Section 27
Notwithstanding anything contained in these rules the Railway Department shall not be responsible for the loss, misdelivery or deterioration of or damage to any goods –
(a)
with respect to the description of which a declaration materially false has been made or delivered to the
Railway Department by the owner or person having charge thereof or the consignor; or
(b)
in respect of which a wrong or improper or insufficient address for delivery has been given; or
(c)
in respect of which the packing is improper of insufficient; or
(d)
with respect to which the consignor or consignee fails to comply with any rules or regulations in force, if the loss, misdelivery, deterioration or damage is in any way brought about by a false declaration or by giving a wrong or improper or insufficient address or by improper or insufficient packing or failure to comply with any rules or regulations in force, and in any case the Railway Department shall not be responsible for an amount exceeding the value of the goods if such value were calculated in accordance with the description contained in the false declaration.
