Section 86

(1)

Where any vessel, vehicle, article or thing is seized under this Enactment, pending the completion of the investigation or prosecution, the Director may temporarily return the vessel, vehicle, article or thing to the owner thereof or to the person from whose possession, custody or control it was seized, subject to such terms and conditions (including the suspension of a permit or licence issued under this Enactment) as the Director may impose, and to provide sufficient security.

(2)

Notwithstanding subsection (1), the security to be furnished thereunder shall not be less than the aggregate value of the vessel (including its equipment, furniture, appurtenances, stores, cargo and fishing appliance), vehicle, article or thing.

(3)

Any person who –

(a)

fails to surrender on demand to the Director the vessel, vehicle, article or thing temporarily returned to him under subsection (1); or

(b)

fails to comply with or contravenes any of the terms or conditions imposed under subsection (1), shall be guilty of an offence and shall be liable on conviction –

(i)

if a corporate body to fine not exceeding one hundred thousand ringgit;

and

(ii)

if not a corporate body to a fine not exceeding fifty thousand ringgit, or to imprisonment for a term not exceeding two years or to both.
