Pengawalseliaan Sekolah Agama Islam) 2025.
Kaedah-Kaedah ini hendaklah terpakai bagi Wilayah-Wilayah Persekutuan
Kuala Lumpur, Labuan dan Putrajaya.
Dalam Kaedah-Kaedah ini, melainkan jika konteksnya menghendaki makna yang lain—
“Jemaah Pengurusan” ertinya Jemaah Pengurusan Sekolah Agama Islam yang ditubuhkan di bawah subkaedah 19(2);
“Jawatankuasa” ertinya Jawatankuasa Sekolah Agama Islam yang ditubuhkan di bawah kaedah 3;

“Nazir Sekolah” ertinya nazir sekolah agama Islam yang dilantik di bawah subkaedah 14(1);
“Pendaftar” ertinya Ketua Pendaftar sekolah agama Islam dan termasuklah
Pendaftar dan Penolong Pendaftar sekolah agama Islam yang dilantik di bawah kaedah 11;
“Pengerusi” ertinya Pengerusi Jawatankuasa Sekolah Agama Islam yang dilantik di bawah perenggan 5(1)(a);
“prasekolah agama Islam” ertinya sekolah agama Islam yang menyediakan program pendidikan prasekolah agama Islam bagi murid yang berumur dari empat hingga enam tahun;
“perakuan pendaftaran” ertinya perakuan pendaftaran sekolah agama Islam yang dikeluarkan di bawah perenggan 24(5)(a);
“sekolah agama Islam” ertinya mana-mana tempat yang digunakan bagi menjalankan aktiviti pengajaran dan pembelajaran agama Islam yang mempunyai sekurang-kurangnya sepuluh orang murid pada peringkat prasekolah, sekolah rendah atau sekolah menengah agama Islam yang ditubuhkan oleh mana-mana orang,
Majlis atau Jabatan Agama Islam Wilayah Persekutuan yang termasuklah institusi pondok, tahfiz al-Quran, pengajian agama atau pengajian hadis tetapi tidak termasuk mana-mana institusi pendidikan yang disebut dalam perenggan 16(a) dan (b)
Akta Pendidikan 1996 [Akta 550];
“sekolah menengah agama Islam” ertinya sekolah agama Islam yang menyediakan program pendidikan menengah agama Islam yang bersesuaian bagi murid yang sudah tamat pendidikan rendah agama Islam atau pendidikan rendah di bawah
Akta Pendidikan 1996;

“sekolah rendah agama Islam” ertinya sekolah agama Islam yang menyediakan program pendidikan rendah agama Islam bagi murid yang berumur dari enam tahun;
“surat cara pengurusan” ertinya surat cara pengurusan sekolah agama Islam yang dinyatakan di bawah subkaedah 19(1).
Bahagian II
Penubuhan Jawatankuasa
Majlis hendaklah menubuhkan suatu jawatankuasa yang dikenali sebagai
“Jawatankuasa Sekolah Agama Islam”.
Fungsi Jawatankuasa
Fungsi Jawatankuasa adalah seperti yang berikut:
untuk menimbang, meluluskan atau menolak suatu permohonan bagi pendaftaran sekolah agama Islam;
untuk merangka, membangunkan, menilai dan meminda kurikulum dan kokurikulum sekolah agama Islam selaras dengan ketetapan Majlis;
untuk melaporkan hal ehwal sekolah agama Islam kepada Majlis sekurang-kurangnya sekali dalam masa enam bulan;
untuk melaporkan apa-apa tindakan yang diambil terhadap sekolah agama Islam kepada Majlis mengenai pendaftaran dan pembatalan pendaftaran bagi sekolah agama Islam;
untuk menambah, meminda atau membatalkan mana-mana syarat yang dikenakan dalam perakuan pendaftaran;

untuk membatalkan pendaftaran mana-mana sekolah agama Islam mengikut kaedah 34 atau atas permohonan Jemaah Pengurusan;
dan
untuk melakukan segala perkara yang perlu atau suai manfaat untuk atau yang berkaitan dengan pelaksanaan fungsinya di bawah Kaedah-Kaedah ini.
Walau apa pun perenggan (1)(b), Jawatankuasa boleh mendapatkan nasihat daripada Jawatankuasa Penyelarasan Pendidikan Islam Kebangsaan yang ditubuhkan oleh Majlis Kebangsaan Bagi Hal Ehwal Agama Islam Malaysia mengenai apa-apa perkara yang berhubungan dengan sekolah agama Islam termasuk kurikulum dan kokurikulum, buku teks, peperiksaan, pensijilan dan latihan guru.
Keanggotaan Jawatankuasa
Jawatankuasa hendaklah terdiri daripada—
seorang pegawai Jabatan Agama Islam Wilayah Persekutuan yang dinamakan oleh
Pengarah
Jabatan
Agama
Islam
Wilayah Persekutuan;
seorang pegawai Jabatan Kemajuan Islam Malaysia yang dinamakan oleh Ketua Pengarah Jabatan Kemajuan Islam Malaysia;

tiga orang anggota lain yang mempunyai pengalaman, pengetahuan dan kepakaran yang berkaitan dalam orang yang beragama Islam yang hendaklah dilantik oleh Majlis.
Anggota yang dilantik di bawah perenggan (1)(a) dan (h) hendaklah dilantik selama tempoh tidak melebihi tiga tahun dan layak untuk dilantik semula.
Setiausaha
Majlis boleh melantik seorang pegawai hal ehwal Islam yang kanan di Jabatan Agama Islam Wilayah Persekutuan sebagai Setiausaha kepada Jawatankuasa.
Setiausaha hendaklah bertanggungjawab bagi menjalankan dasar, arahan dan keputusan Jawatankuasa.
Setiausaha berhak menghadiri semua mesyuarat Jawatankuasa dan mengambil bahagian dalam pertimbangtelitiannya tetapi tidak layak untuk mengundi.
Pembatalan dan peletakan jawatan
Majlis boleh, secara bertulis, membatalkan pelantikan mana-mana anggota Jawatankuasa yang dilantik di bawah perenggan 5(1)(a) dan (h).
Anggota Jawatankuasa yang dilantik di bawah perenggan 5(1)(a) dan (h)
boleh meletakkan jawatan melalui suatu notis bertulis kepada Pengerusi Majlis.
Pengosongan jawatan
Seseorang anggota
Jawatankuasa yang dilantik di bawah perenggan 5(1)(a) dan (h) hendaklah disifatkan telah mengosongkan jawatannya jika—
dia menjadi tidak sempurna akal atau selainnya tidak berupaya untuk menunaikan kewajipannya.
Jika seseorang anggota yang dilantik di bawah perenggan 5(1)(a) dan (h)
terhenti menjadi anggota Jawatankuasa oleh sebab mana-mana peruntukan
Kaedah-Kaedah ini, Majlis boleh melantik seorang yang lain untuk mengisi kekosongan itu bagi tempoh berbaki bagi anggota yang mengosongkan jawatan itu.
Mesyuarat Jawatankuasa
Semua mesyuarat Jawatankuasa hendaklah dipanggil oleh Setiausaha atas arahan Pengerusi melalui notis bertulis kepada anggota Jawatankuasa yang disampaikan sekurang-kurangnya tujuh hari sebelum mesyuarat.
Walau apa pun subkaedah (1), Pengerusi boleh, jika dia mengganggap bahawa terdapat keperluan mendesak, memanggil mesyuarat dengan notis yang lebih singkat.
Pengerusi, atau pada masa ketiadaannya, Timbalan Pengerusi hendaklah mempengerusikan semua mesyuarat Jawatankuasa.
Jawatankuasa hendaklah mengadakan mesyuarat sekurang-kurangnya sekali bagi tiap-tiap enam bulan.
Pengerusi mesyuarat dan empat anggota Jawatankuasa lain yang hadir hendaklah membentuk kuorum dalam mana-mana mesyuarat Jawatankuasa.
Semua keputusan mesyuarat Jawatankuasa hendaklah dibuat secara persetujuan atau melalui ketetapan majoriti anggota yang hadir dan berhak mengundi dan jika terdapat persamaan undi, Pengerusi atau Timbalan Pengerusi yang mempengerusikan mesyuarat itu hendaklah mempunyai undi pemutus.

Walau apa pun subkaedah (4), Pengerusi boleh, mengarahkan Setiausaha memanggil mesyuarat.
Pengerusi boleh mengundang mana-mana orang yang bukan anggota
Jawatankuasa untuk menghadiri mana-mana mesyuarat atau pertimbangtelitian
Jawatankuasa bagi menasihati Jawatankuasa mengenai apa-apa perkara yang sedang dibincangkan tetapi orang itu tidak berhak mengundi dalam mesyuarat itu.
Elaun
Anggota Jawatankuasa boleh dibayar apa-apa elaun yang ditentukan oleh Majlis.
Bahagian III
Pelantikan Ketua Pendaftar, Pendaftar dan Penolong Pendaftar
Setiausaha yang dilantik di bawah subkaedah 6(1) hendaklah menjadi
Ketua Pendaftar.
Majlis boleh melantik apa-apa bilangan Pendaftar dan Penolong Pendaftar dalam kalangan orang yang berkhidmat dalam perkhidmatan Hal Ehwal Islam atau perkhidmatan pendidikan di Jabatan Agama Islam Wilayah Persekutuan atas apa-apa terma dan syarat yang ditentukan oleh Majlis.
Tertakluk kepada arahan dan kawalan Ketua Pendaftar dan apa-apa syarat atau sekatan yang dikenakan oleh Ketua Pendaftar, seseorang Pendaftar atau
Penolong Pendaftar boleh menjalankan apa-apa kuasa Ketua Pendaftar di bawah
Kaedah-Kaedah ini.
Tanggungjawab Pendaftar
Pendaftar hendaklah bertanggungjawab untuk perkara seperti yang berikut:

untuk mendaftarkan suatu sekolah agama Islam jika permohonan bagi pendaftarannya telah diluluskan di bawah kaedah 24;
untuk memastikan bahawa semua sekolah agama
Islam di Wilayah-Wilayah Persekutuan ditadbir dengan sepatutnya;
untuk mengesyorkan apa-apa tindakan yang sesuai diambil terhadap sekolah agama Islam yang melanggar Kaedah-Kaedah ini kepada Jawatankuasa;
untuk mengemukakan laporan bertulis mengenai hal ehwal sekolah agama Islam di Wilayah-Wilayah Persekutuan kepada
Jawatankuasa sekurang-kurangnya sekali dalam tiap-tiap enam bulan;
untuk menasihati atau mengesyorkan apa-apa tindakan yang boleh diambil oleh sekolah agama Islam berdasarkan laporan yang dikemukakan oleh Nazir Sekolah; dan
untuk melaksanakan apa-apa kewajipan yang diarahkan oleh
Jawatankuasa dari semasa ke semasa.
Pendaftar hendaklah bertindak di bawah arahan dan kawalan Jawatankuasa.
Daftar Sekolah Agama Islam
Pendaftar hendaklah menyimpan dan menyenggara suatu
Daftar Sekolah Agama Islam.

Sekolah
Agama
Islam hendaklah mengandungi—

nama, nombor telefon, jenis sekolah, tarikh pendaftaran dan alamat sekolah agama Islam;
apa-apa maklumat lain yang difikirkan perlu oleh Pendaftar untuk direkodkan.
Pelantikan Nazir Sekolah
Majlis boleh, atas syor Jawatankuasa, melantik apa-apa bilangan
Nazir Sekolah yang perlu dalam kalangan orang yang berkhidmat dalam—
Seseorang Nazir Sekolah yang dilantik di bawah subkaedah (1) hendaklah tertakluk kepada arahan dan kawalan Pendaftar.
Tanggungjawab Nazir Sekolah
Nazir Sekolah hendaklah bertanggungjawab seperti yang berikut:
untuk memeriksa sekolah agama Islam berhubung dengan penggunaan kurikulum yang diluluskan oleh Majlis, kualiti pengajaran dan pembelajaran, penggunaan buku-buku teks, guru-guru dan pematuhan
Kaedah-Kaedah ini atau apa-apa perkara yang diarahkan oleh Pendaftar;
untuk mengemukakan laporan pemeriksaan sekolah agama Islam termasuk untuk mengesyorkan apa-apa tindakan yang sesuai untuk diambil terhadap sekolah itu kepada
Pendaftar dalam masa dua puluh satu hari bekerja selepas pemeriksaan itu.
Kuasa untuk memeriksa

Pendaftar, Nazir Sekolah atau mana-mana orang yang diberi kuasa oleh Majlis boleh memeriksa mana-mana sekolah agama Islam sama ada yang berdaftar atau tidak berdaftar di bawah Kaedah-Kaedah ini.
Pemeriksaan sekolah agama Islam yang berdaftar
Pendaftar, Nazir Sekolah atau mana-mana orang yang diberi kuasa oleh
Majlis semasa menjalankan suatu pemeriksaan di bawah perenggan 15(a) dan kaedah 16, boleh memasuki mana-mana bahagian premis dan memeriksa apa-apa buku, dokumen, bahan media elektronik atau barang lain yang difikirkan perlu olehnya.
Pendaftar, Nazir Sekolah atau mana-mana orang yang diberi kuasa oleh
Majlis, dalam menjalankan pemeriksaan di bawah subkaedah (1), boleh diiringi oleh mana-mana orang lain yang difikirkan perlu olehnya.
Mana-mana orang yang ada dalam milikan atau kawalannya apa-apa buku, dokumen, bahan media elektronik atau barang lain yang berhubungan dengan pengurusan atau pengajaran yang dijalankan di sekolah agama Islam hendaklah mengemukakan buku, dokumen, bahan media elektronik atau barang lain itu bagi pemeriksaan apabila diminta oleh Pendaftar, Nazir Sekolah atau mana-mana orang yang diberi kuasa oleh Majlis.

Walau apa pun subkaedah (3), Pendaftar boleh menyita, memindahkan atau menahan apa-apa buku, dokumen, bahan media elektronik atau barang lain yang pada pendapatnya memudaratkan kepentingan awam atau murid atau yang boleh menjadi keterangan pelakuan suatu kesalahan di bawah Kaedah-Kaedah ini atau
Akta Kesalahan Jenayah Syariah (Wilayah-Wilayah Persekutuan) 1997 [Akta 559].
Pemeriksaan sekolah agama Islam yang tidak berdaftar
Jika Pendaftar atau Pegawai Penguat Kuasa Agama mempunyai sebab yang munasabah untuk mempercayai bahawa mana-mana premis sedang digunakan sebagai sekolah agama Islam tanpa didaftarkan di bawah Kaedah-Kaedah ini, Pendaftar atau
Pegawai Penguat Kuasa Agama itu boleh memasuki dan memeriksa premis itu.
Pendaftar atau Pegawai Penguat Kuasa Agama, dalam menjalankan pemeriksaan di bawah subkaedah (1), boleh disertai oleh mana-mana orang lain yang difikirkan perlu olehnya.
Pendaftar atau Pegawai Penguat Kuasa Agama boleh menyita dan menahan apa-apa buku, dokumen, bahan media elektronik atau barang lain yang terdapat di dalam premis itu yang didapatinya boleh menjadi keterangan pelakuan suatu kesalahan terhadap Kaedah-Kaedah ini atau yang didapatinya adalah harta, atau telah digunakan berkaitan dengan, sesuatu sekolah agama Islam yang tidak didaftarkan di bawah
Kaedah-Kaedah ini.
Bahagian IV
Jemaah Pengurusan
Tiap-tiap sekolah agama Islam hendaklah mempunyai surat cara pengurusan sebagaimana yang ditentukan oleh Jawatankuasa.
Tiap-tiap surat cara pengurusan hendaklah mengadakan peruntukan bagi penubuhan suatu Jemaah Pengurusan sekolah agama Islam yang hendaklah bertanggungjawab bagi pengurusan sekolah agama Islam itu.

Jawatankuasa boleh, atas permohonan secara bertulis oleh
Jemaah Pengurusan, meminda surat cara pengurusan.
Kaedah ini tidak terpakai bagi sekolah agama Islam yang ditubuhkan oleh
Majlis atau Jabatan Agama Islam Wilayah Persekutuan.
Keanggotaan Jemaah Pengurusan
Tiap-tiap Jemaah Pengurusan hendaklah terdiri daripada sekurang-kurangnya lima orang dan tidak lebih daripada sebelas orang yang hendaklah memegang apa-apa jawatan sebagaimana yang perlu bagi sekolah agama Islam itu.
Kelayakan anggota Jemaah Pengurusan
Seseorang itu layak menjadi anggota Jemaah Pengurusan jika dia—
tidak pernah disabitkan dan dihukum dengan apa-apa kesalahan jenayah oleh mana-mana mahkamah; dan
Walau apa pun perenggan (1)(b), Jawatankuasa boleh membenarkan seorang bukan warganegara Malaysia untuk dilantik sebagai anggota Jemaah Pengurusan jika ia berpuas hati bahawa terdapat hal keadaan khas dan ia tidak berlawanan dengan kepentingan awam atau mana-mana undang-undang yang berkuat kuasa untuk berbuat demikian.

Tanggungjawab Jemaah Pengurusan
Jemaah Pengurusan hendaklah bertanggungjawab bagi pengurusan, pentadbiran dan kewangan sekolah agama Islam.
Jemaah Pengurusan hendaklah—
mentadbir dan menyenggara sekolah agama Islam mengikut surat cara pengurusannya;
butir-butir guru dan kakitangan sekolah agama Islam;
yuran pengajian sekolah agama Islam; dan
Jemaah Pengurusan boleh melantik apa-apa bilangan guru dan kakitangan yang perlu bagi maksud kaedah ini.
Walau apa pun subkaedah (3), pelantikan guru dan kakitangan sekolah agama Islam yang ditubuhkan oleh Majlis atau Jabatan Agama Islam
Wilayah
Persekutuan hendaklah masing-masing dibuat oleh
Majlis atau
Jabatan Agama Islam Wilayah Persekutuan.

Bahagian V
Tiap-tiap sekolah agama
Islam hendaklah didaftarkan di bawah
Kaedah-Kaedah ini.
Permohonan bagi pendaftaran
Jemaah Pengurusan hendaklah memohon bagi pendaftaran sekolah agama Islam kepada Jawatankuasa mengikut cara sebagaimana yang boleh ditentukan oleh Jawatankuasa.
Tiap-tiap permohonan bagi pendaftaran hendaklah disertakan dengan—
kelulusan atau dokumen sokongan daripada pihak berkuasa tempatan bahawa premis sekolah agama Islam itu boleh digunakan sebagai suatu sekolah;
kelulusan atau dokumen sokongan daripada pihak berkuasa yang berkenaan bahawa premis sekolah agama Islam itu telah memenuhi piawaian kesihatan dan keselamatan yang ditetapkan;
Permohonan di bawah subkaedah (1) hendaklah disertakan dengan fi sebagaimana yang dinyatakan dalam Jadual.

Jawatankuasa hendaklah setelah menerima permohonan, mengarahkan
Pendaftar memeriksa premis sekolah agama Islam itu untuk memastikan sama ada atau tidak premis itu mempunyai keperluan dan kemudahan asas yang mencukupi sebagai suatu sekolah dan Pendaftar hendaklah mengemukakan dapatannya kepada Jawatankuasa.
Selepas mempertimbangkan permohonan itu, Jawatankuasa boleh—
meluluskan permohonan itu, dengan atau tanpa syarat, dan mengeluarkan perakuan pendaftaran sekolah agama Islam itu kepada pemohon mengikut cara sebagaimana yang boleh ditentukan oleh Jawatankuasa selepas fi pendaftaran sebagaimana yang dinyatakan dalam Jadual dibayar; atau
menolak permohonan itu dan menyatakan alasan penolakan itu kepada pemohon secara bertulis.
Mana-mana sekolah agama islam yang tidak mematuhi kaedah 23
melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya, dan dalam hal kesalahan yang berterusan, didenda selanjutnya tidak melebihi satu ratus ringgit bagi setiap hari selama kesalahan itu berterusan selepas disabitkan.
Dokumen atau maklumat tambahan
Pendaftar boleh, selepas menerima suatu permohonan di bawah subkaedah 24(2), meminta pemohon untuk memberi Pendaftar, dalam tempoh yang dinyatakan dalam permintaan itu, apa-apa dokumen atau maklumat tambahan mengenai permohonan itu.
Jika dokumen atau maklumat tambahan yang dikehendaki di bawah subkaedah (1) tidak diberikan oleh pemohon dalam tempoh yang dinyatakan dalam permintaan atau dalam apa-apa pelanjutan masa yang diberikan oleh Pendaftar,

permohonan itu hendaklah disifatkan telah ditarik balik dan tidak lagi boleh diteruskan, tetapi tanpa menjejaskan hak pemohon itu untuk membuat suatu permohonan baharu.
Tempoh kesahan perakuan pendaftaran
Perakuan pendaftaran adalah sah bagi tempoh lima tahun dari tarikh perakuan pendaftaran itu dikeluarkan melainkan jika pendaftaran sekolah agama Islam itu dibatalkan di bawah kaedah 34 atau pentadbiran sekolah agama Islam diambil alih oleh
Majlis di bawah kaedah 44.
Pembaharuan perakuan pendaftaran
Jemaah Pengurusan boleh memohon untuk membaharui perakuan pendaftaran tidak kurang daripada tiga bulan sebelum habis tempohnya mengikut cara sebagaimana yang boleh ditentukan oleh Jawatankuasa.
Permohonan di bawah subkaedah (1) adalah tertakluk kepada apa-apa bayaran fi yang dinyatakan dalam Jadual dan hendaklah disertakan dengan dokumen dan maklumat sebagaimana yang boleh dikehendaki oleh Jawatankuasa.
Selepas mempertimbangkan permohanan itu, Jawatankuasa boleh—
membaharui pendaftaran, dengan atau tanpa syarat, selepas fi pembaharuan sebagaimana yang dinyatakan dalam Jadual dibayar;
atau
menolak untuk membaharui pendaftaran dan menyatakan alasan penolakan itu kepada pemohon secara bertulis.
Jika permohonan bagi pembaharuan itu dibuat selepas tempoh yang dinyatakan dalam subkaedah (1) tetapi sebelum tarikh habis tempoh perakuan, pemohon hendaklah membayar fi bagi pembaharuan lewat sebagaimana yang dinyatakan dalam Jadual.

Pempameran perakuan pendaftaran
Jemaah Pengurusan hendaklah mempamerkan atau menyebabkan dipamerkan perakuan pendaftaran di tempat yang mudah dilihat di premis sekolah agama Islam dan hendaklah mengemukakan perakuan pendaftaran itu apabila diminta bagi pemeriksaan.
Mana-mana anggota Jemaah Pengurusan yang melanggar subkaedah (1)
melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu ribu ringgit atau dipenjarakan selama tempoh tidak melebihi enam bulan atau kedua-duanya, dan dalam hal kesalahan kedua atau yang berterusan, didenda tidak melebihi dua ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.
Penggantian perakuan pendaftaran
Jika perakuan pendaftaran hilang atau rosak, Jemaah Pengurusan hendaklah memohon kepada Pendaftar bagi suatu penggantian perakuan pendaftaran dan permohonan itu hendaklah disertakan dengan fi sebagaimana yang dinyatakan dalam Jadual.
Pendaftaran berasingan bagi setiap peringkat sekolah
Setiap peringkat persekolahan bagi mana-mana sekolah agama Islam yang dijalankan di premis yang sama hendaklah didaftarkan secara berasingan.
Cawangan sekolah agama Islam
Islam hendaklah didaftarkan secara berasingan.
Penukaran nama, dsb.
Nama, alamat, lokasi dan premis suatu sekolah agama Islam itu tidak boleh ditukar, dipinda atau diubah suai tanpa kebenaran bertulis Pendaftar.

Suatu permohonan untuk menukar, meminda atau mengubah suai nama, alamat, lokasi atau premis sekolah agama Islam itu hendaklah dibuat oleh
Jemaah Pengurusan kepada Pendaftar mengikut cara yang ditentukan oleh Pendaftar.
Jika permohonan di bawah subkaedah (2) diluluskan, Pendaftar hendaklah mengeluarkan suatu perakuan pendaftaran yang baharu setelah fi sebagaimana yang dinyatakan dalam Jadual dibayar.

Jemaah
Pengurusan yang tidak mematuhi subkaedah (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.
Pengiklanan sekolah agama Islam
Tiada seorang pun boleh mengiklankan suatu sekolah agama Islam melainkan jika ia telah didaftarkan di bawah Kaedah-Kaedah ini.
Mana-mana orang yang melanggar subkaedah (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya, dan dalam hal kesalahan kedua atau yang berterusan, didenda tidak melebihi empat ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.
Pembatalan pendaftaran
Jawatankuasa boleh membatalkan pendaftaran suatu sekolah agama Islam jika Jawatankuasa berpuas hati bahawa Jemaah Pengurusan—
telah gagal melaksanakan mana-mana tanggungjawabnya di bawah Kaedah-Kaedah ini;
telah disabitkan dengan apa-apa kesalahan jenayah oleh mana-mana mahkamah;

telah melanggar mana-mana syarat yang dikenakan dalam perakuan pendaftaran; atau
Walau apa pun perenggan (1)(a), (c) dan (d), Jawatankuasa hendaklah, sebelum membatalkan sesuatu pendaftaran, memberi suatu notis secara bertulis kepada
Jemaah Pengurusan tentang hasratnya untuk berbuat demikian dan menghendaki
Jemaah
Pengurusan itu melaksanakan tanggungjawabnya atau membetulkan pelanggaran itu atau mematuhi apa-apa arahan itu dalam tempoh yang dinyatakan dalam notis itu atau dalam apa-apa tempoh lanjutan sebagaimana yang diberikan oleh Jawatankuasa.
Jika selepas tamat tempoh yang disebut dalam subkaedah (2)
Jemaah Pengurusan tidak melaksanakan tanggungjawab itu atau membetulkan pelanggaran itu atau mematuhi arahan itu, Jawatankuasa boleh membatalkan pendaftaran sekolah agama Islam itu melalui suatu notis bertulis yang dialamatkan dan disampaikan kepada Pengerusi Jemaah Pengurusan.
Jawatankuasa boleh membatalkan pendaftaran suatu sekolah agama Islam jika ia mempunyai sebab untuk mempercayai bahawa sekolah agama Islam itu telah terhenti daripada beroperasi.
Notis pembatalan pendaftaran yang disebut dalam subkaedah (3)
hendaklah—
mengandungi segala arahan yang difikirkan perlu oleh Pendaftar.

Pengerusi Jemaah Pengurusan hendaklah menyerahkan perakuan pendaftaran itu kepada Pendaftar dalam masa tiga puluh hari dari tarikh pembatalan pendaftarannya.
Pengerusi Jemaah Pengurusan yang tidak menyerahkan perakuan pendaftaran di bawah subkaedah (6) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.

Jemaah
Pengurusan yang terkilan dengan apa-apa keputusan
Jawatankuasa yang dibuat di bawah perenggan 24(5)(b) atau kaedah 34 boleh, dalam masa tiga puluh hari dari tarikh keputusan itu diterima, merayu secara bertulis terhadap keputusan itu kepada Majlis.
Majlis boleh, setelah menimbangkan suatu rayuan yang dibuat di bawah subkaedah (1), mengesahkan atau mengetepikan keputusan Jawatankuasa dan keputusan Majlis adalah muktamad.
Jemaah Pengurusan boleh, menurut peruntukan Kaedah-Kaedah ini, memohon untuk mendaftarkan semula sekolah agama Islam yang telah dibatalkan perakuan pendaftarannya.
Bahagian VI
Akaun kewangan sekolah agama Islam
Bagi maksud Kaedah-Kaedah ini, tiap-tiap Jemaah Pengurusan hendaklah membuka suatu akaun kewangan yang dinamakan sebagai akaun kewangan sekolah agama Islam di mana-mana bank Islam berlesen.

Garis panduan kewangan
Setiap kelulusan untuk memperoleh apa-apa pembekalan atau perbelanjaan hendaklah dibuat mengikut garis panduan kewangan atau apa-apa peraturan-peraturan yang dikeluarkan oleh Majlis dari semasa ke semasa.
Audit
Pengerusi Jemaah Pengurusan hendaklah mengemukakan kepada Majlis akaun kewangan sekolah agama Islam yang telah diaudit jika diminta untuk berbuat demikian oleh Majlis.
Bahagian VII
Notis pemberhentian operasi
Mana-mana sekolah agama
Islam yang tidak berdaftar atau pendaftarannya telah dibatalkan di bawah Kaedah-Kaedah ini hendaklah ditamatkan daripada beroperasi.
Sebelum menamatkan operasi sekolah agama
Islam,
Jawatankuasa hendaklah—
mengeluarkan suatu notis secara bertulis kepada Jemaah
Pengurusan atau mana-mana orang yang mengoperasikan sekolah agama Islam itu untuk memberitahu niatnya untuk berbuat demikian; dan
menghendaki Jemaah Pengurusan atau mana-mana orang yang mengoperasikan sekolah agama Islam itu untuk mendaftarkan sekolah agama Islam itu dalam tempoh yang dinyatakan dalam notis

bertulis itu atau dalam apa-apa tempoh lanjutan yang diberikan oleh Jawatankuasa.
Jemaah Pengurusan atau orang itu gagal untuk mendaftar, sekolah agama Islam itu boleh ditamatkan operasinya melalui suatu notis bertulis oleh Jawatankuasa yang dialamatkan dan disampaikan masing-masing kepada Pengerusi Jemaah Pengurusan atau orang itu.
Notis untuk menamatkan operasi yang disebut dalam subkaedah (3)
hendaklah—
Jemaah Pengurusan atau orang itu boleh, menurut peruntukan
Kaedah-Kaedah ini, memohon untuk mendaftarkan semula sekolah agama Islam yang operasinya telah ditamatkan.
Bahagian VIII
Laporan
Tiap-tiap sekolah agama Islam hendaklah, tidak lewat daripada 31 Januari tiap-tiap tahun, membuat dan mengemukakan kepada Pendaftar suatu laporan aktiviti dan laporan kewangan sekolah agama Islam bagi tahun sebelumnya.
Kurikulum dan kokurikulum sekolah agama Islam
Semua sekolah agama Islam hendaklah menggunakan kurikulum dan kokurikulum yang disediakan oleh Jawatankuasa dan diluluskan oleh Majlis.

Penilaian
Sekolah agama Islam hendaklah mengadakan penilaian bagi murid-muridnya mengikut apa-apa kaedah yang diluluskan oleh Majlis.
Kuasa Majlis untuk mengeluarkan arahan
Pengurusan, Pendaftar atau Nazir Sekolah berhubung dengan apa-apa perkara yang diperuntukkan di bawah Kaedah-Kaedah ini dan Jawatankuasa, Jemaah Pengurusan,
Pendaftar atau Nazir Sekolah hendaklah melaksanakan tiap-tiap arahan itu.
Pengambilalihan pentadbiran sekolah agama Islam
Jawatankuasa atas arahan Majlis boleh, jika difikirkan perlu olehnya dan suai manfaat demi kepentingan murid atau sesuatu sekolah agama Islam itu, mengambil alih secara sementara pentadbiran sekolah agama Islam itu selama tempoh yang boleh sampai enam bulan.
Selepas habis tempoh yang disebut dalam subkaedah (1), Majlis boleh—
Bahagian IX
Mana-mana orang yang mengendalikan suatu sekolah agama Islam sebaik sebelum tarikh permulaan kuat kuasa Kaedah-Kaedah ini hendaklah mendaftarkan sekolah agama Islam itu mengikut kaedah 23 Bahagian V Kaedah-Kaedah ini dalam masa dua belas bulan dari tarikh permulaan kuat kuasa Kaedah-Kaedah ini atau dalam apa-apa tempoh lanjutan yang dibenarkan oleh Jawatankuasa.

Jika Jawatankuasa tidak meluluskan permohonan yang disebut dalam subkaedah (1), orang yang mengendalikan suatu sekolah agama Islam itu hendaklah menamatkan operasi sekolah agama Islam itu.

(REGISTRATION AND REGULATION OF ISLAMIC RELIGIOUS SCHOOL) RULES 2025
IN exercise of the powers conferred by section 99
of the
Administration of
Islamic
Law
(Federal
Territories)
Act 1993
[Act 505], the Yang di-Pertuan Agong, on the advice of the Majlis, makes the following rules:
PART I
PRELIMINARY
Citation, application and commencement 1.
(1)
These rules may be cited as the Administration of Islamic Law
(Federal Territories) (Registration and Regulation of Islamic Religious School)
Rules 2025.
(2)
These Rules shall apply to the Federal Territories of Kuala Lumpur, Labuan and Putrajaya.
(3)
These Rules come into operation on 1 June 2025.
Interpretation 2.
In these Rules, unless the context otherwise requires—
“Board of Management” means the Board of Management of an Islamic Religious
School established under subrule 19(2);
“Committee” means the Islamic Religious School Committee established under rule 3;
“Inspector of Schools” means the inspector of schools of Islamic religious school appointed under subrule 14(1);

“Registrar” means the Chief Registrar of the Islamic religious school and includes the Registrar and Assistant Registrar of Islamic religious school appointed under rule 11.
“Chairman” means the Chairman of the Islamic Religious School Committee appointed under paragraph 5(1)(a);
“Islamic religious pre-school” means an Islamic religious school providing
Islamic religious pre-school educational program for pupils from the ages of four to six years;
“certificate of registration” means the certificate of registration for
Islamic religious school issued under paragraph 24(5)(a);
“Islamic religious school” means any places used for carrying out an activity of teaching and learning of the religion of Islam having at least ten pupils at the level of Islamic religious pre-school, primary school or secondary school established by any person, the Majlis or the Islamic Religious Department of the Federal Territories which includes the institution of pondok, tahfiz al-Quran, religious studies or hadith studies but does not include any educational institution referred to in paragraphs 16(a) and (b) of the Education Act 1996 [Act 550];
“Islamic religious secondary school” means an Islamic religious school providing
Islamic religious secondary education appropriate for a pupil who has just completed
Islamic religious primary education program or primary education under the Education Act 1996;
“Islamic religious primary school” means an Islamic religious school providing
Islamic religious primary education program for pupils from the age of six years;
“instrument of management” means an instrument of management of the Islamic religious school as specified under subrule 19(1).

PART II
ISLAMIC RELIGIOUS SCHOOL COMMITTEE
Establishment of Committee 3.
The Majlis shall establish a committee to be known as the “Islamic Religious
School Committee”.
Functions of Committee 4.
(1)
The functions of the Committee are as follows:
(a)
to consider, approve or refuse an application for the registration of an Islamic religious school;
(b)
to formulate, develop, evaluate and amend the curriculum and co-curriculum of the Islamic religious school consistent with the resolution of the Majlis;
(c)
to report on the affairs of Islamic religious school to the Majlis at least once in six months;
(d)
to report any action taken against an Islamic religious school to the
Majlis pertaining to the registration and revocation of registration of the Islamic religious school;
(e)
to add, amend or revoke any condition imposed in the certificate of registration;
(f)
to revoke the registration of any Islamic religious school in accordance with rule 34
or by the application of the Board of Management; and
(g)
to do all things necessary or expedient for or in connection with the performance of its functions under these Rules.

(2)
Notwithstanding paragraph (1)(b), the Committee may seek advice from the Jawatankuasa Penyelarasan Pendidikan Islam Kebangsaan established by the
Majlis Kebangsaan Bagi Hal Ehwal Agama Islam Malaysia on any matters relating to Islamic religious school including curriculum and co-curriculum, text books, examinations, certifications and training of teachers.
Membership of Committee 5.
(1)
The Committee shall consist of—
(a)
a Chairman to be appointed by the Majlis from among its members;
(b)
the Director of the Islamic Religious Department of the
Federal Territories as a Deputy Chairman;
(c)
the Mufti or his representative;
(d)
an officer of the Majlis nominated by the Majlis;
(e)
an officer of the
Islamic
Religious
Department of the
Federal
Territories nominated by the
Director of the Islamic Religious Department of the Federal Territories;
(f)
an officer of the Department of Islamic Development Malaysia nominated by the Director General of the Department of
Islamic Development Malaysia;
(g)
an officer of the Education Department of the Federal Territories;
and
(h)
three other members who have the relevant experience, knowledge and expertise from among Muslims who shall be appointed by the Majlis.

(2)
A member appointed under paragraphs (1)(a) and (h) shall be appointed for a term not exceeding three years and shall be eligible for reappointment.
Secretary 6.
(1)
The Majlis may appoint a senior Islamic affairs officer at the
Islamic Religious Department of the Federal Territories as a Secretary to the Committee.
(2)
The Secretary shall be responsible for carrying out of the policies, directions and decisions of the Committee.
(3)
The Secretary shall be entitled to attend all meetings of the Committee and to participate in its deliberations but shall not be entitled to vote.
Revocation and resignation of office 7.
(1)
The Majlis may, in writing, revoke the appointment of any member of the Committee appointed under paragraphs 5(1)(a) and (h).
(2)
The member of the Committee appointed under paragraphs 5(1)(a) and (h)
may resign by a notice in writing to the Chairman of the Majlis.
Vacation of office 8.
(1)
A member of the Committee appointed under paragraphs 5(1)(a) and (h)
shall be deemed to have vacated his office if—
(a)
he dies;
(b)
he has been convicted of any criminal offences;
(c)
he becomes an undischarged bankrupt; or
(d)
he is of unsound mind or is otherwise incapable of discharging his duties.

(2)
Where a member appointed under paragraphs 5(1)(a) and (h) cease to be a member of the Committee by a reason of any provision in these Rules, the Majlis may appoint another person to fill the vacancy for the remaining term for which the vacating member.
Meetings of Committee 9.
(1)
All meetings of the Committee shall be summoned by the Secretary on the direction of the Chairman by serving a written notice to the members of the Committee at least seven days before the meeting.
(2)
Notwithstanding subrule (1), the Chairman may, if he considers that there is an urgent need, summon a meeting at a shorter notice.
(3)
The Chairman, or in his absence, the Deputy Chairman shall preside over all the meetings of the Committee.
(4)
The Committee shall convene its meetings at least once in every six months.
(5)
The chairman of the meeting and four other members of the Committee present shall form a quorum at any meeting of the Committee.
(6)
All decisions of the meeting of the Committee shall be made by a consensus or by a resolution of the majority of the members present and entitled to vote and if there is an equality of votes, the Chairman or the Deputy Chairmain presiding over the meeting shall have a casting vote.
(7)
Notwithstanding subrule (4), the Chairman may, direct the Secretary to summon a meeting.
(8)
The Chairman may invite any person who is not a member of the
Committee to attend any meeting or deliberation of the Committee for the purpose of

advising the Committee on any matter under discussion but that person shall not be entitled to vote at the meeting.
Allowances 10.
The members of the Committee may be paid such allowances as may be determined by the Majlis.
PART III
CHIEF REGISTRAR, REGISTRAR, ASSISTANT REGISTRAR AND INSPECTOR OF SCHOOLS
Appointment of Chief Registrar, Registrar and Assistant Registrar 11.
(1)
The Secretary appointed under subrule 6(1) shall be the Chief Registrar.
(2)
The
Majlis may appoint such numbers of
Registrars and
Assistant Registrars from amongst persons serving in the Islamic Affairs service or education service at the Islamic Religious Department of the Federal Territories on such terms and conditions as may be determined by the Majlis.
(3)
Subject to the direction and control of the Chief Registrar and to such conditions or restrictions as may be imposed by the Chief Registrar, a Registrar or an Assistant Registrar may exercise any power of the Chief Registrar under these Rules.
Responsibilities of Registrar 12.
(1)
The Registrar shall be responsible for the following matters:
(a)
to register an Islamic religious school if the application for its registration has been approved under rule 24;
(b)
to ensure that all Islamic religious schools in the Federal Territories are properly administered;
(c)
to regulate and monitor the Board of Management;

(d)
to recommend any appropriate action that may be taken against any Islamic religious school for contravening these Rules to the Committee;
(e)
to submit a written report pertaining to the Islamic religious school affairs in the Federal Territories to the Committee at least once in every six months;
(f)
to advice or recommend any action that may be taken by the Islamic religious school based on the report submitted by the Inspector of Schools; and
(g)
to perform such duties as directed by the Committee from time to time.
(2)
The Registrar shall act under the direction and control of the Committee.
Register of Islamic Religious School 13.
(1)
The Registrar shall keep and maintain a Register of Islamic
Religious School.
(2)
For the purposes of subrule (1), a Register of Islamic Religious School shall contain—
(a)
the name, telephone number, type of school, date of registration and address of the Islamic religious schools;
(b)
the particulars of members of the Board of Management of the
Islamic religious schools;
(c)
the particulars of teachers of the Islamic religious schools;
(d)
the curriculum of the Islamic religious schools, if necessary;

(e)
the validity period of certificate of registration of the Islamic religious schools;
(f)
the financial resources of the Islamic religious schools; and
(g)
any other informations as the Registrar deems necessary to be recorded.
Appointment of Inspector of Schools 14.
(1)
The Majlis may, on the recommendation of the Committee, appoint such number of Inspector of Schools as may be necessary from amongst persons serving in—
(a)
the Islamic Affairs service; and
(b)
the education service, at the Islamic Religious Department of the Federal Territories.
(2)
An Inspector of Schools appointed under subrule (1) shall be subject to the direction and control of the Registrar.
Responsibilities of Inspector of Schools 15.
An Inspector of Schools shall be responsible as follows:
(a)
to inspect Islamic religious schools in relation to the use of the curriculum approved by the Majlis, the quality of teaching and learning, the use of text books, the teachers and the compliance of these Rules or any matters as directed by the Registrar;
(b)
to inspect the financial account of Islamic religious school; and

(c)
to submit the inspection report of Islamic religious school including to recommend any appropriate action that may be taken against the school to the Registrar within twenty-one working days after the inspection.
Power to inspect 16.
The Registrar, Inspector of Schools or any person authorized by the Majlis may inspect any Islamic religious school whether registered or unregistered under these Rules.
Inspection of registered Islamic religious school 17.
(1)
The Registrar, Inspector of Schools or any person authorized by the Majlis in carrying an inspection under paragraph 15(a) and rule 16, may enter any part of the premises and examine any book, document, electronic media material or other articles as he deems necessary.
(2)
The Registrar, Inspector of Schools or any person authorized by the Majlis, in carrying inspection under subrule (1), may be accompanied by any other person he considers necessary.
(3)
Any person who is in the possession or control of any book, document, electronic media material or other articles relating to the management of or the teaching carried out in the Islamic religious school shall produce the book, document, electronic media material or other articles for inspection upon request by the Registrar,
Inspector of Schools or any person authorized by the Majlis.
(4)
Notwithstanding subrule (3), the Registrar may seize, remove or detain any book, document, electronic media material or other articles which in his opinion is detrimental to the interest of the public or the pupils or may become evidence of the commission of an offence under these Rules or the Syariah Criminal Offences
(Federal Territories) Act 1997 [Act 559].

Inspection of unregistered Islamic religious school 18.
(1)
Where the Registrar or a Religious Enforcement Officers has reasonable cause to believe that any premises is being used as an Islamic religious school without being registered under these Rules, the Registrar or the Religious Enforcement Officers may enter and inspect the premises.
(2)
The Registrar or a Religious Enforcement Officers, in carrying inspection under subrule (1), may be accompanied by any other person he considers necessary.
(3)
The Registrar or a Religious Enforcement Officers may seize and detain any book, document, electronic media material or other article found in the premises which appears to him may be used as evidence of the commission of an offence against these Rules or which appears to be the property of, or to have been used in connection with, an Islamic religious school which is not registered under these Rules.
PART IV
ESTABLISHMENT OF BOARD OF MANAGEMENT
Board of Management 19.
(1)
Every Islamic religious school shall have an instrument of management as may be determined by the Committee.
(2)
Every instrument of management shall provide for the establishment of a
Board of Management of an Islamic religious school who shall be responsible for the management of the Islamic religious school.
(3)
The
Committee may, on the application in writing by the Board of Management, amend the instrument of management.
(4)
This rule shall not apply to the Islamic religious school established by the Majlis or Islamic Religious Department of the Federal Territories.

Members of Board of Management 20.
Every Board of Management shall consist of at least five persons and not exceeding eleven persons who shall hold such offices as may be necessary for such
Islamic religious school.
Qualifications of members of Board of Management 21.
(1)
A person may become a member of the Board of Management if he—
(a)
is a Muslim;
(b)
is a citizen of Malaysia;
(c)
is not less than twenty-one years old;
(d)
is not an undischarged bankrupt;
(e)
has not been convicted of and sentenced on any criminal offence by any court; and
(f)
has appropriate knowledge in academics or Islamic studies.
(2)
Notwithstanding paragraph (1)(b), the Committee may allow a non-citizen of Malaysia to be appointed as a member of the Board of Management if it is satisfied that there are special conditions and it is not inconsistent with the public interest or any law for the time being in force to do so.
Responsibilities of Board of Management 22.
(1)
The Board of Management shall be responsible for the management, administration and financial of the Islamic religious school.
(2)
The Board of Management shall—

(a)
administer and maintain the Islamic religious school in accordance with its instrument of management;
(b)
comply with any direction of the Registrar; and
(c)
maintain proper records on—
(i)
the particulars of teachers and officers of the Islamic religious school;
(ii)
the particulars of pupils of the Islamic religious school;
(iii)
the financial resources and expenditures of the Islamic religious school;
(iv)
the curriculum and co-curriculum of the Islamic religious school;
(v)
the education fees of the Islamic religious school; and
(vi)
any other information as may be required by the Registrar.
(3)
The Board of Management may appoint such number of teachers and officers as may be necessary for the purposes of this rule.
(4)
Notwithstanding subrule (3), the appointment of teachers and officers for the Islamic religious school established by the Majlis or the Islamic Religious Department of the Federal Territories shall be made by the Majlis or the Islamic Religious Department of the Federal Territories, respectively.

PART V
REGISTRATION OF ISLAMIC RELIGIOUS SCHOOL
Registration of Islamic religious school 23.
Every Islamic religious school shall be registered under these Rules.
Application for registration 24.
(1)
The Board of Management shall apply for a registration of an Islamic religious school to the Committee in the manner as may be determined by the Committee.
(2)
Every application for registration shall be accompanied by—
(a)
approval or supporting document by the local authority that the premise of the Islamic religious school may be used as a school;
(b)
approval or supporting document by the appropriate authority that the premise has fulfilled the health and safety standards as prescribed;
(c)
particulars of the members of the Board of Management for the
Islamic religious school;
(d)
information of the financial sources of the Islamic religious school;
and
(e)
any other information or document as the Committee deems necessary.
(3)
An application under subrule (1) shall be accompanied by such fee as specified in the Schedule.

(4)
Committee shall upon receiving the application, direct the Registrar to inspect the premise of the Islamic religious school to ensure whether or not such premise has sufficient basic needs and facilities as a school and the Registrar shall forward its finding to the Committee.
(5)
After considering the application, the Committee may—
(a)
approve the application, with or without condition, and issue a certificate of registration of the Islamic religious school to the applicant in the manner as may be determined by the Committee after the registration fee as specified in the Schedule is paid; or
(b)
refuse the application and state the ground of such refusal in writing to the applicant.
(6)
Any Islamic religious school who does not comply with rule 23 commits an offence and shall, on conviction, be liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding three years or to both, and in the case of a continuing offence, to a further fine not exceeding one hundred ringgit for each day during which the offence continues after conviction.
Additional document or information 25.
(1)
The Registrar may, after the receipt of an application under subrule 24(2), request the applicant to give to the Registrar, within the period specified in the request, any additional document or information on the application.
(2)
Where the additional document or information required under subrule (1) is not given by the applicant within the period specified in the request or within any extension of time granted by the Registrar, the application shall be deemed to be withdrawn and shall not be further proceeded with, but without affecting the right of the applicant to make a fresh application.

Validity period of certificate of registration 26.
A certificate of registration shall be valid for a period of five years from the date it is issued unless the registration of Islamic religious school is revoked under rule 34
or the administration of the Islamic religious school is taken over by the Majlis under rule 44.
Renewal of certificate of registration 27.
(1)
The Board of Management may apply to renew the certificate of registration not less than three months before its expiry in the manner as may be determined by the Committee.
(2)
An application under subrule (1) shall be subject to the payment of fee as specified in the Schedule and shall be accompanied by such documents and information as may be required by the Committee.
(3)
After considering the application, the Committe may—
(a)
renew the registration, with or without conditions, after the renewal fee as specified in the Schedule is paid; or
(b)
refuse to renew the registration and state the ground of such refusal to the applicant in writing.
(4)
If the application for renewal is made after the period specified in subrule (1) but before the date of expiry of the certificate, the applicant shall pay a fee for the late renewal as specified in the Schedule.
Display of certificate of registration 28.
(1)
The Board of Management shall display or cause to be displayed the certificate of registration in a conspicuous part of the premise of the Islamic religious school and shall produce the certificate of registration upon request for inspection.

(2)
Any member of the Board of Management who contravenes subrule (1)
commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both, and in the case of a second or continuing offence, to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both.
Replacement of certificate of registration 29.
If a certificate of registration is lost or damaged, the Board of Management shall apply to the Registrar for a replacement of the certificate of registration and the application shall be accompanied by a fee as specified in the Schedule.
Separate registration for each level of school 30.
Each level of schooling for such Islamic religious school carried out in the same premises shall be registered separately.
Branch of Islamic religious school 31.
Every branch of the Islamic religious school shall be registered separately.
Change of name, etc.
32.
(1)
The name, address, location and premises of an Islamic religious school shall not be changed, amended or modified without the written consent of the Registrar.
(2)
An application to change, amend or modify the name, address, location or premises of an Islamic religious school shall be made by the Board of Management to the Registrar in the manner as determined by the Registrar.
(3)
If the application under subrule (2) is approved, the Registrar shall issue a new certificate of registration after the fee as specified in the Schedule is paid.
(4)
Any member of the Board of Management who contravenes subrule (1)
commits an offence and shall, on conviction, be liable to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Advertisement of Islamic religious school 33.
(1)
No person shall advertise an Islamic religious school unless it has been registered under these Rules.
(2)
Any person who contravenes subrule (1) commits an offence and shall, on conviction, be liable to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both, and in the case of a second or continuing offence, to a fine not exceeding four thousand ringgit or to imprisonment for a term not exceeding two years or to both.
Revocation of registration 34.
(1)
The Committee may revoke the registration of an Islamic religious school if the Committee is satisfied that the Board of Management—
(a)
has failed to perform any of its responsibilities under these Rules;
(b)
has been convicted of any criminal offence by any court;
(c)
has contravened any of the conditions imposed in the certificate of registration; or
(d)
has failed to comply with any of the directions of the Registrar, the Committee or the Majlis.
(2)
Notwithstanding paragraphs (1)(a), (c) and (d), the Committee shall, before revoking any registration, give a notice in writing to the Board of Management of its intention to do so and require the Board of Management to perform its responsibilities or to rectify the contraventions or to comply with such directions within the period specified in the notice or within such extended period as may be given by the Committee.
(3)
If upon the expiry of the period mentioned in subrule (2)
the Board of Management fails to perform the responsibility or rectify the contravention

or comply with such direction, the Committee may revoke the registration of the Islamic religious school by a written notice addressed and served to the Chairman of the Board of Management.
(4)
The Committee may revoke the registration of an Islamic religious school if it has reason to believe that the Islamic religious school has ceased to be in operation.
(5)
The notice of revocation of registration referred to in subrule (3) shall—
(a)
specify grounds and effective date of the revocation; and
(b)
contain all directions as the Registrar thinks necessary.
(6)
The Chairman of the Board of Management shall surrender the certificate of registration to the Registrar within thirty days from the date of the revocation of its registration.
(7)
The Chairman of the Board of Management who fails to surrender the certificate of registration under subrule (6) commits an offence and shall, on conviction, be liable to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or to both.
Appeal 35.
(1)
The Board of Management who aggrieved by any decision of the Committee made under paragraph 24(5)(b) or rule 34 may, within thirty days from the date of the receipt of the decision, appeal in writing against such decision to the Majlis.
(2)
The Majlis may, after considering an appeal made under subrule (1), confirm or set aside the decision of the Committee and the decision of the Majlis is final.
(3)
The Board of Management may, pursuant to these Rules, apply to re-register the Islamic religious school which certificate of registration has been revoked.

PART VI
FINANCIAL
Financial account of Islamic religious school 36.
(1)
For the purposes of these Rules, every Board of Management shall open the financial account named as the financial account of the Islamic religious school at any licensed Islamic bank.
(2)
For the purposes of subrule (1), “licensed Islamic bank” has the meaning assigned to it under section 2 of the Islamic Financial Services Act 2013 [Act 759].
Financial guidelines 37.
Each approval for obtaining any supply or expenditure shall be made in accordance with the financial guidelines or any regulations issued by the Majlis from time to time.
Audit 38.
The Chairman of the Board of Management shall submit to the Majlis an audited financial accounts of the Islamic religious school if requested to do so by the Majlis.
PART VII
ENFORCEMENT
Notice of cessation of operation 39.
(1)
Any Islamic religious school which is not registered or its registration has been revoked under these Rules, the operation of any Islamic religious school shall cease to operate.
(2)
Before ceasing the operation of the Islamic religious school, the Committee shall—

(a)
give a notice in writing to the Board of Management or any person operating the Islamic religious school notifying its intention to do;
and
(b)
require the Board of Management or that person which operating the Islamic religous school to register the Islamic religious school within the period specified in the notice in writing or within any further period as may be given by the Committee.
(3)
Upon the expiry of the period referred to in subrule
(2)
the Board of Management or that person fails to register, the Islamic religious school may cease to operate by a written notice by the Committee addressed and served to the Chairman of the Board of Management or that person, respectively.
(4)
The notice to cease operation referred to under subrule (3) shall—
(a)
specify grounds and effective date of the cease; and
(b)
contain all directions as the Registrar deems necessary.
(5)
The Board of Management or that person may, pursuant to these Rules, apply to re-register the Islamic religious school which the operation of the Islamic religious school has been ceased.
PART VIII
MISCELLANEOUS
Report 40.
Every Islamic religious school shall, not later than 31 January every year, make and submit to the Registrar a report of activities and financial report of the Islamic religious school for the year before.

Curriculum and co-curriculum of Islamic religious school 41.
All Islamic religious schools shall use the curriculum and co-curriculum which is prepared by the Committee and approved by the Majlis.
Assessment 42.
The Islamic Religious School shall convene assessment for its pupils in such manner as approved by the Majlis.
Power of Majlis to issue directions 43.
The Majlis may issue any direction to the Committee, Board of Management,
Registrar or Inspector of Schools in relation to any matter provided under these Rules and the Committee, Board of Management, Registrar or Inspector of Schools shall give effect to every such direction.
Take over of administration of Islamic religious school 44.
(1)
The Committee on the direction of the Majlis may, if it thinks necessary and expedient in the interest of the pupils or the Islamic religious school, take over provisionally the administration of an Islamic religious school for a period which may extend to six months.
(2)
After the expiry of the period referred to in subrule (1), the Majlis may—
(a)
take over the administration of the Islamic religious school;
(b)
cease the operation of the Islamic religious school; or
(c)
take such action as it thinks necessary.

PART IX
TRANSITIONAL
Transitional 45.
(1)
Any person who operates an Islamic religious school immediately before the date of coming into operation of these Rules shall register the Islamic religious school in accordance with rule 23 of Part V of these Rules within twelve months from the date of coming into operation of these Rules or any extended period allowed by the Committee.
(2)
If the Committee disapproves the application referred to in subrule (1), the person who is operating the Islamic religous school shall cease to operate the Islamic religious school.
