Section 2C
Powers and functions of the Board
The Board shall have the following powers and functions to do all things necessary or convenient to be done for, or in connection with, the performance of its functions as follows—
(a)
to determine the qualifications for persons to be registered as a building professional under this Ordinance;
(b)
to conduct or cause to be conducted examinations or assessments as the Board considers necessary for the purpose of qualifying any person for registration under this Ordinance or the regulations made hereunder;
(c)
to register the qualified persons, accredited checkers, green building certification body and green building practitioner under this Ordinance and to impose any conditions or restrictions on such registration as it may deem fit;
(d)
to establish, maintain and develop standards of professional conduct and ethics of the qualified persons, accredited checkers, green building certification body and green building practitioner;
(e)
to fix, from time to time, with the approval of the
Majlis Mesyuarat Kerajaan Negeri, the scale of fees to be charged for professional service rendered by any person including the qualified persons, accredited checkers, green building certification body and green building practitioner;
(f)
to determine the green building rating tools to be used under this Ordinance or the regulations made hereunder or the standards submitted by the green building certification body and to direct any modification or impose any conditions or restrictions thereof as it may deem fit;
(g)
to formulate and review from time to time, and to enforce, the standards or requirements for the conduct of building and structural plan submission and application for building plan approval in Sarawak, including determining the qualification for registration as qualified persons;
(h)
to form a committee to hear and determine any complaint or disputes relating to professional conduct or ethics of qualified persons, accredited checkers, green building certification body and green building practitioner registered under this Ordinance or the regulations made hereunder;
(i)
to provide scholarships, grants, loans or other incentives for training or research related to buildings or any matter thereof including built environment;
(j)
to accept grants, donations or gifts from any source or raise funds by lawful means;
(k)
to acquire, purchase, lease, dispose of, or otherwise deal with, any immovable property of the Board;
(l)
to impose and collect any fees to which the Board has the power to impose and collect under this Ordinance and the regulations made hereunder;
(m)
to borrow from bank or any financial institution, from time to time, by bank overdraft or otherwise for the purposes of carrying out its functions under this Ordinance and the regulations made hereunder;
(n)
to form or constitute such committees, comprising members of the Board and any persons, as the Board deems necessary to assist the Board in the discharge of its duties and functions;
(o)
with the approval of the Minister, to facilitate or enter into arrangements with any person or party, within or outside
Sarawak for any matter relating to buildings including the qualifications and standards adopted by such party regarding the practice of built environment;
(p)
to promote learning and education in connection with matter relating to building including built environment and the professional consultancy practices; and
(q)
generally to do all such acts, matters and things as are necessary to be carried out under the provisions of this
Ordinance.
