before the meeting.

(2)

Notwithstanding subrule (1), the Chairman may, if he considers that there is an urgent need, summon a meeting at a shorter notice.

(3)

If the Chairman is absent from any meeting, the members present shall elect one of them to preside over the meeting and the member may exercise all the powers of the Chairman in relation to that meeting.

(4)

The Wakaf Committee shall meet at least four times in a year.

Six members of the Wakaf Committee present shall form a quorum at any meeting of the Wakaf Committee.

(6)

All decisions of the meeting of the Wakaf Committee shall be made by a consensus or by a resolution of the majority of the members present and entitled to vote, and if there is an equality of votes, the chairman of the meeting shall have a casting vote.

(7)

The Chairman may invite any person who is not a member of the

Wakaf Committee to attend any meeting or deliberation of the Wakaf Committee for the purpose of advising the Wakaf Committee on any matter under discussion but that person shall not be entitled to vote at the meeting or deliberation.

All decisions made by the meeting of the Wakaf Committee shall be reported to the Majlis.

Minutes 8.

Suggest a correction

(1)

All minutes of the meeting of the Wakaf Committee shall be maintained and kept by the Secretary of the Wakaf Committee.

(2)

Any minutes of the meeting of the Wakaf Committee which has been duly signed by the Chairman and Secretary of the Wakaf Committee shall be admissible in any proceedings as a prima facie evidence of the facts stated in the minutes without further proof.

CHIEF REGISTRAR OF WAKAF AND REGISTRAR OF WAKAF

Chief Registrar of Wakaf and Registrar of Wakaf 9.

(1)

The Secretary of the Majlis shall be the Chief Registrar of Wakaf.

The Majlis may appoint such numbers of Registrar of Wakaf as the Majlis deems necessary to assist the Chief Registrar of Wakaf in carrying out the functions and exercising the powers of the Majlis under these Rules.

Subject to the direction and control of the Chief Registrar of Wakaf, a Registrar of Wakaf may exercise any power of the Chief Registrar of Wakaf under these Rules.

Responsibilities of Chief Registrar of Wakaf 10.

The Chief Registrar of Wakaf shall be responsible to—

keep and maintain a register of all mawquf in any form or manner as determined by the Majlis;

keep and hold all instruments, documents of tittle or other documents relating to any mawquf;

maintain data and information related to mawquf, mutawalli and qayyim; and

(e)

perform such duties as directed by the Wakaf Committee.

(1)

The Chief Registrar of Wakaf shall keep and maintain a Register of Wakaf.

For the purposes of subrule (1), a Register of Wakaf shall contain the following information:

(a)

details of mawquf which the Majlis is the sole trustee or mawquf ‘alaih;

any other details relating to the wakaf as deemed necessary or expedient by the Chief Registrar of Wakaf.

Registration of wakaf 12.

(1)

A person who wishes to surrender his property as a wakaf may apply for a registration of wakaf to the Wakaf Committee in such manner as may be determined by the Wakaf Committee.

The Wakaf Committee may determine the types of property that are not required to be registered as wakaf.

(3)

If the Wakaf Committee is satisfied that the registration under subrule (1)

has complied with the rukun and conditions of wakaf under these Rules, the

Committee may approve the application and direct the

Chief Registrar of Wakaf to register the wakaf in the Register of Wakaf.

The Wakaf Committee may cause a wakaf to be registered in the Register of Wakaf.

PART IV

APPOINTMENT OF MUTAWALLI, QAYYIM AND ADMINISTRATOR

Mutawalli and qayyim 13.

(1)

No person may collect, receive, manage, administer or develop mawquf, or distribute the benefit of the mawquf, on behalf of the Majlis in the Federal Territories unless he is appointed as a mutawalli or qayyim, as the case may be, by the Wakaf Committe.

Any mutawalli or qayyim intending to distribute any mawquf outside the Federal Territories shall obtain prior written permission of the Wakaf Committee.

Any company, firm, organization, society or other body of person is eligible to apply to be appointed as a mutawalli or qayyim if the company, firm, organization, society or other body of person is registered in Malaysia and carries on activity or business which is not contrary to the Islamic Law and the application shall be made to the Wakaf Committe in such manner as may be determined by the Wakaf Committee.

The Wakaf Committe may, at any time, revoke the appointment of the mutawalli or qayyim.

Responsibilities of mutawalli and qayyim 14.

Mutawalli shall be responsible to perform all of the following functions:

Mutawalli may create any wakaf product with the approval of the Wakaf Committee.

Qayyim shall be responsible to perform any one or two functions as follows:

Mutawalli and qayyim shall report all activities carried out to the Wakaf Commitee.

Administrator 15.

A waqif may, with the approval of the Wakaf Commitee, appoint any person as administrator to manage his mawquf.

A person is qualified to be administrator if—

(b)

in the case of a company, firm, organization, society or other body of person, it is registered in Malaysia and carries on activity or business which is not contrary to the Islamic Law.

A waqif may, with the approval of the Wakaf Commitee, at any time, revoke the appointment of administrator.

PART V

RUKUN AND CONDITIONS OF WAKAF

The rukun of wakaf are as follows:

A waqif shall fulfil the following conditions:

in the case of a company, firm, organization, society or other body of person—

it is incorporated, established or registered in Malaysia or outside Malaysia;

(ii)

it has not been dissolved or its registration has not been cancelled or revoked, as the case may be; and

it does not carry on activity or business which is contrary to the Islamic Law.

A mawquf shall be a property which—

(b)

is transferable or assignable without any encumbrances; and

(c)

capable of yielding any benefit, usufruct or interest to the mawquf ‘alaih at the time the wakaf is created or in future.

(2)

For the purposes of paragraph (1)(a), the property shall be deemed to be fully owned by the waqif, if the waqif is legally permitted to carry out any transaction or dealing in respect of the property.

Conditions of mawquf ‘alaih 19.

(1)

In the case of wakaf ‘am, any person is qualified to be mawquf ‘alaih for a mawquf.

(2)

In the case of wakaf khas, the mawquf ‘alaih shall satisfy the specific conditions stipulated by the waqif.

In the case of wakaf khas—

(a)

where there are more than one mawquf ‘alaih for the wakaf khas and the waqif does not determine their respective share in the benefit, usufruct or interest of the mawquf, the benefit, usufruct or interest shall be distributed by the Majlis to the mawquf ‘alaih; or

where the mawquf ‘alaih is a beneficiary of zakat, the benefit, usufruct or interest of the mawquf shall be distributed by the Majlis in line with the intention of the waqif.

Conditions of sighah 20.

The sighah of wakaf may be made whether orally, in writing or by way of sign before two witnesses in accordance with the Islamic Law.

Commencement of wakaf 21.

(1)

Subject to subrule 26(1), a wakaf shall come into effect once all the rukun and conditions of wakaf have been fulfilled.

Where a wakaf has come into operation, a mawquf shall not be sold, charged, transferred or given as hibah, revoked by the waqif or inherited as estate.

For a wakaf muaqqat, the prohibition under subrule (2) shall apply during the period of wakaf determined by the waqif.

A wakaf is invalid if the wakaf is made—

(b)

for the sole benefit, usufruct or self-interest; or

PART VI

METHODS OF WAKAF

Wakaf muabbad 23.

A waqif may create a wakaf muabbad for his property perpetually.

Wakaf muaqqat 24.

A waqif may create a wakaf muaqqat for his property temporarily in accordance with Islamic Law.

Wakaf by way of ta’liq 25.

(1)

A waqif may create a wakaf by way of ta’liq which shall come into effect upon the occurrence of the conditions as stipulated by the waqif during his lifetime provided that such conditions is not contrary to the Islamic Law.

A wakaf by way of ta’liq is not valid if the waqif dies prior to the conditions stipulated in the ta’liq is fulfilled.

Where a waqif creates a wakaf by way of ta’liq to his heir to be executed after his death, such wakaf shall be subject to the consent of all heirs after the death of the waqif.

In the event of a waqif creates a wakaf by way of ta’liq to a non-heir to be executed after his death, the wakaf shall not exceed one-third of the property of the waqif after deducting the debt and any liability in accordance with the Islamic Law unless with the consent of all heirs.

A waqif may create a wakaf by way of will and appoint wasi to perform or execute such wakaf by way of will after his death.

The wasi shall be appointed by the waqif from among the Muslim, a body or a company that is permissible by Islamic Law and the wasi shall execute the wakaf after the death of the waqif.

If there is no wasi appointed by the waqif, any interested person may apply to the Court for the appointment of wasi.

Wakaf by way of will to an heir shall be subject to the consent of all heirs.

(5)

Wakaf by way of will to the non-heir shall not exceed one-third of the property of the waqif after deducting the debt and any liability in accordance with the Islamic Law unless with the consent of all heirs.

(6)

Where the waqif surrenders his property as a wakaf to his heir under subrule (4) or to his non-heir which exceeds one-third of his property under subrule (5), the wasi shall, after the death of the waqif, obtain the consent of all heirs for the purpose of executing the wakaf by way of will.

If the wasi fails to execute the wakaf by way of will after the death of the waqif, any interested person may apply to the Court for an order against the wasi for the execution of such wakaf by way of will.

Upon receiving the order of the execution referred to in subrule (7), the wasi shall execute the wakaf in accordance with the will.

For the purposes of this rule—

(a)

“interested person” means any person who has interest on a mawquf by way of will;

Heir and non-heir as mawquf ‘alaih 27.

(1)

A waqif may nominate his heir or non-heir as a mawquf ‘alaih.

In the case of heir as a mawquf ‘alaih, if the waqif surrenders his property as a mawquf in the state of death-bed, the wakaf is valid subject to the consent of all heirs in accordance with Islamic Law.

In the case of non-heir as a mawquf ‘alaih, if the waqif surrenders more than one-third of his property as a mawquf, the wakaf is valid subject to the consent of all heirs in accordance with the Islamic Law.

Cash wakaf 28.

(1)

The Majlis, mutawalli and qayyim may accept cash wakaf from any person, organization or institution for the purposes of wakaf ‘am or wakaf khas.

For the purposes of this rule, “cash wakaf” means surrender of any cash, gold value, proceed value or those similar thereto by any person for any purposes of wakaf ‘am or wakaf khas.

Wakaf product or scheme 29.

The Wakaf Committe may establish any wakaf product or wakaf scheme, or approve any person to establish any wakaf product or wakaf scheme subject to any condition determined by the Wakaf Committe.

Development of mawquf 30.

Any mawquf registered in the Register of Wakaf may be developed or maintained by utilising the following sources:

(b)

the Baitulmal subject to the approval of the Majlis; or

other sources in accordance with the Islamic Law.

Istibdal 31.

(1)

Subject to the ruling of the Islamic Legal Consultative Commitee and the approval of the Majlis, the Wakaf Commitee may execute any istibdal, either partly or wholly in the following circumstances:

(a)

if any condition of the wakaf is inconsistent with any written law;

if the mawquf is taken by any authority in accordance with any written law;

(c)

if the usage of mawquf fails to provide benefit, usufruct or interest as intended by the waqif;

(d)

if the usage of mawquf fails to fulfil the purpose or conditions stipulated by the waqif;

if the Majlis needs to execute istibdal for a mosque or site of a mosque which is a mawquf;

if any of the conditions stipulated by the waqif cannot be executed and the Majlis intends to execute the wakaf in the manner as closely as maybe possible with the conditions stipulated by the waqif; or

(g)

other circumstances as the Wakaf Commitee deems necessary.

The value of the mawquf acquired by way of istibdal shall not be less than the current value of the original mawquf.

The Majlis shall execute istibdal of any mawquf whether wholly or partly within a reasonable period.

Where it relates to immovable property evidenced by document of title issued under the National Land Code [Act 828] or any other laws for the time being in force, the Registrar, after receiving a written application from the Majlis on the existence of wakaf by way of istibdal shall, give effect to the vesting or transfer of the immovable property upon the Majlis as the sole trustee, and if relevant, the word “wakaf”

shall be endorsed in such document of title.

For the purposes of execution of istibdal relating to any immovable property, the National Land Code shall apply.

For the purposes of this rule, “Registrar” has the same meaning assigned to it under the National Land Code.

Right of waqif to enjoy benefit, usufruct or interest of mawquf 32.

A waqif who creates a wakaf for general benevolent are entitled to enjoy the usufruct, benefit or interest of the mawquf.

Majlis as mawquf ‘alaih 33.

The Majlis may become mawquf ‘alaih for any mawquf situated within or outside the Federal Territories.

Mawquf for abandoned wakaf khas 34.

The Wakaf Committee may, after referring to the Islamic Legal Consultative

Committee, manage and develop the mawquf for wakaf khas which is abandoned in any manner as it deems fit.

WAKAF FUND IN BAITULMAL

Expenditure to be charged on wakaf fund 35.

The wakaf fund shall be expended in accordance with the Islamic Law for the purpose of—

(a)

paying all costs, charges and expenditure for administration of any wakaf including the cost for maintenance and repair of any mawquf;

funding the development of any wakaf and execute the purposes of any wakaf subject to any terms and conditions as the Majlis deems fit;

paying for the management expenditure including allowances for the members of the Wakaf Committee;

OFFENCES AND PENALTY

Collecting, managing or distributing wakaf ‘am or wakaf khas without permission of Wakaf Committee 37.

Any person who collects, manages or distributes wakaf ‘am or wakaf khas without the written permission of the Wakaf Commitee commits an offence and shall, on conviction, be liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both, and the Court shall order such collection to be confiscated and paid into the wakaf fund.
