Section 21
(a)
The Railway Department shall not in any circumstances be liable for personal injury to any passenger –
(i)
who is travelling (whether with or without permission) in any part of a train other than the portion set aside for the use of passengers; or
(ii)
who is travelling on a free pass or privilege ticket; or
(iii)
who is travelling over a section of Railway in course of construction whether with or without permission.
(b)
A passenger ticket issued at a fare which is less than the fare payable in respect of an ordinary ticket is subject to any special condition which may be issued from time to time by Railway Department.
