(1)
Every Authority may, subject to the approval of the Minister, make by-laws for the carrying into effect and for the purposes of any function conferred on it by virtue of this or any other written law.
(2)
Any by-law made by an Authority under the provisions of this section shall be read and construed subject to the provisions of any written law and to the Instrument of such
Authority and nothing in this Ordinance contained shall be deemed to empower an Authority to make any by-law overriding or derogating from the provisions of any other written law for the time being in force.
(3)
By-laws made under the provisions of this section may be made to apply to the whole of the area of an Authority or any part thereof and the power to make by-laws conferred by this section shall include power to make different by-laws in respect of different parts of the area of an Authority.
(4)
An Authority may in making any by-laws relating to cleanliness of public places or obstructions therein prescribe the circumstances in which it shall be presumed that an offence under the provisions of any such by-laws was committed by or with the permission of the occupier of land or building or of the driver or person having charge or control of vehicle.
