Section 138
Unlawful removal from mining land
Except as otherwise authorized under any other written law, any person who removes beyond the boundaries of the mining land for any purpose—
(a)
any timber or other forest produce;
(b)
any plant, vegetable, animal, poultry or fish; or
(c)
any coral, earth, gravel, guano, loam, rock, sand, shell, clay, brick, lime, cement or other commodity manufactured from such minerals, obtained from or on the mining land, shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding three years or to both, and be ordered to pay to the Authority the value of the thing removed and any sum ordered to be so paid shall be recoverable as if it were a fine so imposed.
