Tuntutan bagi elaun mencari pekerjaan dan elaun pendapatan berkurangan

Seksyen 2

Orang berinsurans hendaklah mengemukakan suatu tuntutan bagi elaun mencari pekerjaan di bawah seksyen 34 Akta atau elaun pendapatan berkurangan di bawah seksyen 36 Akta dalam Borang SIPF 1 Jadual kepada Pertubuhan, secara elektronik atau selainnya, bersama dengan apa-apa dokumen atau maklumat sebagaimana yang ditentukan oleh Pertubuhan.

Tarikh pengemukaan tuntutan bagi elaun mencari pekerjaan dan elaun pendapatan berkurangan

Tarikh pengemukaan suatu tuntutan bagi elaun mencari pekerjaan atau elaun pendapatan berkurangan di bawah peraturan 2 hendaklah pada tarikh Pertubuhan mengaku terima tuntutan itu.

Pemberitahuan keputusan bagi tuntutan bagi elaun mencari pekerjaan dan elaun pendapatan berkurangan 4.

Jika Pertubuhan—

(a)

telah meluluskan suatu tuntutan bagi elaun mencari pekerjaan atau elaun pendapatan berkurangan di bawah perenggan 33(1)(a) Akta,

Pertubuhan hendaklah memberitahu orang berinsurans itu, secara elektronik atau selainnya, mengenai keputusannya; atau

(b)

telah menolak suatu tuntutan bagi elaun mencari pekerjaan atau elaun pendapatan berkurangan di bawah subseksyen 29(2) atau 31(3), atau perenggan 33(1)(b) Akta, Pertubuhan hendaklah memberitahu orang berinsurans itu, secara elektronik atau selainnya, mengenai keputusannya bersama dengan alasan bagi penolakan.

Jika Pertubuhan telah menolak suatu tuntutan bagi elaun mencari pekerjaan atau elaun pendapatan berkurangan sebagaimana yang dinyatakan di bawah perenggan (1)(b), suatu tuntutan bagi elaun mencari pekerjaan atau elaun pendapatan berkurangan berhubung dengan kehilangan pekerjaan yang sama tidak boleh dikemukakan semula kepada Pertubuhan melainkan jika Pertubuhan berpuas hati bahawa—

(a)

terdapat keterangan baharu mengenai suatu fakta material yang tidak dizahirkan kepada Pertubuhan atau orang berinsurans itu pada masa keputusan untuk menolak tuntutan itu dibuat; dan

(b)

pengemukaan semula tuntutan itu dibuat dalam masa enam puluh hari dari tarikh orang berinsurans itu kehilangan pekerjaannya sebagaimana yang ditentukan oleh

Pertubuhan di bawah subseksyen 29(1) Akta.

Bayaran elaun mencari pekerjaan

Seksyen 5

Bayaran bulanan pertama bagi elaun mencari pekerjaan hendaklah dibayar kepada orang berinsurans oleh Pertubuhan sebaik selepas tempoh menunggu jika orang berinsurans itu mengambil bahagian dalam program penempatan pekerjaan semula di bawah seksyen 44 Akta.

Bagi tiap-tiap bayaran bulanan elaun mencari pekerjaan yang berikutnya,

Pertubuhan hendaklah membayar elaun mencari pekerjaan itu kepada orang berinsurans bagi bulan itu selepas Pertubuhan—

(a)

menerima laporan bulanan mengenai rancangan komitmen pekerjaan yang disebut dalam perenggan 15(d) daripada orang berinsurans itu;

dan

(b)

berpuas hati bahawa orang berinsurans itu telah menjalankan rancangan komitmen pekerjaan dan mencapai sasaran sebagaimana yang dinyatakan dalam rancangan komitmen pekerjaan itu.

Seksyen 6

Orang berinsurans hendaklah memberitahu

Pertubuhan tentang penerimaannya bagi suatu tawaran pekerjaan dalam Borang SIPF 2 Jadual, secara elektronik atau selainnya, dalam masa tujuh hari dari tarikh orang berinsurans itu menerima tawaran pekerjaan itu bersama dengan apa-apa dokumen atau maklumat itu sebagaimana yang ditentukan oleh Pertubuhan.

Walau apa pun subperaturan (1), jika orang berinsurans menerima tawaran pekerjaan dan melapor diri untuk bertugas dalam tempoh menunggu di bawah perenggan 35(1)(a) Akta, orang berinsurans itu hendaklah memberitahu Pertubuhan dalam Borang SIPF 2 Jadual, secara elektronik atau selainnya—

(a)

mengenai penerimaan tawaran pekerjaan itu; dan

sama ada orang berinsurans itu memilih untuk menerima elaun bekerja semula awal atau tidak, dalam masa dua hari dari tarikh orang berinsurans itu melapor diri untuk bertugas.

Apabila pemberitahuan daripada orang berinsurans di bawah subperaturan (1) atau (2) diterima dan apabila berpuas hati bahawa orang berinsurans itu telah menerima tawaran pekerjaan dan melapor diri untuk bertugas,

Pertubuhan hendaklah membayar elaun bekerja semula awal kepada orang berinsurans itu.

Bayaran elaun latihan

Apabila bukti kehadiran latihan bersama dengan apa-apa dokumen lain di bawah perenggan 18(2)(b) daripada orang berinsurans diterima dan apabila berpuas hati bahawa orang berinsurans itu telah menghadiri latihan, Pertubuhan hendaklah membayar elaun latihan kepada orang berinsurans itu.

Bayaran fi latihan

Pertubuhan boleh melantik apa-apa bilangan pemberi latihan mengikut apa-apa cara dan tertakluk kepada apa-apa syarat sebagaimana yang ditentukan oleh Pertubuhan.

Pemberi latihan yang dilantik oleh Pertubuhan di bawah subperaturan (1)

hendaklah mengemukakan suatu tuntutan bagi fi latihan dalam Borang SIPF 3 Jadual kepada Pertubuhan, secara elektronik atau selainnya, bersama dengan apa-apa dokumen sebagaimana yang ditentukan oleh Pertubuhan.

Apabila tuntutan di bawah subperaturan (2) diterima dan apabila berpuas hati bahawa pemberi latihan telah menjalankan latihan berkenaan dengan orang berinsurans, Pertubuhan hendaklah membayar fi latihan kepada pemberi latihan itu.

Bayaran faedah kepada orang tanggungan

Jika orang berinsurans mati, dalam keadaan koma atau tidak sempurna akal—

(a)

selepas orang berinsurans itu membuat suatu tuntutan bagi elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan di bawah Akta; atau

(b)

dalam tempoh yang orang berinsurans itu berhak mendapat atau sedang menerima elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan di bawah Akta, mana-mana orang tanggungan bagi orang berinsurans itu hendaklah dengan segera memberitahu Pertubuhan, secara elektronik atau selainnya, mengenai hakikat itu.

Mana-mana orang tanggungan bagi orang berinsurans yang disebut dalam subperaturan (1) yang berniat untuk menuntut bayaran elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan hendaklah mengemukakan tuntutan dalam Borang SIPF 4 Jadual kepada Pertubuhan, secepat yang dapat dilaksanakan, secara elektronik atau selainnya, bersama dengan apa-apa dokumen atau maklumat sebagaimana yang ditentukan oleh Pertubuhan.

Dalam hal orang tanggungan yang merupakan orang yang belum dewasa, tuntutan yang dibuat di bawah subperaturan (2) hendaklah dikemukakan—

(b)

jika tiada penjaga, oleh mana-mana orang lain sebagaimana yang difikirkan patut oleh Pertubuhan.

Apabila suatu tuntutan daripada orang tanggungan di bawah subperaturan (2) atau (3) diterima, Pertubuhan boleh mengeluarkan suatu notis, secara elektronik atau selainnya, kepada mana-mana orang tanggungan lain yang telah

dinamakan dalam Borang SIPF 1 Jadual tetapi belum mengemukakan tuntutannya di bawah subperaturan (2) atau (3).

Notis yang disebut dalam subperaturan (4) hendaklah mengandungi maklumat bahawa suatu tuntutan di bawah subperaturan (2) atau (3) telah dikemukakan oleh orang tanggungan yang lain.

Apabila notis yang dikeluarkan di bawah subperaturan (4) diterima, orang tanggungan itu boleh mengemukakan suatu tuntutan mengikut subperaturan (2)

atau (3) kepada Pertubuhan dalam apa-apa tempoh sebagaimana yang dinyatakan dalam notis itu.

Apabila tuntutan daripada orang tanggungan di bawah subperaturan (2)

atau (3) diterima, Pertubuhan hendaklah menentukan sama ada orang tanggungan itu berhak mendapat bayaran elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan.

Jika Pertubuhan menentukan bahawa orang tanggungan berhak mendapat bayaran elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan, Pertubuhan hendaklah membayar elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan itu kepada orang tanggungan itu.

Jika Pertubuhan menentukan bahawa orang tanggungan tidak berhak mendapat bayaran elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan, Pertubuhan hendaklah memberitahu orang tanggungan itu mengenai penentuannya secara elektronik atau selainnya.

Tarikh akruan faedah yang kena dibayar kepada orang tanggungan

Jika orang berinsurans yang berhak mendapat elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan yang diberikan di bawah Akta mati, dalam keadaan koma atau tidak sempurna akal, tarikh akruan bagi

elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan atau elaun latihan itu yang kena dibayar kepada orang tanggungan bagi orang berinsurans itu oleh Pertubuhan adalah dari tarikh orang berinsurans itu mati, dalam keadaan koma atau tidak sempurna akal.

Seksyen 11

Cara pembayaran faedah

Elaun mencari pekerjaan, elaun bekerja semula awal, elaun pendapatan berkurangan dan elaun latihan hendaklah dibayar kepada orang berinsurans, atau orang tanggungannya di bawah subperaturan 39(1) Akta, dengan cara pemindahan wang secara elektronik, cek atau apa-apa cara pembayaran lain sebagaimana yang ditentukan oleh Pertubuhan.

Pemberitahuan mengenai representasi, tuntutan atau aduan di bawah undang-undang bertulis lain

apa-apa representasi bagi pengembalian pekerjaan di bawah Akta

Perhubungan Perusahaan 1967 [Akta 177];

apa-apa tuntutan bagi bayaran faedah penamatan atau rentikerja sentara di bawah Akta Kerja 1955 [Akta 265], Ordinan Buruh Sabah

[Sabah Bab 67] dan Ordinan Buruh Sarawak [Sarawak Bab 76]; atau

(c)

apa-apa aduan yang berhubungan dengan persaraan pramasa di bawah

Akta Umur Persaraan Minimum 2012 [Akta 753], orang berinsurans itu hendaklah dengan segera, selepas mengemukakan tuntutan bagi faedah itu, memberitahu Pertubuhan mengenai hakikat itu mengikut apa-apa cara sebagaimana yang ditentukan oleh Pertubuhan.

Jika selepas pengemukaan suatu tuntutan bagi faedah di bawah Akta orang berinsurans membuat apa-apa representasi, tuntutan atau aduan yang disebut dalam

perenggan (1)(a), (b) atau (c), orang berinsurans itu hendaklah dengan segera memberitahu Pertubuhan mengenai hakikat itu mengikut apa-apa cara sebagaimana yang ditentukan oleh Pertubuhan.

Penyertaan dalam program penempatan pekerjaan semula

Seksyen 15

Bagi maksud penyertaan dalam program penempatan pekerjaan semula, orang berinsurans hendaklah, secara elektronik atau selainnya, dalam tempoh menunggu—

(b)

memberikan semua maklumat tentang kesihatannya dan laporan kesihatan yang berkaitan;

melengkapkan borang penempatan dan penilaian pekerjaan;

(e)

mematuhi apa-apa syarat, sebagaimana yang ditentukan oleh Pertubuhan.

Penangguhan penyertaan dalam program penempatan pekerjaan semula

orang berinsurans itu diperakukan sebagai tidak sihat dari segi perubatan oleh seorang pengamal perubatan; atau

orang berinsurans itu mempunyai apa-apa sebab lain sebagaimana yang diluluskan oleh Pertubuhan.

, orang berinsurans hendaklah mengemukakan suatu permohonan untuk menangguhkan penyertaannya dalam program penempatan pekerjaan semula kepada Pertubuhan dalam Borang SIPF 5

Jadual, secara elektronik atau selainnya, bersama dengan apa-apa dokumen atau maklumat sebagaimana yang ditentukan oleh Pertubuhan.

Pemerakuan yang dibuat oleh pengamal perubatan di bawah perenggan

hendaklah dalam bentuk sebagaimana yang ditentukan oleh Pertubuhan.

Bagi maksud peraturan ini, “pengamal perubatan” ertinya seorang pengamal perubatan yang berdaftar di bawah Akta Perubatan 1971 [Akta 50].

Aktiviti program penempatan pekerjaan semula

Seksyen 17

(a)

menjalankan rancangan komitmen pekerjaan sebagaimana yang disediakan di bawah perenggan 15(d) dalam tempoh yang dinyatakan dalam rancangan komitmen pekerjaan itu; dan

(b)

mengemukakan laporan bulanan, dalam bentuk sebagaimana yang ditentukan oleh

Pertubuhan, mengenai pencapaiannya yang berhubungan dengan rancangan komitmen pekerjaan kepada

Pertubuhan tidak lebih daripada tiga puluh hari selepas orang berinsurans itu menerima elaun mencari pekerjaan.

Rancangan komitmen pekerjaan yang disediakan di bawah perenggan 15(d)

boleh dikaji semula oleh Pertubuhan dari semasa ke semasa.

Latihan

Jika Pertubuhan meluluskan permohonan di bawah subperaturan (1), orang berinsurans hendaklah—

(a)

menghadiri dan menyempurnakan latihan dalam tempoh yang dinyatakan; dan

(b)

mengemukakan bukti kehadiran bagi latihan itu yang diperakukan oleh pemberi latihan bersama dengan apa-apa dokumen lain sebagaimana yang ditentukan oleh Pertubuhan kepada Pertubuhan tidak lebih daripada tujuh hari selepas hari terakhir bagi bulan yang orang berinsurans itu menghadiri latihan itu.

Pertubuhan boleh meluluskan suatu permohonan bagi apa-apa latihan di bawah subperaturan (1) yang fi latihannya melebihi amaun maksimum fi latihan sebagaimana yang dinyatakan dalam Jadual Ketiga kepada Akta jika orang berinsurans itu bersetuju untuk membayar perbezaan antara fi latihan dengan amaun maksimum fi latihan itu sebagaimana yang dinyatakan dalam Jadual Ketiga kepada Akta.

Jika orang berinsurans menerima tawaran pekerjaan yang disebut dalam subperaturan (1), orang berinsurans itu hendaklah melapor diri untuk bertugas pada tarikh yang dinyatakan dalam tawaran pekerjaan itu.

Jika terdapat apa-apa tawaran pekerjaan yang dibuat secara terus oleh mana-mana majikan kepada orang berinsurans, orang berinsurans itu—

(a)

hendaklah memberitahu Pertubuhan bahawa dia itu telah menerima tawaran pekerjaan itu, secara elektronik atau selainnya, dalam masa satu hari dari tarikh tawaran itu diberikan kepadanya; dan

boleh menerima tawaran pekerjaan itu dalam masa tujuh hari dari tarikh tawaran itu diberikan kepadanya.

Jika orang berinsurans itu menerima tawaran pekerjaan yang disebut dalam subperaturan (3), orang berinsurans itu hendaklah melapor diri untuk bertugas pada tarikh yang dinyatakan dalam tawaran pekerjaan itu.

Bantuan kewangan

Pertubuhan boleh memberikan apa-apa jenis bantuan kewangan kepada orang berinsurans yang menyertai program penempatan pekerjaan semula mengikut apa-apa cara dan tertakluk kepada apa-apa syarat sebagaimana yang ditentukan oleh Pertubuhan.

Seksyen 21

Pemberhentian program penempatan pekerjaan semula

Pertubuhan boleh memberhentikan program penempatan pekerjaan semula bagi mana-mana orang berinsurans jika orang berinsurans itu—

(b)

tidak berniat untuk terus menyertai program penempatan pekerjaan semula itu;

tidak boleh dan tidak bersedia untuk bekerja disebabkan oleh keadaan kesihatannya;

(d)

gagal untuk mematuhi apa-apa arahan yang diberikan oleh Pertubuhan dalam masa dua minggu dari tarikh arahan itu diberikan;

telah memberikan butir-butir, dokumen atau penyata yang palsu, tidak benar atau tidak betul—

pada masa tuntutan bagi faedah dibuat;

(ii)

semasa penentuan tuntutan bagi faedah oleh Pertubuhan; atau

Suggest a correction

(iii)

semasa menyertai program penempatan pekerjaan semula; atau

(f)

telah melanggar apa-apa peruntukan Peraturan-Peraturan ini.

Penerusan penyertaan dalam program penempatan pekerjaan semula

Seksyen 22

Orang berinsurans boleh terus mengambil bahagian dalam program penempatan pekerjaan semula jika—

(a)

orang berinsurans itu tidak diambil bekerja selepas tamat tempoh menerima elaun mencari pekerjaan; atau

(b)

orang berinsurans itu menamatkan pekerjaannya dengan alasan yang munasabah dalam masa enam bulan dari tarikh dia melapor diri untuk bertugas.

EMPLOYMENT INSURANCE SYSTEM ACT 2017

EMPLOYMENT INSURANCE SYSTEM (BENEFIT AND RE-EMPLOYMENT PLACEMENT

PROGRAMME) REGULATIONS 2018

IN exercise of the powers conferred by section 85 of the Employment Insurance System

Act 2017 [Act 800], the Minister makes the following regulations:

PART I

PRELIMINARY

Citation and commencement 1.

(1)

These regulations may be cited as the Employment Insurance System

(Benefit and Re-Employment Placement Programme) Regulations 2018.

(2)

These Regulations come into operation on 1 January 2019.

PART II

BENEFITS

Claim for job search allowance and reduced income allowance 2.

An insured person shall submit a claim for job search allowance under section 34

of the Act or reduced income allowance under section 36 of the Act in Form SIPF 1

of the Schedule to the Organization, by electronic means or otherwise, together with such documents or information as may be determined by the Organization.

Date of submission of claim for job search allowance and reduced income allowance 3.

The date of submission of a claim for job search allowance or reduced income allowance under regulation 2 shall be the date on which the Organization acknowledges the receipt of the claim.

Notification of decision for claim for job search allowance and reduced income allowance 4.

(1)

If the Organization—

(a)

has approved a claim for job search allowance or reduced income allowance under paragraph 33(1)(a) of the Act, the Organization shall notify the insured person, by electronic means or otherwise, of its decision; or

(b)

has rejected a claim for job search allowance or reduced income allowance under subsection 29(2) or 31(3), or paragraph 33(1)(b)

of the Act, the Organization shall notify the insured person, by electronic means or otherwise, of its decision together with the grounds for rejection.

(2)

If the Organization has rejected a claim for job search allowance or reduced income allowance as specified under paragraph (1)(b), a claim for job search allowance or reduced income allowance in relation to the same loss of employment shall not be resubmitted to the Organization unless the Organization is satisfied that—

(a)

there is fresh evidence of a material fact that was not disclosed to the

Organization or the insured person at the time the decision to reject such claim was made; and

(b)

the resubmission of the claim is made within sixty days from the date the insured person has lost his employment as determined by the

Organization under subsection 29(1) of the Act.

Payment of job search allowance 5.

(1)

The first monthly payment of a job search allowance shall be paid to an insured person by the Organization immediately after the waiting period if the insured person participates in the re-employment placement programme under section 44

of the Act.

(2)

For every subsequent monthly payment of the job search allowance, the Organization shall pay the job search allowance to an insured person for that month after the Organization—

(a)

receives a monthly report of the employment commitment plan referred to in paragraph 15(d) from the insured person; and

(b)

is satisfied that the insured person has carried out the employment commitment plan and achieved the target as specified in the employment commitment plan.

Payment of early re-employment allowance 6.

(1)

An insured person shall notify the Organization of his acceptance of an offer of employment in Form SIPF 2 of the Schedule, by electronic means or otherwise, within seven days from the date the insured person accepts the offer of employment together with such documents or information as may be determined by the Organization.

(2)

Notwithstanding subregulation (1), where an insured person accepts an offer of employment and reports for duty within the waiting period under paragraph 35(1)(a) of the Act, the insured person shall notify the Organization in

Form SIPF 2 of the Schedule, by electronic means or otherwise—

(a)

of the acceptance of the offer of employment; and

(b)

whether or not the insured person elects to accept the early re-employment allowance, within two days from the date the insured person reports for duty.

(3)

Upon receiving the notification from the insured person under subregulation (1) or (2) and upon being satisfied that the insured person has accepted

the offer of employment and reported for duty, the Organization shall pay the early re-employment allowance to the insured person.

Payment of training allowance 7.

Upon receiving a proof of attendance of the training together with any other documents under paragraph 18(2)(b) from an insured person and upon being satisfied that the insured person has attended the training, the Organization shall pay the training allowance to the insured person.

Payment of training fees 8.

(1)

The Organization may appoint any number of training provider in such manner and subject to such conditions as may be determined by the Organization.

(2)

A training provider appointed by the Organization under subregulation (1)

shall submit a claim for training fees in Form SIPF 3 of the Schedule to the Organization, by electronic means or otherwise, together with any documents as may be determined by the Organization.

(3)

Upon receiving the claim under subregulation (2) and upon being satisfied that the training provider has carried out the training in respect of an insured person, the Organization shall pay the training fees to the training provider.

Payment of benefits to dependant 9.

(1)

If an insured person dies, is in coma or is of unsound mind—

(a)

after the insured person has made a claim for job search allowance, early re-employment allowance, reduced income allowance or training allowance under the Act; or

(b)

during the period in which the insured person is entitled to or is receiving a job search allowance, an early re-employment allowance, a reduced income allowance or a training allowance under the Act,

any dependant of the insured person shall immediately notify the Organization, by electronic means or otherwise, of such fact.

(2)

Any dependant of the insured person referred to in subregulation (1)

who intends to claim for the payment of the job search allowance, early re-employment allowance, reduced income allowance or training allowance shall submit the claim in Form SIPF 4 of the Schedule to the Organization, as soon as practicable, by electronic means or otherwise, together with such documents or information as may be determined by the Organization.

(3)

In the case of a dependant who is a minor, the claim made under subregulation (2) shall be submitted—

(a)

by his guardian; or

(b)

where there is no guardian, by any other person as the Organization deems fit.

(4)

Upon receiving a claim by a dependant under subregulation (2) or (3), the Organization may issue a notice, by electronic means or otherwise, to any other dependant who has been named in Form SIPF 1 of the Schedule but has not submitted his claim under subregulation (2) or (3).

(5)

The notice referred to in subregulation (4) shall contain information that a claim under subregulation (2) or (3) has been submitted by another dependant.

(6)

Upon receiving the notice issued under subregulation (4), such dependant may submit a claim in accordance with subregulation (2) or (3) to the Organization within such period as specified in the notice.

(7)

Upon receiving the claim from the dependant under subregulation (2) or (3), the Organization shall determine whether the dependant is entitled to the payment of

the job search allowance, early re-employment allowance, reduced income allowance or training allowance.

(8)

Where the Organization determines that a dependant is entitled to the payment of the job search allowance, early re-employment allowance, reduced income allowance or training allowance, the Organization shall pay the job search allowance, early re-employment allowance, reduced income allowance or training allowance to the dependant.

(9)

Where the Organization determines that a dependant is not entitled to the payment of the job search allowance, early re-employment allowance, reduced income allowance or training allowance, the Organization shall notify the dependant of its determination by electronic means or otherwise.

Date of accrual of benefits payable to dependant

10. If an insured person who is entitled to a job search allowance, an early re-employment allowance, a reduced income allowance or a training allowance provided under the Act dies, is in a coma or is of unsound mind, the date of accrual of such job search allowance, early re-employment allowance, reduced income allowance or training allowance payable to the dependants of the insured person by the

Organization shall be from the date the insured person dies, is in coma or is of unsound mind.

Mode of payment of benefits

11. The job search allowance, early re-employment allowance, reduced income allowance and training allowance shall be paid to an insured person, or his dependants under subsection 39(1) of the Act, by way of electronic fund transfer, cheque or any other modes of payment as may be determined by the Organization.

Notification on representation, claim or complaint under other written laws

12. (1)

If before submission of a claim for benefits under the Act an insured person has made—

(a)

any representation for reinstatement of employment under the

Industrial Relations Act 1967 [Act 177];

(b)

any claim for termination or lay-off benefits payment under the

Employment Act 1955 [Act 265], the Labour Ordinance of Sabah

[Sabah

Cap.

67]

and the

Labour

Ordinance of

Sarawak

[Sarawak Cap. 76]; or

(c)

any complaint relating to premature retirement under the Minimum

Retirement Age Act 2012 [Act 753], the insured person shall immediately, after submission of the claim for benefits, notify the Organization of such facts in such manner as may be determined by the Organization.

(2)

If after submission of a claim for benefits under the Act an insured person makes any representation, claim or complaint referred to in paragraph (1)(a), (b) or (c), the insured person shall immediately notify the Organization of such facts in such manner as may be determined by the Organization.

Change of particulars

13. If there is any change of particulars—

(a)

in Form SIPF 1, Form SIPF 2, Form SIPF 5 or Form SIPF 6 of the Schedule, the insured person shall furnish such change of particulars to the

Organization; or

(b)

in Form SIPF 4 of the Schedule, the dependant shall furnish such change of particulars to the Organization.

Service of documents or notices

14. Any documents or notice left at, or posted by ordinary post to, the address for service furnished by—

(a)

the insured person in Form SIPF 1, Form SIPF 2, Form SIPF 5 or Form SIPF 6

of the Schedule; or

(b)

the dependant in Form SIPF 4 of the Schedule, shall be deemed to have been duly served on the insured person.

PART III

RE-EMPLOYMENT PLACEMENT PROGRAMME

Participation in re-employment placement programme

15. For the purpose of participation in a re-employment placement programme, an insured person shall, by electronic means or otherwise, within the waiting period—

(a)

furnish any particulars;

(b)

furnish all information on his health and the relevant medical report;

(c)

complete a job placement and assessment form;

(d)

prepare an employment commitment plan; and

(e)

comply with such conditions, as may be determined by the Organization.

Deferment of participation in re-employment placement programme

16. (1)

The Organization may allow an insured person to defer the particpation in the re-employment placement programme for such period as determined by the

Organization if—

(a)

the insured person is certified as medically unfit by a medical practitioner; or

(b)

the insured person has any other reasons as may be approved by the Organization.

(2)

For the purpose of subregulation (1), an insured person shall submit an application to defer his participation in the re-employment placement programme to the Organization in Form SIPF 5 of the Schedule, by electronic means or otherwise, together with such documents or information as may be determined by the Organization.

(3)

Upon receiving the application from the insured person under subregulation (2), the Organization shall determine whether to approve or reject the application.

(4)

The Organization shall notify the insured person, by electronic means or otherwise, of its determination under subregulation (3).

(5)

The certification made by the medical practitioner under paragraph (1)(a)

shall be in the form as may be determined by the Organization.

(6)

For the purpose of this regulation, “medical practitioner” means a medical practitioner who is registered under the Medical Act 1971 [Act 50].

Re-employment placement programme activity

17. (1)

Upon commencing the participation in the re-employment placement programme, the insured person shall—

(a)

carry out the employment commitment plan as prepared under paragraph 15(d) within the period specified in the employment commitment plan; and

(b)

submit a monthly report, in the form as determined by the

Organization, on his achievement relating to the employment

commitment plan to the Organization not more than thirty days after the insured person receives the job search allowance.

(2)

The employment commitment plan prepared under paragraph 15(d) may be reviewed by the Organization from time to time.

Training

18. (1)

In the course of carrying out the employment commitment plan prepared under paragraph 15(d), an insured person may apply to the Organization in Form SIPF 6

of the Schedule to undergo any training provided by a training provider approved by the Organization.

(2)

If the Organization approves the application under subregulation (1), the insured person shall—

(a)

attend and complete the training within the specified period; and

(b)

submit proof of attendance of the training certified by the training provider together with any other documents as may be determined by the Organization to the Organization not more than seven days after the last day of the month in which the insured person attended the training.

(3)

The Organization may approve an application for any training under subregulation (1) the training fee of which exceeds the maximum amount of the training fee as specified in the Third Schedule to the Act if the insured person agrees to pay the difference between the training fee and the maximum amount of the training fee as specified in the Third Schedule to the Act.

Offer of employment

19. (1)

If the Organization informs an insured person of an offer of employment from any employer under subsection 44(3) of the Act, the insured person may accept

the offer of employment within seven days from the date of being informed of such offer.

(2)

If the insured person accepts the offer of employment referred to in subregulation (1), the insured person shall report for duty on the date specified in the offer of employment.

(3)

If there is any offer of employment made directly by any employer to an insured person, the insured person—

(a)

shall notify the Organization that he has received such offer of employment, by electronic means or otherwise, within one day from the date the offer is made to him; and

(b)

may accept the offer of employment within seven days from the date the offer is made to him.

(4)

If the insured person accepts the offer of employment referred to in subregulation (3), he shall report for duty on the date specified in the offer of employment.

Financial assistance

20. The Organization may provide any kind of financial assistance to an insured person who participates in the re-employment placement programme in such manner and subject to such conditions as may be determined by the Organization.

Discontinuation of re-employment placement programme

21. The Organization may discontinue a re-employment placement programme for any insured person if the insured person—

(a)

has been employed;

(b)

has no intention to further participate in the re-employment placement programme;

(c)

is not able and available to work due to his health conditions;

(d)

fails to comply with any direction given by the Organization within two weeks from the date the direction is given;

(e)

has furnished false, untrue or incorrect particulars, documents or returns—

(i)

at the time of the claim for benefits is made;

(ii)

during the determination of the claim for benefits by the Organization;

or

(iii)

in the course of participating in the re-employment placement programme; or

(f)

has contravened any provision of these Regulations.

Continuation of participation in re-employment placement programme

22. An insured person may continue to participate in the re-employment placement programme if—

(a)

the insured person has not been employed after the expiry of the period of receiving the job search allowance; or

(b)

the insured person terminates his employment with reasonable grounds within six months from the date he reports for duty.
