Section 25

of PROTECTION OF WILD LIFE ACT 1972

Section 25

On an application made by a Game-Warden, a Magistrate shall make an order for forfeiture, in respect of the following which is seized notwithstanding that no person is charged or convicted of an offence under this Act:

(a)

any jerat, spring gun or drop spear;

(b)

any firearm (licensed or unlicensed) or any other weapon, poison/or poisoned bait which is—

(i)

used for shooting killing or taking a totally protected wild animal or a totally protected wild bird; or

(ii)

found in the possession of a person who is found in a wild life reserve or in a wild life sanctuary without the written permission of the Game-Warden; or

(c)

any wild animal or wild bird which is—

(i)

shot killed or taken or housed confined or bred in contravention of the provisions of this Act; or

(ii)

the subject matter of an offence relating to cruelty to wild life.
