Section 18

(1)

Any person who -

(a)

spreads chemicals or other toxic matters either from within or outside a Wildlife Sanctuary which cause harm to fauna or flora in that Sanctuary;

(b)

discharges or allows the discharge of oil, chemicals or other toxic or waste matters capable of harming fauna and flora in or adjacent to any rivers, lakes and waters in or flowing into a

Wildlife Sanctuary; or

(c)

obstructs or diverts any rivers, pools, lakes or other bodies of water in or flowing into a Wildlife Sanctuary, commits an offence and shall, on conviction, be liable, if a corporate body, to a fine of not less than one hundred thousand ringgit and not more than five hundred thousand ringgit and, if not a corporate body, to a fine of not less than fifty thousand ringgit and not more than one hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both.

(2)

A Court that convicts a person of an offence under subsection (1) may order that person to pay to the Government such contribution towards the cost estimated by the Government of remedying the damage caused by the spread, discharge, obstruction or diversion as the Court shall consider appropriate.
