(2)
A notice under subsection (1) shall also state that the infringing goods will be released to the importer unless an action

for infringement in respect of the goods is instituted by the applicant within a specified period from the date of the notice.
(3)
If at the time of the receipt of the notice an action for infringement has been instituted by the applicant, the applicant shall notify the Registrar of that fact in the form as determined by the Registrar.
(4)
The applicant may, by written notice given to the Registrar before the end of the period specified in the notice (the initial period), request that the period be extended.
(5)
Subject to subsection (6), the Registrar may extend the initial period upon a request made in accordance with subsection (4)
where the Registrar is satisfied that it is reasonable that the request be granted.
(6)
A decision on a request made in accordance with subsection (4) shall be made within two working days after the request is made, but such decision cannot be made after the end of the initial period to which the request relates.
