Section 12

Section 12

(1)

The Director shall issue a notice requesting the permit holder to mitigate or rectify any damage caused to the environment or any damage caused to property, or for rectifying any damage as a consequence of any breach of the conditions of the permit.

(2)

If the permit holder fails to comply with subsection (1), the Director shall have access to the deposit referred to in section 10 (5) to give effect to subsection (1).

(3)

The Director may ask the permit holder to replenish the deposit.
