Tribunal
(2)
In the case of a member of the Appeal Tribunal, if the Chairman is of the opinion that the member’s interest is in conflict with the member’s duties, the Chairman shall inform all the parties to the matter of the conflict, and—
(a)
if none of the parties to the matter objects to the conflict, the member may continue to execute his duties as a member of the Appeal Tribunal in relation to that matter; or
(b)
if a party to the matter objects to the conflict, the member of the Appeal Tribunal shall not continue to execute his duties as a member of the Appeal Tribunal in relation to that matter.
(3)
In the case of the Chairman of the Appeal Tribunal, the
Minister shall consider the matter and if the Minister is of the opinion that there is a conflict of interest with his duties as the Chairman of the Appeal Tribunal, the Minister may appoint any of the Deputies Chairman as a replacement Chairman in accordance with section 63.
(4)
The failure by the Chairman or any member of the Appeal
Tribunal to disclose his interest under subsection (1) shall—
(a)
invalidate the decision of the Appeal Tribunal, unless all parties agree to be bound by the decision; and
(b)
subject the Chairman or member of the Appeal Tribunal to the revocation of his appointment under subsection 64(2).
