Section 83
Application for water permit

(1)
An application for a water permit shall be made by the holder of a mineral tenement to the State Water Authority in the prescribed form.
(2)
The term of a water permit—
(a)
shall not exceed one year but may, upon application made in the prescribed form, be renewable at the discretion of the
State Water Authority and upon renewal thereof it—
(i)
may impose such terms and conditions as it deems fit; and
(ii)
shall endorse on the permit the particulars of such renewal; and

(b)
shall not exceed the expiry date of the mineral tenement for which the water is to be used.
(3)
A water permit, which shall be in Form G of the Schedule, shall authorize the holder thereof to divert, make use of and discharge such water as is therein specified, in such places by such means, in such manner, in such quantities and on such conditions as the State
Water Authority may think fit.
(4)
A water permit shall not authorize the holder thereof to construct any works—
(a)
upon alienated land or occupied land except with the written permission of the owner thereof; or
(b)
upon reserved land except with the written consent of the public officer for the time being having the control thereof.
