Section 21
New section 24a
of Medical (Amendment) Act 2012
The principal Act is amended by inserting after section 24
the following section:
“Reinstatement of names in Register 24a. (1) Where the name of a medical practitioner has been removed from the Register in accordance with section 24, he may apply to the Council for his name to be reinstated in the Register.
(2)
The Council may, in its discretion, upon application made under subsection (1), order the name of the applicant to be reinstated in the Register or reject the reinstatement of the name by giving reasons therefor.
(3)
Any person who has ceased to be registered under this
Act under paragraph 24(2)(b) shall not be reinstated unless he has been certified fit by a Fitness to Practise Committee.
(4)
The Council may impose such conditions and restrictions as it deems fit to the reinstatement.
(5)
Any person whose application has been rejected under subsection (2) may appeal to the Minister within thirty days from the date of the decision.
(6)
The decision of the Minister shall be final.”.
